It appearing that notice of said hearing has been given by sending notice thereof to the petitioner and all those owners of property deemed by the Board to be affected thereby, and to the public by posting notice of the hearing and published in The Register,the hearing was opened and held on the date stated above. The petitioner requests, in the alternative, a Special Permit or a Variance, in order to construct a temporary kitchen, to serve the needs of the hospital, during construction within the hospital which will render the facilities regular kitchen unusable. The portion of the petitioner's property at issue (with the Town Yarmouth)is in the R25 zone and MOD overlay zone. The petitioner represents that the temporary kitchen will be needed for approximately 9 months, beginning in March of this year. It will be located as shown on the site plan field with the Board, and will extend to the property line, adjoining Bayview Street. It will effectively have no setbacks, at its closest corner. A fire land and no parking zone will be established along the street line, and a no parking zone will be enforced around the structure. The"building" will actually be a series of mobile trailers, which will be delivered to the site and assembled in place. Because of this prefabricated situation, they have no ability to modify the size or shape of the structure to fit the available area. No one spoke opposed to the request. The Board finds that the proposed kitchen, to the extent that it qualifies as a structure, is allowable by Special Permit under bylaw §203.5 (R) in this MOD location. The Board finds that the proposed use, while not acceptable for a permanent structure, is acceptable for the modest temporary nature requested, especially given the public health demands and benefits of the hospital. The petitioner's have, under the circumstances, made appropriate arrangements with the Fire Departments to assure the safe access to and around the structure. As a result, it will be an inconvenience, but will not cause a substantial nuisance, hazard or congestion. At the end of its use, the assembly will be removed and the area returned to the open area originally proposed with the plans for the major adjoining addition, now under construction. Therefore, a motion was made by Mr. Richards, seconded by Mrs. Moudouris, to grant the Special Permit, as requested, which permit will remain in effect up to one year from its effective date (the issuance of the Certificate of Special Permit by the Board), but with the understanding that the 1 petitioner will remove the structure earlier if its use is no longer required. The members voted unanimously in favor of the motion. The petitioner then requested to withdraw the balance of the petition, without prejudice. A motion was made, seconded and voted unanimously in favor to grant this request. No permit shall issue until 20 days from the filing of this decision with the Town Clerk. Appeals from this decision shall be made pursuant to MGL c40A section 17 and must be filed within 20 days after filing of this notice/decision with the Town Clerk. This matter is scheduled for the January 26, 2006 Zoning Board of Appeals hearing agenda, and we would request that this correspondence be distributed to the Board prior to that hearing date. Background As the Board is aware, in the fall and winter of 2004, Cape Cod Hospital received permits from the Cape Cod Commission, Yarmouth Board of Appeals, Yarmouth Conservation Commission, Department of Public Health of the Commonwealth, the FAA, and the Barnstable and Yarmouth Building Departments to undertake the patient bed and materials management addition to Cape Cod Hospital. A copy of the Board of Appeals decision which was granted on December 9, 2004, and recorded with the Barnstable County Registry of Deeds in Book 19454, Page 79, is attached hereto as Exhibit A. Construction is presently underway at Cape Cod Hospital for the patient bed addition and materials management storage building. The upgrade and expansion of the interior Hospital kitchen is an important component of the renovation work associated with the addition projects. As was noted to the Zoning Board of Appeals (the "Board") and the other permitting agencies that reviewed the patient bed addition project, the present Hospital kitchen, which Nutter McClennen & Fish LLP • Attorneys at Law 1513 lyannough Road, P.O. The kitchen was designed at that time to serve 150 meals per day. Presently, the Hospital kitchen serves over 1,200 meals per day utilizing the exact same area and space that was created in 1963 (over 43 years ago). Accordingly, the kitchen is woefully undersized and inadequate to meet existing demands. Moreover, based on current census and population trends, all indications suggest that the Hospital will become busier and busier in the future. As such, enlargement, renovation and expansion of the interior kitchen area is of utmost importance to the proper care of patients and functioning of the Hospital. For the Board's reference, photographs showing the tight quarters in the kitchen are attached hereto as Exhibit B. In addition, as these photographs reveal, there is also inadequate storage space for kitchen supplies. As a result, the Hospital must receive deliveries on almost a daily basis because there is not sufficient area to keep the products and goods on-site. Therefore, in connection with the patient bed addition, the Hospital is proposing to enlarge the existing interior kitchen in roughly its present, although enlarged, area within the Hospital such that it has sufficient area to meet the existing and estimated patient, visitor and staff demands. The enlarged kitchen area will also have capacity to store goods for more than a day at a time, thereby reducing the number of delivery trucks coming to the Hospital on what is now an • almost daily basis. However, because the Hospital cannot close its doors during this construction phase, it must construct a temporary kitchen facility to serve the visitor, staff and patients during this important and significant expansion and renovation project. Proposed Temporary Kitchen While the interior kitchen is being reconstructed and enlarged, the Hospital is requesting dimensional zoning relief to allow for a temporary kitchen to be connected to the Hospital off of Bayview Street as shown on the proposed site plan attached hereto as Exhibit C. As shown on the plan, the temporary kitchen will be approximately 40 feet by 48 feet and will be connected to the Hospital. The temporary kitchen area will be served by town water and will be connected to the Town of Barnstable wastewater treatment facility. This temporary kitchen will be utilized to serve all the needs of the Hospital while the interior kitchen area is being renovated. The area upon which the temporary kitchen is proposed is shown on Town of Yarmouth Assessor's Map 36 as Parcel 1 and Map 28 as Parcel 55. It is located in the Residential 25 Zoning District and the Medical Overlay District ("MOD") as designated by the Town of Yarmouth Zoning Map. The property is not situated in the Aquifer Protection District. The temporary kitchen is only proposed to be in place for a period of approximately nine (9) months while the interior kitchen is being renovated. Once the interior kitchen has received all of the requisite occupancy permits, the temporary kitchen will be removed and the Zoning Board of Appeals January 23, 2006 Page 3 area will be modified back to the originally approved site plan conditions pursuant to the Cape Cod Commission approval and the Town of Yarmouth Zoning Board of Appeals approval in Petition No. 3928. The temporary kitchen was reviewed by the Yarmouth Site Plan Review Committee, and the Hospital and its consultants have had individual meetings with several the Building Commissioner, Fire Department and other town hall departments as needed to discuss the technical aspects of this proposal. Requested Zoning Relief The applicant has requested a special permit pursuant to Section 203.5(R) of the Yarmouth Zoning Bylaws to allow for intrusion into the front yard set back requirements off of Bayview Street. As shown on the site plans, the temporary kitchen will extend, in one corner, all the way to the lot line. This is the only zoning relief needed for the proposed kitchen area. Pursuant to Section 103.2.2, we believe that the requested special permit may be granted to allow for this temporary structure. As requested by the Site Plan Review Committee, because of the proximity of the proposed temporary structure to Bayview Street, the site plan designates the area immediately in front of the temporary kitchen as a fire lane to prevent any cars from parking in this area and thereby obstructing passage along Bayview Street. Although the temporary structure does extend to the lot line, since it will only be in place for approximately 9 months, there is no substantial harm to the future character of the neighborhood or town. Once the interior kitchen has been enlarged to meet the needs of the patients, employees and visitors of Cape Cod Hospital, this temporary structure will be removed, and the area will be returned to the conditions approved by the Board of Appeals and Cape Cod Commission. Any relief granted by this Board for this proposal could be conditioned on a period of time such that after the temporary structure was removed, if there were any future intrusions into the front yard setback in that area, the Hospital would have to come back to the Board for approval. Moreover, the Hospital did review whether it was possible to locate this temporary kitchen in another location or if it could be reduced in size. However, given the needs and demands of the Hospital, together with the current layout of the structures on the property, it was determined that this was the best location for this temporary structure. It is important to locate the kitchen in an area that is easily accessible to the infrastructure area of the Hospital and in a place where deliveries could be received and processed. Although the Hospital is sensitive to the fact that the structure will be located right along the lot line, this site was determined to be the most suitable on this short term basis. Zoning Board of Appeals111 January 23, 2006 Page 4 Based upon the foregoing, we respectfully request that the Board grant the requested special permit relief to allow for this temporary kitchen facility so that the Hospital may renovate and expand the existing woefully inadequate kitchen area to meet the existing and anticipated needs. The Hospital has worked closely with the Town of Yarmouth Health Department, in particular, to coordinate public health and safety issues associated with the temporary kitchen. In addition, the Hospital and its consultants have had several meetings with the Building Commissioner and the Fire Department to insure that the temporary kitchen can be placed in the proposed location without impacting public safety or operations in this area. As such, on behalf of the applicant, we respectfully request issuance of the special permit to allow for this temporary structure. In addition, we have, in the alternative, requested variance relief from the front yard set back should the special permit be denied. Based upon the shape of the Hospital property, together with the location of the existing Hospital on the lot, we believe that there are unique conditions relating to the location of the existing structures and the topography of the property. Further, the operational nature of the kitchen mandates that it be connected to the Hospital yet separated from the main visitor access areas. As such, we believe that the proposed location is the most suitable location on the property and therefore that compliance with the Zoning Bylaws would therefore result in substantial hardship to the Hospital. For the foregoing reasons, we believe that a variance may be granted pursuant to Massachusetts General Laws, Chapter 40A, §10, if necessary, should the Board feel that the special permit is not the appropriate approach. Conclusion The relief requested by this application is a necessary component in the overall vision and plans of the Hospital to upgrade and enlarge its facility and to better provide for and care for the residents of Yarmouth and Barnstable County. Clearly, the existing kitchen which was constructed approximately 43 years ago to serve 150 meals a day is in no way adequate to meet the needs of the Hospital. The relief requested by this application will allow for the Hospital to continue to serve its patients and employees while it renovates and reconstructs the existing interior kitchen to handle the existing and anticipated demand. Although the applicant acknowledges that the proposed temporary kitchen will necessitate substantial relief from the front yard set back requirements, given the desperate need for this use together with its temporary nature, we respectfully request that the Board grant the special permit relief. The site is located in the R25 Residential District and the Medical Overlay District (MOD). The Use, P4 Hospital, requires a Special Permit in the R25 zone and is allowed in the MOD. The proposed temporary use is anticipated to be needed for approximately 9 months. The use would be located in the required front setbacks. The applicant must apply to the Board of Appeals to modify the existing relief granted in Petition#3928, dated 12/09/04, and seek relief from the 20 foot front setback requirement outlined in Bylaw section 203.5, footnote R.
