The applicant is seeking a Certificate of Compliance. The proposed stone embankment was constructed with a high level of compliance with the Order of Conditions. The land area between the lawn and the stone array was heavily vegetated with beach grass immediately following construction. A grove of rugosa rose, an acceptable naturalized plant at the time, was planted on. the northeast portion of the work area. Other varieties have mixed into this planted buffer area over the past 20 years including various salt tolerant plants such as beach goldenrod, wild pea and upland grasses. The Order of Conditions indicates that monitoring reports would be filed. We do not believe any were filed because the applicant deemed the area quickly reverted to a heavily vegetated state and the current condition appearance adequately shows that. A row of cedar trees initially proposed on the north lot line was not planted. The privacy screening purpose was deemed no longer of interest by the adjoining land owners. Based on the current site conditions and known activities during construction the project was carried out in substantial compliance with the Order of Conditions.
