VARIANCE #4937: The Tasty Tidbits Realty Trust, 175 Route 28, West Yarmouth, MA.
Map & Lot #: 37.74; Zoning District: B-2. Review the conditions of Variance No. 4937
dated July 18, 2022.
The Petitioner has met the conditions of Variance #4937.
The Petitioner's representatives appeared before the Board to review the status of the conditions
of Variance #4937. The Board's conditions included: (1) Paint a Fire Lane on the pavement
around the building in a location determined by Yarmouth Fire Department, but in any event,
formally marked to preclude parking; (2) Obtain a Certificate of Compliance from Conservation
Commission; (3) Plant 5 in -lot trees in location shown on plan; (4) Lot to contain 66 total
parking spaces that are at least 9x1 S in size; (5) Parking spots that are removed shall be marked
on pavement as "No Parking"; and (6) Revised site plan to be submitted to the Board.
The representatives explained the Petitioners have completed the work at the property in
compliance with the Board's conditions. The Board was given a copy of the recorded Certificate
of Compliance. The Board briefly discussed whether the trees planted were healthy and whether
a fire truck could make its way around the building. The Petitioner's engineer explained his
meeting with the Fire Department to lay out the location and width of the Fire Lane. He also
explained hash marks were placed on the pavement where parking spaces were removed, and the
five foot pedestrian walkway was added to the front of the building. Mr. Fraprie noted that he
had been out to the property and the width of the parking spaces had been improved. After
deliberation, the Board was satisfied that the conditions had been met.
Accordingly, a motion was made by Mr. Igoe, seconded by Mr. Martin, to confirm that the
review of conditions occurred, and the Board was satisfied with its terms. On a unanimous voice
vote (5-0), the motion was approved.
