HEARING
The petition was duly filed. Notice was given as required by law,
including twice publication in the • LumoutaL_ Siin, a weekly
publication having circulation in Yarmouth. Pursuant to notice, a
public hearing was held by the Yarmouth Board of Appeals on April
9, 1992. In the course of the hearing, several questions were
posed to the Petitioner's representatives by the members of the
Board of Appeals. Several Yarmouth residents were heard and
responses were made by representatives of the Petitioner and by
Members of this Board.

REASON FOR .TIE DECISION
CRITERIA

The criteria for the grant of special permit are stated as follows:
1. Zoning By-law Section 103.2.2! Special permits shall not be
granted unless the applicant demonstrates that no undue
nuisance, hazard or congestion will be created and that there
will be no substantial harm to the established or future
character of the neighborhood or town.
2. M.C.L. , Chapter 40A; Special permits may be issued only for
uses which are in harmony with the general purpose and intent
of the ordinance or by-law, and shall be subject to general or
, specific provisions set forth therein; and such permits may
•
also impose conditions, safeguards and' limitations on time or
USG.
3. The change, extension or alteration of a prior existing
nonconforming structure criteria are stated in Section 104.3.2
of the by-laws as follows: •
" , .pre-existing nonconforming structures or uses may be
extended, altered or changed in use on special permit from the
Board of Appeals if the Board of Appeals finds that such
extension, alteration or change will not be substantially more
detrimental to the neighborhood than the existing
nonconforming use. . . ."

PACTS •
Based upon Information received at the hearing, the Petitioner
acquired locus, known as the Colonial House Inn in October of 1979.
The Inn was closed at that time and waa reopened and has been
,operated by the Petitioner as Innkeeper since 1980. Since that
time, the Petitioner has striven to restore the Inn as a quality
facility while maintaining its historic character as one of
Yarmouthpor.t's and Route 6A's beautiful and quaint destinations for
tourists and a dining place for area residents. In 1984, by
decision in Appeal No. 2085, this Board granted the Petitioner a
special permit to allow remodeling and restoration of the existing
carriage house adjacent to the Inn to provide for ten (10) guest
rooms. In 1989, by decision in Appeal No, 2655, this Hoard granted
the Petitioner a special permit to construct an inground, indoor
swimming pool, connected to the now remodeled carriage house. The
pool was constructed adjacent to the public area guest recreation
room, beneath the carriage house, all as described in Memorandum of
Decision, Perna Consultants, Inc. , et al vs. Board of Selectmen,
Town of Yarmouth Superior Court No. 46443 (1988). After obtaining
approval by way of a certificate of appropriateness from the Old
King's Highway Historic District (#2655 - 1989), the Petitioner
obtained a building permit (12/1/89, No. 706) to repair and rebuild
the foundation of the Inn building. This major undertaking
commenced in 1990. When the structure was raised, it was
determined that additional renovation, rewiring and replumbing
would be necessary. Inasmuch as the raised foundation would
require remodeling to provide access to the pool area and carriage
house, the lower level was required to be designed and constructed
as a public access area. On the plan sLbmitted to the building
department the three (3) rooms or areas in question as to this
appeal were casually labelled (1) office storage room (2) open area
and (3) furniture storage. Given the public/guest usage
specifications in construction the Petitioner was unaware that
these casual room name labels would be construed so as to limit
use. After construction was complete the Petitioner
furnished and decorated these areas which now connect the Inn to
the pool and public recreation area as (1) an office, (2) furnished
lobby, foyer or sitting room, and (3) a meeting and sitting room.
During an inspection of the premises in December of 1991, the
Building Department representative indicated to the Petitioner that
the labels on the plan must be strictly construed as a limit on
use, whereas the Petitioner believed the': the room names on the
plan had merely been intended to identify an area on the plan and
not as a limit on use.
Thus, at the request of the building inspector, this appeal was
filed so as to provide for a special permit, to allow for the change
in the rocm name labels and to extend the room uses in accordance
with said labels, but no structural alterations are requested, The

rooms, by agreement with the Building Department r n decorated and furnished
in accordance with the petitioner's intended use pending a decision by this
Board.
The area where these "rooms" presently exist was not formerly habitable space.
The required foundation improvements created this additional space, which the
petitioner now wishes to use in conjunction with the operation of the Inn.
It will therefore involve an increase in the habitable area of the Inn, and
thus requires a special permit. The Building Department previously allowed
the construction of this "area" and its use as passive storage, but not
as customer accessible area. The petitioner represents that the use of this
area will not in any significant respect, increase the volume of customers •
and guests using the inn facilities, This area will not be used for
dining, nor will it be used for separate functions. It will be used as an area
for groups (otherwise coming to the Inn) to congregate and meet, in conjunction
with functions and events already planned for the other Inn facilities. It
will not be hired out for additional functions or events. •
CRITERIA SATISFIED
The Inn is a prior existing non-conforming structure and use having
been constructed and operated well prior to current zoning, all as evidenced
by teh grant of the above referenced special permits by this Board. The
proposed use of these rooms by guests utilizing the services of the Inn will
not increase the intensity of Inn usage and will not increase traffic,
occupancy or noise. The use in question is entirely interior and thus no •
undue nuisance, hazard or congestion will be created. There will be no harm,
substantial or otherwise, to the established or future character of the
neighborhood or Town. The continued use of the Inn as an Inn is protected by
the Zoning by law and is thus in harmony with the general purpose and intent
of the by law. The upgraded and improved foundation, wiring, plumbing, fire
safety equipment and ventilation all promote the health, safety, convenience
and welfare of the Town inhabitants.
The current room labels allow for office storage, furniture storage, and
passage by Inn guests. The change to the uses requested are thus not
substantially more detrimental to the neighborhood than the existing non-
conforming uses. Thus, it may be concluded that all statutory and by law
criteria have been met.
CONCLUSION
Upon all of the evidence presented, a Motion watimade by Mr. Lindquist,
seconded by Mr. Schmidt, to grant the petition on the express condition that
the areas not be used for dining purposes, nor tie independently hired or
used for additional functions or events (i.e. it'shalonly be used as an
ancillary area for functions and events planned.for thi other facilities
at the Inn), Mr. Campbell, Mr. Lindquist, Mr. Schmidyand Mr. Reid voted
in favor: Mr. Oman voted against the Motion. a�1 v
The Motion therefore passed by a vote of 4111 -,
No permit shall issue until the passing of 20 days from the filing of this
decision with-the Town.Clerk.

It appearing that notice of said hearing has been given by sending
notice thereof to the petitioner and all those owners of property
deemed by the Board to be affected thereby and that public notice
16 of such hearing having been given by publication in The Yarmouth Sun
• on 6/28/89 and 7/5/89, the hearing was opened and held on the date
first above written.
Property located at the Colonial House Inn, on the south side of Route
6A, and shown on Assessor's Map #110 as parcel N2.
The following appeared in favor of the petition: Michael McGrath,
attorney for the petitioner; Mr. Malcolm Perna, petitioner.
REASON FOR DECISION
Malcolm Perna, the proprietor of the •Colonial House Inn, seeks a
special permit to alter/extend the Inn, a pre-existing nonconforming
structure. The Petitioner wishes to construct an inground, indoor
swimming pool, connected to the Carriage House, the use of which would
be limited to guests of the Inn and not to the general public. The
structure would be no •c1oser to the rear lot' line than the Carriage
House is 'and in' fact appears to meet current setback requirements.
No guess rooms :..-c to be .^C:.c:, as the enclosure 18 ' .. 3- '
approximately, would house only the inground pool. Petitioner states
that the structure, to be built •a: ,or below grade level of the parking
area, will not be visible from Route 6A, Historic District Committee
approval has already been granted, and site plan review comments have
been received.
No new traffic or occupancy will be associated with the pool. It 's
enclosure should contain any noise which its use may bring. The Board
does not envision any nuisance or hazard to be created by the pool,
either. It ' s addition to the Inn would seem to be benign.
Accordingly, the Board agrees with the petitioner's assertion that
the proposed structure will 'not be substantially more detrimental
to the neighborhood than the existing structures. This meets the
• Bylaw criteria set forth in S 104 .3.2, and on this basis, the Board
grants the special permit relief sought , as reflected on the plan
Oti submitted with the petition.
