Matt Bearse Project Summary Propose Riverwalk Park, Boardwalk Loop and Event Space. Comments uildin : Project is located in the B-2/ VC1 overlay district with a portion of the project located in the R25 residential zoning district. USE: Riverwalk Park: Is identified as an N9 use per Use Table 202.5 — Municipal Recreation Uses are an allowed use in the VCOD VC1. The elevated boardwalk to the kayak launch, the restrooms and pump station will require building permits. Special Events also fall under the following two uses which are by right uses in the VCOD VC1. • N3 — Theatrical productions, including bands, orchestras & entertainers. • N11 — Other miscellaneous amusement & recreation services Boardwalk: Is also identified as an N9 use per Use Table 202.5 — Municipal Recreation Use which requires a ZBA Special Permit as it is located in the R25 zoning District. The elevated boardwalk will require a building permit. Pump station: Is identified as a P10 municipal use per Use Table 202.5 and is also by right use in the VC1. SITE: Structures appear to meet setback requirements of Table 203.5. Each structure will require a separate permit per 780 CMR. Parking area does not indicate the standard is being met regarding the required canopy coverage of 30% per 414.8.9 c. Project will require a Stormwater Management Permit from the Conservation Commission which meets the Yarmouth Stormwater Management Regulations and is peer reviewed. Riverwalk project is required to go through the VCOD Site Plan Review process with the Planning Board (PB). The pump station will require floor plans and elevations to ensure compliance with Section 414.8. Further review will be required at the time of submittal with the PB as additional comments may apply. If compliance with the VCOD section of the zoning bylaw cannot be achieved, relief from the ZBA may be necessary. All construction to comply with 780 CMR MSBC and all other appendant codes and regulations. )Community Development and Planning: This project is an important goal of the Board of Selectmen and has overall wide- spread support from the community. It will provide a unique destination location in the heart of our commercial corridor to provide for an abundance of recreational opportunities, promote economic development by drawing people to Yarmouth and will help to promote redevelopment along Route 28. During the design phase, significant staff coordination has already occurred with the DPW, Engineering, Water, Parks, Building, Health, Conservation, Police & Fire. The project is at the 75% design phase with permitting having started in earnest in October 2022. 1. Concur with the Building Commissioners notes regarding the allowed Uses with the development of the Riverwalk Park/Event Space under the optional VCOD VC1 overlay district, and the boardwalk being a Special Permit as it is located in the R25 zoning district. Special Events for entertainment will need to be licensed by the Board of Selectmen. The Riverwalk Park/Event Space will need to go through the VCOD SPR process with the Planning Board which is handled through Community Development and includes input from the Design Review Committee (DRC). 2. Restroom design is proposed to be elevated to first floor elevation 12 and dry flood proofed to elevation 15. Coordinate with timing of upcoming amendments to the Building Code, permitting of the structure separately may be required. 3. Fill in excess of 4' will require a permit from the Building Commission per Section 302.1. 4. Project will require a Stormwater Management Permit from the Conservation Commission which meets the Yarmouth Stormwater Management Regulations and is peer reviewed. 5. Coordinate with the Health Dept and Engineering regarding the temporary tight tank and future sewer connection to the proposed pump station. 6. Coordinate with Eversource on 3-phase power to the site and pump station. 7. Coordinate with Parks Dept on maintenance of landscaping. 8. Miscellaneous: Ensure parking meets open space and canopy coverage requirements, trees to be a min. 3" caliper and meet the minimum height requirements of Section 414.8.9, ensure a virtually opaque level of screening to residential abutters to the west, replace the hydrant by Courtland Way, trash bins not solar, ensure lighting meets the foot candle requirements of Section 414.8.10, provide sail style shade structure, add angled interpretive signage on boardwalk and consider angled signage in the Riverwalk Park to avoid impacting views, and park entrance sign needs embellishment. Conservation: Requires a Stormwater Management permit, Notice of Intent complete with DMF and NHESP review, Waterways committee review, and Chapter 91 license through the state for the boardwalk. Our current regulations require inch spacing between planks for the boardwalk. Areas within the 100' buffer to a resource area and riverfront area should use straight native species, when possible, not cultivars. Stabilized aggregate may not be considered as pervious y the commission, an alternative material or a natural path would be preferred. Design Review: Not present, will review as part of the VCOD SPR process. Engineering: The applicant has met with DPW staff numerous times throughout the design. We have reviewed key elements such as the tight tank, drainage, bathhouse, coordination with the pump station and have had our considerations incorporated. We will continue to meet on landscaping and other key coordination details. In-depth review of the drainage will be deferred to the Conservation Commission and the stormwater regulations process and 3ro party review. ���fire: The Fire Department supports the project subject to applicable permits, submissions, and inspections. Hydrants as shown on plan and turning templates for emergency vehicle access. Health: Septic Tight Tank will need additional spec- size, H2O, waterproofing, pump float elevations in inches, alarm and light location ,DPW should review sewer line specs to town pump station; show mop sink in storage room, water lines and sewer lines shall not cross unless sleeved and specs shown on plan, future food trucks will need water and electrical hook UPS, Water: Not present Read & Received by Applicant(s)
