Appeal from the decision of the Planning Board - # 2022-2
ROAD Plan approval — 1272, 1276 & 1282 Route 28, S. Yarmouth MA
The owners of the above referenced properties on Route 28, South Yarmouth,
made application to the Planning Board for approval of their plans to re -develop
the property, pursuant to the ROAD Bylaw, section 411. This bylaw provides an
alternate process for such site development, whereby the applicant voluntarily
submits to Design Review before the Planning Board as a predicate to submission
to the Zoning Board of Appeal for special permit relief. The bylaw requires, inter
alia, that in order to be eligible to apply to the Board of Appeals, the project must
first be approved "by a majority of the Planning Board membership." ( section
411.6). On January 18, 2023, the Planning Board held a hearing on the owners'
application, and after hearing a Motion was made to grant the approval. Of the
Board members sitting on the matter, Joanne Crowley, Brad Goodwin, Ken Smith
and Chris Vincent voted in favor, while Susan Brita, Jim Saben and Will
Rubenstein voted against the motion. It was therefore declared that the motion had
passed by a majority vote and the plan was approved, authorizing the applicant to
proceed to apply to the ZBA for further relief under the ROAD Bylaw.
However, it has since come to the appellant's attention that Mr. Brad Goodwin was
not eligible to vote on the matter. As a result, the vote was only 3 to 3, and failed to
get the required minimum "majority" to be approved.
It is the appellant's contention that Mr. Brad Goodwin was not then eligible to vote
on the matter because he was no longer a resident of the Town of Yarmouth. We
will present evidence to the board to prove that Mr. Goodwin is a resident of the
Town of Sandwich, and has been for several years. His principal residence is at 24
Luscombe Lane, Sandwich, where he has, since 2005, registered a Declaration of
Homestead at that address, proclaiming it to be his principal residence, and has
renewed that Declaration under oath as recently as November 12, 2021. To the
best of our knowledge, Mr. Goodwin does not own any other property or residence
in the Town of Yarmouth.
The "Town of Yarmouth Boards, Committees and Commissions Handbook" states
under "Qualifications for appointment", "All Yarmouth residents registered to vote
in Yarmouth are qualified to apply for membership on any committee."
Massachusetts General Laws c. 41 sections 81 A and 11, setting forth the
procedures for appointment of Planning Board a members, states that an appointee
"shall be a registered voter of the town". General Laws chapter 51 sections 1
specify that one may register to vote "who is a resident in the city or town where
he claims the right to vote" . General Laws chapter 41 section 109 states that when
a general law or bylaw requires one holding a municipal office to be a resident of
the town, if an elected or appointed town or district officer removes from the town
or district in which he holds his office, he shall be deemed to have vacated his
office." ( In this context, the phrase "removes from the town" means moves his
residence out of town with the intention to remain in the other location. See:
Inhabitants of Barre v. Inhabitants of Greenwich, 10 Mass 129, (1822))
With due respect for Mr. Goodwin and his many years of service to the Town of
Yarmouth, once he moved his residence from Yarmouth to Sandwich, he ceased to
be a lawful resident and registered voter in Yarmouth and ceased to be eligible for
and a lawful member of the Planning Board. Having voluntarily "vacated his
office", he was no longer a Member of the Board and not eligible to cast a vote in
favor of this project on January 18, 2023.
Therefore the vote was, in effect, 3 to 3, and failed to secure a "majority" of the
Members of the Board. The Decision of the Planning Board should have recited
that the motion FAILED.

It is hereby certified by the Planning Board of the Town of Yarmouth, Massachusetts, that at a
duly called and properly posted and advertised Public Hearing of said Planning Board, held on
January 18, 2023, it was voted (4-3) to approve ROAD Application #2022-2 submitted for 1272,
1276 & 1282 Route 28, South Yarmouth with Brad Goodwin, Chris Vincent, Ken Smith and
Joanne Crowley voting in favor, and Susan Brita, Jim Saben and Will Rubenstein voting against,
with the following conditions:
1. Include more variety in tree species with fewer red maples.
2, Reduce footcandles under the gas pump canopy to industry standards of no more than 30
footcandles and reduce footcandles to 0.05 footcandles at the property line abutting
residentially zoned properties.
3. No fencing, vegetation removal, grading or ground disturbance shall occur within the
triangular area along the eastern property boundary where there appears to be conflicting
property boundary records.
4. Install a six (6) foot fence within the buffer area along the eastern property boundary to
within 20' of the Route 28 layout.
5. Install an eight (8) foot acoustic fence along the entirety of the northern property line
abutting the residential zoning district.
The plans and the application for the requested action were filed with your office on September 29,
2022, with a fourteen (14)-day extension filed with your office on October4, 2022, and a sixty (60)
day extension filed with your office on October 24, 2022.

PROJECT DESCRIPTION:
The site consists of three parcels totaling 1.14 acres which currently contain five cottages, a
convenience store and two gas pumps with canopy. The applicant proposes to demolish all
existing buildings on the three adjoining properties and construct a new gasoline filling station with
four dispensers, overhead canopy, a two-story mixed -use building with a 4,000 square foot (sf)
footprint, and associated site improvements including parking, traffic circulation, pedestrian
walkways, site lighting, various utilities and landscaping. The mixed -use building is proposed to
include a convenience store, coffee shop area, and drive-thru on the first floor; and four (4)
residential apartments on the second floor.
ZONING RELIEF:
The project will require the following zoning relief from the Zoning Board of Appeals:
1. Building front setback, section 203.5
2. Parking behind front setback, section 301.4.1
3. In lot trees, section 301.4.6 (1 short)
4, Drive through buffer distance to residential zone of 100', section 301.8.
5. Front landscape buffer width, section 301.4.4.
6. Al 2, multifamily use, table 202.5 (with no more than 50% of total building floor area being
used for residential)
7. H6, gas station use, table 202.5.

Upon further discussion with the Applicant, relief from section 301.4.3 for a curb cut in excess of
24 feet wide does not appear needed.
FINDINGS:
The Planning Board finds that the project meets the following general criteria for approval of a
R.O.A. D. District Development Plan as outiined in Section 411.5 of the Zoning Bylaw as follows:
1. results in economic benefits to the Town and is recommended by the Community &
Economic Development Committee.
2. the building will be mixed -use, making use of a second story for housing (top of shop).
3. the Design Review Committee and the Planning Board have both determined that the
project substantially adheres to the applicable sections of the Yarmouth Architectural and
Site Design Standards.
4. improves the aesthetics of the buildings using cape cod style architecture, traditional
looking building materials and muted colors.
5. promotes an attractive and viable commercial district.
6. improves the buffering along the public way with wider buffers with additional landscaping
and fewer curb cuts.
7. the site provides adequate internal circulation/egress and pedestrian access.
8. the benefits of the project outweigh the detriments resulting from the requested relief being
through a Special Permit.
NOTE TO THE APPLICANT: Approval by the Panning Board does not grant zoning relief,
Application must be made to the Board of Appeals.
NOTE TO PLANNING BOARD: Approval by the Planning Board must be noted on the plan to the
Board of Appeals as an endorsement, per Zoning Bylaw section 411.6.
NOTE TO THE BOARD OF APPEALS: Planning Board approval is a recommendation to the
Board of Appeals that the above referenced zoning relief be granted in the form of a Special
Permit, as outlined in Zoning Bylaw section 411.3.2.

Qualifications for appointment
Committee membership requirements are subject to the Board of Selectmen. All
Yarmouth residents registered to vote in Yarmouth are qualified to apply for
membership on any committee.
Application
The appointment application process begins with entry of your name and contact
information into the Town of Yarmouth's Talent Bank, maintained by the Town
Administrator's Office. A Talent Bank form must be completed and submitted in
order to be considered for membership on an appointed board or committee.

forms may also be obtained, completed and returned to the Selectmen/Town

You may register in the Talent Bank at any time, even when no vacancy exists on
your desired committee. Should such a vacancy occur, you and all other Talent Bank
applicants who declared a similar committee preference will be contacted and
invited to schedule an interview with the Board of Selectmen.
The Talent Bank shall be kept by the Town Administrator's Office and as time
permits, reviewed every three years by:
- contacting applicant to see if applicant is still interested in serving the Town.
- updating talent banks of applicants who wish to remain in active file.
- discarding talent banks of applicants who are no longer interested in serving the
Town.
Appointments
Most appointments to town boards (collectively refers to boards, committees and
commissions) are made by the Board of Selectmen. Some appointments are made by
the Moderator. The appointing authority shall have sole discretion to make such
appointments as the appointing authority deems to be in the best interest of the
Town. It is also suggested that applicants attend one or two meetings of the board
on which they are interested in serving to become familiar with the time
commitment and other functions of that Board.
