All filings must be made on Town of Yarmouth forms found at www.yarmouth.ma.us/325/Conservation. The
filing deadline is two weeks prior to the next scheduled Conservation Commission meeting. No new
information may be accepted into the Commissioners' packets within the week before a meeting.
Failure to follow this Checklist shall result in an Administrative Incomplete Application and will not be
advertised for a Public Hearing. Refer to the meeting and fee schedule. Contact the Conservation Office if you
need assistance.

1 hardcopy detailed project narrative to include sufficient information to enable the Commission to determine
whether the proposed work will alter an area subject to protection.

41 hardcopy Yarmouth Assessor's locator map highlighting parcel(s) where work is proposed, including map
and parcel numbers. Assessor's maps can be found at www.yarmouth.ma.us/70/Assessor
1 original and 7 photocopies of the plan/sketch, folded separately, right side out with title and address
visible. All plans shall reference NAVD1988 unless otherwise noted. Landscape plans shall be detailed to
show proposed and existing conditions, native species, size and spacing.

bdirienzoa.yarmouth.ma. us. Please put the property's street address in the pdf file name.

"YARMOUTH - RDA - Street Address - Applicant Name" and copied to bdirienzotayarmouth.ma.us.
We must receive a copy of this email as proof that it has been sent to DEP.
If applicable, submit a copy of any Certified Mail receipts (PS Form 3800) for others, such as Massachusetts
Natural Heritage and Endangered Species Program, Massachusetts Division of Marine Fisheries, etc.
Alternatively, you may visit their websites for electronic filing information. If filed electronically, please copy
bdirienzo@.yarmouth.ma.us.

REQUEST FOR DETERMINATION OF APPLICABILITY
#184 South Sea Avenue Unit 10, South Yarmouth
Project Narrative
The applicant is pleased to submit a Request for Determination of Applicability application for the
construction of an elevated deck addition. The 506,380 s.f. property is located within a residential
neighborhood and bordered to the east by a Salt Marsh and Lewis Pond. The proposed deck will
be will be located within Land Subject to Coastal Storm Flowage (LSCSF) zone AE (EL 11).
No work will take place within Priority/Estimated Habitat of endangered species. A staked silt
fence is proposed down gradient of all proposed work.
Worl< Proposed within Resource Area
Existing single family dwelling. Proposing to add an elevated deck attached to the southeast side
of the dwelling. All work will take place within existing lawn/developed areas. No fill is proposed,
and no ground disturbance will be necessary. The proposed deck will be cantilevered off the
existing dwelling. The existing fire pit will be relocated further away from the salt marsh. A 2:1
mitigation area is proposed to offset the increase in hardscape within the buffer.
Salt Marsh (310 CMR 10.32)
The edge of the Salt Marsh was flagged by BLH Environmental Consultanting, Inc. and located by
Down Cape Engineering. The closest part of the elevated deck will be 2.3' to the edge of the Salt
Marsh. No adverse effects from the work are expected, as the work limit line shall remain staked
in place until all work is complete, and the site is stabilized. The proposed mitigation will provide
an enhanced buffer to the edge of the Salt Marsh. The Salt Marsh will continue to act fully in its
capacity to provide habitat and food sources for wildlife.

• The property is located within flood zones AE EI. 11
• No fill is proposed
• The proposed work will not generate any additional stormwater runoff.
• No adverse impacts are expected during any flooding event.
All work will conform to flood zone and building code standards. No fill is expected to be required
for this project. On behalf of our clients, we hereby request a variance from the Yarmouth Wetland
Protection Regulations for proposed work to occur within 35' of a Resource Area.
