Bruce G. Murphy, MPH, R.S., CHO \� Petition 5004 — Special Permit request at Parkers River Resort, 759 Route 28, West Yarmouth. Hearing date February 23, 2023 February 21, 2023 Present and past use of this property has been a motel. Proposal Board of Health Health Division Jennifer G. Stanley and Patrick J. Demko have applied to change Parkers River Resort from a motel with 24 units to 100% seasonal employee housing with 24 units. Regulatory Regulations Town of Yarmouth bylaw requires all housing rentals to be registered annually, Chapter 108- OCCUPANCY OF BUILDINGS. This also requires the rental to be inspected as part of this process to ensure they meet 105 CMR 410.000 MINIMUIM STANDARDS OF FITNESS FOR HUMAN HABITATION (STATE SANITARY CODE, CHAPTER 11). Health Department uses the property septic system plan and square footage of bedrooms to determine occupancy allowance, for all rentals based on the State Housing Code. The Town of Yarmouth rental registration, Chapter 108 — Occupancy of Building bylaw, has been in place since August 24, 1978. Page 1 of 2 Health Department Involvement Housing inspector(s) ensure compliance of all housing rental units, by ensuring all are registered as required by Town Bylaws Chapter 108 and inspected for compliance with the State sanitary code 105 CMR 410.000. Only one inspection maybe needed for the seasonal rentals and motel units. Health Department has issued mixed use licenses to motels with seasonal rental. Additional Information Requested 1) What is the planned occupancy for each unit? 2) What is the proposed seasonal rental period? 3) What is the proposed motel rental period? 4) Can they also rent motel room's during the seasonal rental period? 5) Will there be plans for an onsite manager in the manager unit? 6) Who will be on the property to provide pool maintenance and monitoring? 7) Certified pool operator and safety person with CPR and First Aid. Health Department Recommendations 1) Annual registration and license is required of all rental units. 2) Annual registration and license of motel units. 3) Owner to register all 24 units and have them inspected.
