MME files this NOI pursuant to the Massachusetts Wetlands Protection Act (MWPA)(M.G.L. c.131 §40) and the Yarmouth Wetland Protection Bylaw (Chapter 143), and in accordance with the implementing MWPA Regulations, the bylaw regulations, and the town’s Notice of Intent Administrative Checklist. As explained in the enclosed project narrative (Attachment 1), the project meets the performance standards of Resource Areas associated with Big Sandy Pond and, therefore, this project serves all of the eight interests protected under the MWPA and the local bylaw, and the three additional interests protected under the bylaw (i.e., Recreation, Erosion and Sedimentation Control, and Surface Water Quality) as applicable. While a portion of the project footprint falls within the boundary of a mapped Priority Habitat of Rare Wildlife, MME believes that the Natural Heritage & Endangered Species Program will confirm that the proposed project will not impact the actual habitat of the rare species for which the habitat is mapped. MME attests that it will notify property abutters of this application and of the anticipated date (March 16) of the public hearing in accordance with state and local requirements. MME will send the State portion of the $110 filing fee to MassDEP and a copy of this application. MME has enclosed the additional $100 Yarmouth Conservation Commission bylaw fee, as well as a $10.00 payment to cover the legal advertisement cost. The filing deadline is two weeks prior to the next scheduled Conservation Commission meeting. No new information may be accepted into the Commissioners’ packets within the week before a meeting. Failure to follow this Checklist shall result in an Administratively Incomplete Application and will not be advertised for a Public Hearing. Refer to the meeting and fee schedule. Contact the Conservation Office if you need assistance. Submitting an Application: Does the property have any outstanding/expired Orders of Conditions? If so, please file a Request for Certificate of Compliance for each outstanding/expired Order, as the Commission may not issue a new Order until any outstanding/expired Orders have been closed and recorded. (*see page 2) 1 original hardcopy NOI application with original signatures (double sided). Typed signatures will not be accepted. 1 hardcopy comprehensive and detailed narrative of the project including existing & proposed conditions, construction sequence, type of equipment, staging locations, drainage and stormwater, erosion controls, invasive species management and alternative analysis. The narrative shall document how the project meets performance standards per 310 CMR 10.0 & TOY Wetland Bylaw, Chapter 143, BVW delineation sheets or other supporting information. 1 hardcopy 100’ radius map, current abutters list and abutters notification identifying the property owners who are to be notified per 310 CMR 10.00. Abutters list must be certified by the Town Assessor’s office. The Assessor’s office requires 7 days advance notice. All abutters must be notified via certified mail. 1 original and 7 copies of the plan, folded separately, right side out with title and project address visible. All plans shall reference NAVD1988 unless otherwise noted. Landscape plans shall be detailed to show proposed & existing conditions, native species, size and spacing. A pdf copy of the entire signed application, supporting information listed above, and plan emailed to bdirienzo@yarmouth.ma.us. Please list project property’s street address in the pdf file name. Submit Certified Mail Receipts (PS Form 3800) for all abutters. If applicable, submit Certified Mail Receipts for Massachusetts Natural Heritage and Endangered Species Program and Massachusetts Division of Marine Fisheries. EXISTING HOUSE: According to the property record card obtained from the Yarmouth Assessors office, the original house was constructed in 1989 and is a 1.5-story, three-bedroom, single-family residence that sits centrally on the lot. The rear yard is enclosed by fencing, mostly without trees, and is approximately 3,400 sf in area (Photos 1 and 2). Access to the pond margin is provided by an existing set of stairs down a wooded embankment (Photo 4). WETLAND RESOURCE AREAS: The +/- 18-acre Big Sandy Pond is a freshwater pond mostly contained by wooded embankments. Most of the pond’s perimeter is bordered by properties that have been developed for residential use. There is a man-made surface hydrologic connection between the pond and an active cranberry bog located approximately 450 feet to the northeast. Nearest the Site, the most landward wetland Resource Area associated with the pond is Inland Bank (310 CMR 10.54), which is an intermittently exposed, sandy pond shore (Photo 3). The pond shore supports a community of characteristic coastal plain pond shore herbaceous plants. In one location there is also a very narrow Bordering Vegetated Wetland (BVW)(310 CMR 10.55) area between the Inland Bank and the wooded upland. As illustrated on the site plan, the one-hundred feet-wide buffer zone to the Inland Bank and BVW extends landward to partially overlap both the house and the existing yard. COASTAL FLOODZONE: The entire property is outside of the nearest Zone AE coastal floodzone (FIRM 25001C0586J, effective on 7.16.2014) and, therefore, not within Land Subject to Coastal Storm Flowage (310 CMR 10.04). RARE SPECIES HABITAT: The Natural Heritage and Endangered Species Program (NHESP) of the Massachusetts Division of Fisheries and Wildlife maps a Priority Habitat of Rare Species associated with Big Sandy Pond (Figure 3). MME believes that this habitat (PH 262), which is a coastal plain pond shore habitat, supports the occurrence of State-listed rare plant species, which may include Plymouth rose- gentian (Sabatia kennedyana), pondshore Puritan knotweed (Persicaria puritanorum), and narrow- fruited beaksedge (Rhynchospora inundata). MME believes that NHESP will likely determine that the existing yard in the outer portion of the bank buffer zone where the project is proposed is outside of the actual habitat of the rare plant species. DEGREE OF SITE DISTURBANCE: The outer portion of the buffer zone is partially altered from alterations associated with residential development (i.e., house and yard) occurring decades ago. The buffer zone’s inner portion (i.e., that within fifty horizontal feet of the resource area) is intact and wooded except for the area within the stairway footprint. LAND ELEVATIONS: Maximum land elevation change on the property is between approximately fifteen vertical feet extending from elevation fifteen feet at the embankment toe to approximately thirty feet at the property’s highest point. The existing house sits at roughly the highest elevation. The land elevation at the proposed pool location is only slightly lower than the land elevation at the house. MARSH MATTERS ENVIRONMENTAL Notice of Intent PROJECT NARRATIVE March 2023 Wetland Resource Area ID and Boundary Determination Methods In advance of MME’s on-site observations, MME performed a desk-top review of available mapping resources and any documents that may have been provided by the applicant and project land surveyor as background material. MME reviewed all or some of the following data sources. Certain maps were used to produce a set of site locus figures, which are part of the NOI attachments. • Federal Emergency Management Agency (FEMA) Flood Insurance Rate Maps. • United States Geological Survey Topographic Quadrangle. • MassGIS MassDEP Wetland and Hydrography data layers. • MassGIS Natural Heritage Atlas data layers. • Google Earth Aerial photography. • United States Department of Agriculture, Natural Resources Conservation Service (USDA-NRCS) Web Soil Survey; and, • Mapping data layers provided by the subject municipality’s website (if available). MME performs WRA identification and delineations in substantial accordance with the following publications: the Massachusetts Wetlands Protection Act and the implementing MWPA regulations (310 CMR 10.00 et seq.); Section 404 of the Clean Water Act (33 U.S.C. 1344); the Massachusetts Department of Environmental Protection (MassDEP) publication Delineating Bordering Vegetated Wetlands under the MWPA (1995); and the U.S. Army Corp of Engineers (USACE) Wetland Delineation Manual (1987). When performing WRA identification and delineations, MME uses a methodology involving consideration of (1) plant community compositions and transitions between plant communities, (2) observed topographic changes in the landscape, (3) indicators of wetland hydrology, including evidence of extent of standing or flowing water in nearby waterbody or waterway, (4) the presence/absence of certain sub- surface soil morphological indicators (i.e., redoximorphic features) that confirm the presence, or absence, and approximate elevation of groundwater in the soil profile (relative to the ground surface) during a portion of the growing season, and (5) any evident land alterations. MME marks WRA boundaries with numbered tape flagging, or stakes, and typically collects a set of photographs that document on-site conditions on the day(s) of fieldwork. Entrance onto abutting property is usually incidental and often necessary in order to complete fieldwork and MME assumes that this entry, as well as establishment of wetland boundary flagging, has either been pre-approved, or is otherwise acceptable by the subject property owner and/or property abutters. For wetland indicator status ratings for vascular plants, MME refers to the National Wetland Plant List for the Northcentral and Northeast Regions administered by the U.S. Army Corps of Engineers (2016 updated version). For hydric / non-hydric soil profile determinations, MME consults Field Indicators for Identifying Hydric Soils in New England (Version 4, 2017). When noting the presence of invasive and potentially invasive plant species, MME uses plant status designations provided by the Massachusetts Invasive Plant Advisory Group (MIPAG). MARSH MATTERS ENVIRONMENTAL Notice of Intent PROJECT NARRATIVE March 2023 MME usually completes at least one set of MassDEP Bordering Vegetated Wetland Delineation Field Data Forms (Appendix Gs) when a Bordering Vegetated Wetland is delineated and/or if MME believes that this type of detailed documentation is necessary. One or more sets of these data forms may accompany this narrative / NOI and the information on the forms should be considered generally representative of plant community and soil profile conditions along the length of wetland boundary. Preparation of the attached site locus figures was part of MME’s desk-top review of the Site prior to observing site conditions. 2.0 Proposed Project As illustrated on the proposed project site plan (Proposed Pool Project Plan, by R.J. Hood, PLS, December 28, 2022), an 648-sf in-ground, swimming pool and surrounding, five feet-wide concrete pool decking will be installed in the yard area to the south of the house. The project area is currently a long-existing lawn area with a slight grade (Photos 1 and 2). Because of the existing grade, a low retaining wall of undetermined height may need to be installed on the pool’s northern side. The majority of the work will require the use of an excavator and skid-steer to remove soils and a dump truck to remove soil material from the Site for disposal. Equipment access will be via the existing driveway. The contractor will install a 1000-gallon infiltration galley on the west side of the house to receive pool drainage when necessary. A concrete pool utilities pad will be necessary, but its exact location has not yet been determined by the contractor. All yard areas that are disturbed during construction will be returned to existing grade and reseeded. The pool and surrounding patio installation footprint is approximately 1,288 sf, the majority of which is within the buffer zone, but outside of the inner portion of the buffer zone. Construction vehicle access areas are outside of the buffer zone. The work limit will be defined by continuous, staked-in siltation fencing along the existing fence line nearest the project footprint. The contractor will install this barrier prior to the use of excavation equipment. All or most of the excavated soil material will be removed from the site for disposal or for off-site reuse. The homeowner may utilize some of the soil material excavated from the project area to fill in low areas that have developed in his yard, but any resulting changes in yard elevations will be minimal. Additional conditions specific to enhanced erosion control and resource area protection that the issuing authority may include in the permit are anticipated and can be incorporated upon MME and contractor review. Any lawn area altered inside the work limit, but outside of the pool patio footprint during installation will be restored to either lawn or landscaped area. 3.0 Regulatory Compliance The intent of this required project narrative is to describe existing conditions, explain proposed project elements, and demonstrate that the proposed project will substantially meet the applicable performance standards for wetland resource areas at the Site and that the proposed project will meet any requirements for activities proposed in the buffer zone. As previously described and as shown in the accompanying existing conditions photographs, the entire project area is within the footprint of an open yard located within a fence line (currently used to MARSH MATTERS ENVIRONMENTAL Notice of Intent PROJECT NARRATIVE March 2023 contain family pets). While the pool project area is partially within the one hundred-foot BVW buffer zone, MME believes that this yard area currently serves no protective wetland buffer function, as it is devoid of vegetation and in a landscape position removed from the wetland resource. No work is proposed within fifty feet of the resource area. For primarily these reason, in MME’s opinion, conversion of this yard area to a pool area will result in no significant, direct or indirect adverse effect to the wetland resource characteristics, or to the ecological functions and services this wetland provides. MME believes that this project is eligible for an Order of Conditions approving the project, as the Inland Bank and BVW Performance Standards are met and the proposed work within the buffer zone will contribute to the protection of the Massachusetts Wetlands Protection Act and the Yarmouth Wetlands Bylaw interests.
