HomeMy WebLinkAbout5008 Planning Board Memo 03.03.23TOWN OF YARMOUTH 1146 ROUTE 28, SOUTH YARMOUTH, MASSACHUSETTS 02664-4492 Telephone (508) 398-2231, Ext. 1276, Fax (508) 398-2365 MEMORANDUM To: Zoning Board of Appeals From: Planning Board Date: March 3, 2023 Subject: Sandbar Management Inc. — 452 Route 28, West Yarmouth Town `N Country Family Resort Motel Seasonal Employee Housing at Motels/Hotels - Petition 5008 Planning Board RECEIVED 1MAR 0 6 2023 YARMOUTH BOARD OF APPEALS The Zoning Board of Appeals will be reviewing Petition 5008 on March 9` for the Town `N Country Family Resort Motel, 452 Route 28, to have up to 50% of their rooms used for seasonal employee housing. They are looking to use the Special Permit provision of Section 404.5.2 as they will not be meeting the by - right limitation of 15% of the hotel/motel rooms. The occupants of the seasonal housing rooms are to be employees of the nearby Wicked Waves Waterpark (same as Applicant), Red Jacket Beach Resort and Dunkin Donuts. The Applicant has experience with housing their own waterpark employees and have modified their protocols over the years to address issues as they arise, including having on -site private security and incorporating a bonus program for waterpark employees that are only dispersed if there are no housing issues with that employee. In their application, they have also provided a list of items in their Code of Conduct that each employee must sign including enforced quiet hours and clear protocols for failure to comply, closure of the outdoor pool located closest to the residential neighbors, use of shuttle vans, an onsite live-in manager as well as 24/7 security guard and cameras. There are also four (4) kitchens and laundry facilities available on -site for the seasonal employees. The Planning Board supports the petitioner's Special Permit application for one-year. The Board believes the applicant has demonstrated that they can successfully operate their motel in this fashion without negatively impacting the neighborhood while providing much needed seasonal employee housing. The Planning Board will continue to work with the Chamber of Commerce on this important issue and looks forward to incorporating your insights and suggestions on possible future amendments.
