The affect of the petitioner's request on required open space, a) Open space required for the approved 750 units equals 6,000,000 square feet b) Available open space equals 6,370,459 square feet c) Proposed road layout equals 37,782 and for these calculations is rounded to 40,000 square feet d) Present excess open space 370,459 SF- 40,000 SF Minus road layout=330,359 SF Proposed excess open space 7.59 acres) 2). The affect on maximum allowable units (formula) a) Total area: 193.67 acres or 8,436,455 square feet Minus road layout (rounded) - 40,000 square feet Equals = 8,396,455 square feet Minimum Lot Area Requirement: 20,000 square feet Incentive factor, Applicable Land Area @ 75 plus acres = 1.3 + .7 x M/T M: Number of dwelling units proposed to lie in multi -family structures T: Total number of dwelling units All proposed dwelling units will be in multi -family structures; therefore, 100% M/T = 100% or 1 8,396,455 SF 20,000 SF = 419.8228 x (1.3 + .7)(1) 419.8228 x (2) = 839.6 01JJZ WFV"7 b)- The total number of dwelling units which could have been built at Oak Harbour was 844 units. The total number of dwelling units which could have been built at Oak Harbour under the revised formula would have been 840 units. The Oak Harbour permits allow for only 750 units. 3). CONCLUSION The affect of the petitioner's request on the Oak Harbour open space requirements and allowable number of units is negligable in as much as: a) the project would still have over seven and one half acres of excess open space. b) the project would still have ninty less units than allowable under the formula. 4), REQUEST The owner requests that if the petitioners request is granted that the Board of Appeals in its decision indicate that said aproval does not affect the validity the owner's existing special permits, approvals, and variances; nor the owner's rights thereunder to seek modificiations and/or extensions thereof. b2oo Building West Yarmouth, MA 02673 617) 775-3433
