Thank you so much for your email to me of earlier today - relative to your and our request to schedule an on site
meeting at my house at 331 Union Street , Bass River , South Yarmouth with the Cape Cod Commission to look at the
house -and make a decision regarding the whether the existing house has any historical significance.
Pursuant to this end I met with Kristy Senatori of the Cape Cod Commission - earlier this afternoon to request an on site
meeting - with the appropriate representative of the Cape Cod Commission - at the earliest possible time .
Below is the email I sent to Kristy Senatori - following my meeting with her this afternoon- along with a copy of the
Memo and PDF sent to you by Atty David Reid on yesterday - February 28, 2023 - stating that his research indicates the
house at 331 Union Street has no historic significance - and requesting an on -site meeting at the existing house - as
soon as possible.
Thank you for your assistance and efforts in scheduling this meeting with Sara Korjeff - Planner and Historic Preservation
Specialist of the Cape Cod Commission - at the earliest possible date and time - so this matter does not cause undue
financial hardship for our family .
I am available to meet at the property - at the earliest possible available date in this most time sensitive matter for me
and my family .

Dear Kristy,
Thank you so much for taking the time to meet with me today to discuss my property at
331 Union Street - on Bass River in South Yarmouth - and the issue of whether or not
the existing house on the property has any historical significance .
As we discussed today - below for your review - and that of Sarah Korjeff - Planner and
Historical Preservation Specialist - is a memo from my Attorney David Reid - as
sent to Lisa Sherman of the Yarmouth Historical Commission yesterday - February 28 ,
2023 - with a related attached PDF - explaining that his research of the National Register
on my property at 331 Union Street , Bass River South Yarmouth - shows and
demonstrates that the house on the property - has no historical significance .
Further - as we discussed today - the previous owners of the property The Family of
Richard and Anthony Penny - who purchased the house at 331 Union Street in 1993 -
indicated to me - that as far back as 1973 - prior to their purchase of the property - the
entire house had been totally renovated by the previous owner - and the property has
also has been renovated after Hurricane Bob in 1991 and also altered and modified with
other renovations at different times over the past 30 years during the period of their
Penny family ownership.
As such - it is our belief and there belief - that there is no historical significance to the
house on the property.
In addition - the structural integrity of the existing house is very much in question now -
as due to recent storms - and excessive cold unprecedented sub zero weather of
February 3 and February 4, 2023 -the existing house has suffered some damage due to
Roof and Water Leaks - which has resulted in a few of the ceilings falling down in the
modern house - compromising the structural integrity of the existing home - which
could impact the safety of our family continuing to live in the house.
Finally - the existing house is located in an AE 12 Flood Zone - and in very close proximity
to the Water / Bass River which puts the existing house at risk from Flooding - and
consequently necessitates that the house needs to be knocked down and replaced with
a new flood compliant structure/ home to ensure the safety and structural stability /
integrity of the Family Dwelling
As I explained to you today - in our conversation - I bought this home for my family -
from the Anthony and Richard Penny on November 15 , 2022 .
Since that time we have designed a new Flood Compliant Home for the property - and
we have now received all approvals from both the Yarmouth Conservation Commission
and a Unanimous Special Permit Approval from the Yarmouth Zoning Board of Appeals
to allow us to build a new Flood Compliant Home on the property - which is very
important - particularly given the need for flood compliance in this Waterfront Location
- with the adverse implications of Climate Change on this property and other Waterfront
Properties on Cape Cod .
Our appeal period - allowing me to build a new flood compliant home on this property -
has now expired as of yesterday - Tuesday February 28 , 2023 - with no appeal from any
of our neighbors - which now makes it possible for us to proceed with the filing of
applications for the demolition of the existing house -and building of our new house on
the property .
During our hearing with the Yarmouth Zoning Board of Appeals - testimony was
incorrectly presented by a neighbor to the Yarmouth Zoning Board of Appeals - that he
thought our existing house on our property had historical significance. We believe this
information is not accurate - and a viewing of the property will clearly demonstrate this
fact .
Apparently- according to Lisa Sherman of the Yarmouth Historical Commission - the
testimony presented at our ZBA Hearing of January 26 , 2023 - suggesting that the
property has historic significance- automatically triggers a need for review by the Cape
Cod Commission to determine if the house has any historical significance .
It is our belief - based on Atty David Reid's research - as explained in his memo to Lisa
Adams - and the PDF information attached below - that our family property at 331
Union Street , Bass River is not historically significant .
Per our conversation of this afternoon- I am respectfully requesting your assistance in
interceding to schedule an on site visit to the property by Sarah Korjeff - Planner and
Historic Preservation Specialist for the Cape Cod Commission - at the earliest possible
time - so she can see the property - and it's lack of historical significance - allowing my
family and I to proceed with the demolition of the existing house and the building of our
new approved house without undue financial hardship or further delay .
Thank you so much for meeting with me to discuss this most important time sensitive
issue for our family and your consideration and assistance in this matter.

Thank you.
have been able to do some additional
research on the property. According to the
National Register listing, the house itself at
331 Union Street ( formerly #31) does not
appear to have any historical significance.
Mr. Kelley, who spoke at the hearing,
expressed concern for the location of the
Cooper Shop which would be historically
significant. However, according to the
attached materials from the Register, the
Cooper Shop was at 27 Union Street, not 31
( now 331) which is our subject property.
