All filings must be made on Town of Yarmouth forms. The filing deadline is two weeks prior to the next
scheduled Conservation Commission meeting for new applications. Failure to follow this Checklist shall result
in an Administratively Incomplete Application and will not be advertised for a Public Hearing. Refer to the
meeting schedule. Contact the Conservation Office if you need assistance.

Performance Standards Narrative, Alternatives Analysis, and Construction Protocol
Project Description
The purpose of this project is to reconstruct an existing failing rock revetment, enlarge an existing landing
somewhat, provide a vegetated buffer strip, make some repairs to an existing dock, return the current float
configuration to match the license, and dredge to -3 feet MLW. Each component of the project is discussed below.
Revetment; The existing revetment is suffering from sediment loss from behind the revetment. There are many,
many sinkholes along the top of the revetment, a few of the stones have started to shift, and the bottom toes stones
are exposed. This is a "grouted" revetment, with concrete in between the stones. Eventually, enough sand leaves
from behind the revetment, leaving large holes and then a large section collapses at once. This is a very dangerous
condition. The applicant wants to reconstruct the revetment in its same footprint and height, with deeper toe
stones. The revetment will still be "flat faced", but without grouting. Filter fabric and bedding stone will be
installed, and then some of the old stones, along with new stones, will be fitted to reconstruct the revetment.
Landing; The existing 8'xl2' landing is proposed to be expanded landward into the lawn area to be 12' x 14'.
This is a modest expansion that will reduce the existing lawn area by 72 square feet. The landing will be
constructed similar to the existing landing, supported by posts, etc.
Vegetated buffer strip; The existing Juniper bushes may serve as an existing buffer, but are a monoculture of
vegetation. They will be completely removed, and replaced with an 8' wide vegetated buffer strip consisting of
approximately 30 Bearberry plants, 25 Sheep Laurel plants, and 22 Beach Grass and other salt tolerant grass
plantings. This will provide a variety of plants that will occupy 602 square feet.
Dock Repairs and reconfiguration; The existing dock is in reasonably good condition. The deck boards and
handrails are in need of replacement, and there are a few broken cross braces as well. The piles are fine. Therefore,
the repairs are limited to "above the water", and no piles or in water work is proposed. The existing float
configuration is in excess of what is permitted and licensed. There is an additional float at the end of the first
float. This float will be removed, and the configuration will be returned to its licensed configuration.
Dredging; The reason for the additional float was to get the boat in deeper water. The proposed dredging will
provide the 3 feet of water necessary along the float so that the whole configuration is in accordance with current
standards. In addition, some of the outer (seaward) soils are vey mucky, so the dredging will improve shellfish
habitat by removing some of the unsuitable materials and dredging down to more suitable materials. See attached
construction protocol for dredging procedures and disposal.
Mean High Water Determination
The project site is located approximately 3 miles upstream from the mouth of Bass River. The distance upstream
causes a change to the tidal elevation due to the frictional loss of the tidal flow over distance. In this area, the tidal
range did not change and remains approximately 2.9 feet. Since the site is located close to the main flow of the
river, the Army Corps Tidal Profiles are reasonably accurate. The tidal elevations were verified with vegetation
on an adjacent site and observations and tidal measurements (tide guage) from Shorefront Consulting. Therefore,
MHW is at elevation 1.8' NAVD88, and MLW is at elevation — 1.1' NAVD88.
Navigation
The site where the dredging is proposed is in a large embayment in the river, called "the speed channel". It is the
only area of the river where there is no speed limit; boats can go as fast as possible in this area. However, the
project site is located on the northern edge of the river, out of the speed zone, and approximately over 200 feet
from the channel in that area. Therefore, there are no anticipated impacts to navigation of the waterway with
regards to this project.
Shellfish Survey
A shellfish survey was conducted in late December of 2022. Overall, there was a healthy shellfish population
found at the site out to the -4 NAVD88 (-4 MLW) depth.

There were a total of 22 Littlenecks, 41 Cherrystones, and 51 Quahogs found in 70 sample plots. According to
the shellfish survey, the sediments beyond this point were not suitable, and no shellfish were found seaward of
this depth. The dredging area reaches approximately 28 feet beyond this point; therefore the dredging may
improve the shellfish habitat in that area.
During the February 13, 2023 Waterways meeting, it was discussed as to how the existing shellfish would be
handled prior to the dredging. It was determined that the area should be fished out, with the shellfish located
laterally along the sides of the dredge area, in approximately the same water depth. The committee did not feel
that the shellfish would then be placed back to the original area, but that the shellfish would remain on either
side, and that the area would naturally repopulate on its own.
Alternatives Analysis (Discussion of Options)
Option 1- Do nothing
If nothing is done at this site, the revetment will continue to collapse, leaving a hazard and a mess along the
shorefront. In addition, continued erosion could lead to larger amounts of sediment being introduced into the
river, and undesirable condition. The dock decking will also continue to degrade, potentially leading to splinters
in hands and feet. Additionally, the current float configuration is not permitted, so this needs to be corrected. The
lack of sufficient water depth at the end of the floats has the potential for negative impacts to the bottom and
shellfish habitat, even though there was a healthy shellfish habitat found at this site. Therefore, the resource areas
will see less available water depth and more turbidity with the current configuration. Nothing will be gained with
the "do nothing" option, and it could potentially cause increased impacts to the resource areas. Therefore, this is
not the desired option.
Option 2 — Repair the dock and leave the revetment alone. This option was not discussed as the revetment is the
priority for this project.
Option 3 — Repair or reconstruct the revetment. This option was briefly discussed. Because this is a grouted
revetment, taking apart certain sections and leaving others is problematic. In order to make proper repairs, the
entire revetment has to be taken apart in order to properly place new filter fabric and bedding stone. It would be
more work to try to fix the revetment than to just disassemble it and reconstruct it. The resulting outcome to
reconstruct the revetment in its entirety will leave a revetment that will likely never have to be touched again.
Therefore, a repair of the revetment was not proposed, and is not the desired option.
Option 4 — Leave the dredging out of the work scope. The dredging is an important facet of this project because
it will improve the available bottom depths under the floats and boat. The dredging will improve the outer
stretches of the sediments towards the river, with the possibility of increased shellfish habitat. Since the
elimination of the dredging could lead to negative impacts to the surrounding resource areas, this is not the desired
option.
Option 5 - Preferred Alternative, Project as proposed.
It is desirable to have the boat oriented on the side of the float in sufficient depth at low tide, and in conformance
to the existing permits. The proposed dredging improves bottom sediments by removing some of the softer, anoxic
materials, leaving a cleaner, sandier bottom for shellfish production. The reconstructed revetment will provide
solid shorefront protection and eliminate excess soil from entering the waterway. The new vegetated buffer will
enhance the existing buffer by providing a mix of plants rather than a monoculture of plants. The deck expansion
will reduce turf lawn, and is not part of the vegetated buffer area equation. The dock repairs will make the dock
safer and stronger against storm activity. This option maintains existing permitted and licensed structures,
improves the resource and buffer zone areas, and is therefore, the preferred option.
Performance Standards
The project proposes the reconstruction of an existing revetment, dock repairs, and dredging in several resource
areas. The areas affected by the project include Land Subject To Coastal Storm Flowage, Coastal Bank, Coastal
Beach, Land Under Ocean and Land Containing Shellfish. Each resource area is addressed below separately.
The project as proposed will not have any significant adverse effects to the surrounding resource areas.

Land Subject to Coastal Storm Flowage (LSCSF) — LSCSF is considered a resource area under 310 CMR 10,
section 10.02 (1) d. The only work area that is within LSCSF is the area landward of the revetment. The work
proposed in this area is the landing expansion and the vegetated buffer strip. Any areas disturbed during
implementation of the project will be returned to their pre -construction condition. No significant negative impacts
to this interest are proposed either in the interim or during construction.
Coastal Bank - The area of work over/along the coastal bank consists of the revetment reconstruction. The top
of the revetment forms an "artificial" top of bank, below the flood elevation. The revetment reconstruction is
within the existing footprint, with larger toe stones that will be buried. The project will be conditioned to prevent
negative impacts to the bank. No negative impacts are anticipated. Therefore, the project as proposed can be
permitted under 310 CMR 10.30 (6) through (8).
Coastal Beach - The area of coastal beach extends approximately 3 feet from the bottom of the revetment to
MLW. The proposed work in this area consists of the installation of the new toe stones, which will be buried
when complete. The beach will look and act the same after the re -construction effort. The revetment
reconstruction will not change the role for the beach in storm damage prevention, flood control, or protection of
wildlife habitat. The existing configuration will also not change the volume or form of the beach sediments, the
ability of the beach to respond to wave action, or the effect for any downdrift beach. The work, as designed will
have no significant adverse impacts to the coastal beach, and therefore meets the performance standards for work
on a Coastal Beach. Therefore, the project as proposed can be permitted under 310 CMR 10.27 (1) through (7).
Land Under the Ocean —The dredging will improve clearance under the existing float and for the vessel, and
also will improve the sediments in this area, improving shellfish habitat, and increase the potential for increased
shellfish production. The construction protocol prohibits bottoming of the working barge to avoid negative
impacts to the bottom substrate. Projects not included in 310 CMR 10.25(3) which affect land under the ocean
shall if water -dependent, be designed and constructed, using best available measures, so as to minimize adverse
effects, and if non -water -dependent, have no adverse effects, on marine fisheries habitat or wildlife habitat caused
by alterations in water circulation, destruction of eelgrass (Zostera marina) or widgeon grass (Rupia maritina)
beds, distribution of grain size, changes in water quality, including, but not limited to, other than natural
fluctuations in the level of dissolved oxygen, temperature or turbidity, or the addition of pollutants; or alterations
of shallow submerged lands with high densities of polychaetes, mollusks or macrophytic algae. The project, as
proposed, has no adverse effects, and actually provides an improvement to the resource area. Therefore, the
project can be conducted and permitted to minimize adverse effects to the listed interests in accordance with 310
CMR 10.25 (6).
Land Containing Shellfish — As previously stated, the area around the outer reaches of the float and boat have
some silty material, potentially reducing the ability of the substrate to sustain shellfish. The area of dredging
closer to shore may be considered as an area significant to shellfish, and the proposed dredging will enhance the
area by removing unsuitable materials in the outer reaches of the dredge area, overall improving this resource.
The project as proposed reduces impacts to this resource, and will have no negative effects on the following
interests:
(a) alterations of water circulation;
(b) alterations in relief elevation;
(c) the compacting of sediment by vehicular traffic;
(d) alterations in the distribution of sediment grain size;
(e) alterations in natural drainage from adjacent land; or
(f) changes in water quality, including, but not limited to, other than natural fluctuations in
the levels of salinity, dissolved oxygen, nutrients, temperature or turbidity, or the addition
of pollutants.
By following these proper design and construction protocols, the project can be permitted as proposed without
negative impacts to the shellfish resource and in accordance with 310 CMR 1034 (4).

CONSTRUCTION PROTOCOL
The staging area for materials will be from the applicant's property and from a working barge. The work area will
include most of the entire back yard, and along the west side for equipment access. All equipment shall be stored
in the applicant's yard or on the working barge when not in use. A silt curtain shall be used during any silt
producing activity. All time of year (TOY) restrictions shall be strictly adhered to. The floats and any piles will
be removed for the dredging activity. The piles shall be reinstalled by mechanically driving them. If jetting is
used to initially set the pile, then proper protection against siltation shall be used. The dredged material shall be
properly transported and disposed of off site.
Revetment protocol:
The revetment shall be constructed from the upland. No equipment is anticipated to be on the beach at any time.
The revetment shall be reconstructed in sections only large enough to be reconstructed in a day or two. The
existing stones shall be stockpiled in the back yard, and re -used where possible. Some new stones will be required
and shall be delivered to the back yard, without trucks or stones remaining in the street.
Dredging protocol:
All dredging shall be performed outside of any time of year (TOY) restrictions. All dredging shall be performed
by mechanical means, utilizing a silt curtain to contain silt. All material removed from the area shall be properly
disposed of. The barge shall not come in contact with the bottom at any time, and be stored in sufficient water
depth to prevent grounding when not in use.
Pre -Construction Meeting
Prior to construction, at the discretion of the conservation agent, a pre -construction meeting shall be held on -site
with the Contractor, Property Owner, and the Conservation Commission and/or agent. The purpose of the meeting
is to clearly delineate the limits of work and access, as well as the staging area. The Contractor will describe the
proposed means and methods for performing the work within the requirements of the plans, order of conditions
and construction protocol. The Contractor will comply with mitigation measures as established by the
Conservation Commission.
To be discussed at this meeting:
• Existing property conditions, necessary precautions to be taken by the Contractor;
• Means and methods for construction;
• Necessary post -construction reparations and conditions;
• Procedure for post -construction inspection;
• Shorefront Consulting's responsibilities for inspection and project coordination
During Construction, the site shall be accessible for inspection during reasonable hours by all parties, members
of the conservation commission and their agents, and the Project Manager.
Post -construction meeting
Upon completion of construction and at the discretion of the conservation agent, a post -construction meeting shall
be held on -site with the Contractor, Property Owner, Conservation Commission and/or agent, and the Project
Manager (Shorefront Consulting). The purpose of this meeting is to determine that the project has been
satisfactorily completed in accordance with all permits, and that no additional work or mitigation is required by
the Contractor.
Restoration of project area
Upon completion of construction, and areas disturbed by the construction effort shall be returned as much as
practical to their pre -construction conditions to the satisfaction of the property owner and conservation agent. All
disturbed vegetated areas shall be re -vegetated with native vegetation to match pre -construction conditions for
the surrounding areas, or as determined during the pre -construction meeting.

On behalf of my clients, Joseph and Nina Iannelli, I am submitting (6) full size (24"x 36") copies of the project
plan and supplemental information for the above mentioned project. Electronic copies of all documents will be
emailed to the Natural Resources office. The following items are enclosed:

The purpose of the project is to completely reconstruct the existing revetment from the upland. The revetment
has been undermined and requires reconstruction. The existing permitted dock is only being repaired at this
time. The repairs are limited to decking and handrails, and a few cross braces that are broken. No piles are
proposed to be replaced at this time. Any piles in the dredge area will be temporarily removed and replaced.
The dredging is proposed to bring the existing permitted dock into current compliance with the -3' MLW depth
requirement at low tide. Over time, the area has silted in. Approximately 99 cubic yards of material is proposed
for removal. The dredging shall be accomplished by mechanical means, likely utilizing an excavator bucket to
put the material into a barge container. The container would then be transported to a boat ramp for offloading
into trucks. The dredging will likely be done in the off season, but only until January 15. The Division of
Marine Fisheries will likely have a Time -Of -Year restriction prohibiting dredging from January 15 to June 30.
The Shellfish survey was performed on December 29, 2022, with the results tabulated and shown in the
shellfish grid which is overlayed onto the dredging footprint plan. Overall, there was a healthy population of
shellfish in the area. The shellfish will likely require removal or relocation prior to the dredging operation. The
option exists to replace the shellfish back in the dredge footprint after the dredging is completed. For this to
occur, the shellfish would be temporarily relocated to the side of the dredge area, and then placed back
afterwards.

SITE CONDITIONS
The site consists of an existing rock seawall from the top of the coastal bank down to approx.
MLW. There is an existing wooden dock with pilings for a float. The bottom of the wall is
sand with a few stones. A significant quahog population is found across the survey area out into
the "speed channel" up to the point of transition to "black mayo". The "black mayo" extends
beyond into the "speed channel".

70 sample plots were established 10' apart laterally and 10' apart heading out from the end of
dock. The samples were achieved using a 1/2" standard quahog rake for 0, 10'20'30' and 40'
and 1/2" standard long quahog rake for 50' 60' 70' 80' and 90'.

A Notice of Intent was filed under the Massachusetts Wetlands Protection Act and the Yarmouth
Wetlands Protection By-law, by Joseph and Nina Ianelli with the Yarmouth Conservation
Commission on March 23, 2023 for the property located at 80 Grandview Drive, Map 91, Parcel
180 in Yarmouth, MA. The project is for the proposed Reconstruction of an Existing Permitted and
Licensed Rock Revetment, Repairs to an Existing Permitted and Licensed Dock, and Dredging.

In accordance with the second paragraph of the Massachusetts General Laws Chapter 131, Section 40, you
are hereby notified of the following:
A. The name of the applicant is: Joseph and Nina lannelli
B. The applicants have filed a Notice of Intent with the Yarmouth Conservation Commission, seeking
permission to remove, fill, dredge or alter an Area Subject to Protection under the Wetlands Protection
Act (MGL c. 131 s. 40 & Town of Yarmouth Wetland By -Law, Chapter 143).
C. The address of the lot where the activity is proposed is 80 Grandview Drive
D. Proposed work is for the reconstruction of an existing revetment dock repairs and dredging for a
permitted and licensed revetment and dock
