The Grantor, its successors and/assigns shall be responsible for the upkeep, maintenance, costs, and expenses of the easement area, but the Grantee shall be responsible for the cost of erecting and maintaining in perpetuity a fence around the easement area, and payment in perpetuity of all real estate tax assessments or betterments on Lot #25 with no contribution by the Grantor, or its successors and/or assigns. Grantee further agrees to coordinate joined raised areas for the septic systems of 9 Gilbert Street and 142 Seaview Avenue. Grantor hereby releases any and all homestead rights to the within premises,whether created by declaration or operation of law, and further states under the pains and penalties of perjury that there are no other individuals entitled to homestead rights to the property being conveyed herein.
