QUITCLAIM DEED
WE, PATRICIA D. AMADUCCI and SUZANNE AMADUCCI-ADAMS, Trustees of the
DIANE H. AMADUCCI REVOCABLE LIVING TRUST, under declaration of trust dated
January 25, 2019, an abstract of which is recorded with the Barnstable Land Court
Registry as Document No. 1,364,117 and recorded herewith, said trust with a mailing
address of 3510 Vista Court, Miami, FL 33133, in full consideration paid of THREE

to MARK HANDY and DARLENE HANDY, Husband and wife, as Tenants by the

Subject to and with the benefit of the matters set forth or referred to in Certificate of Title
No. 120631.

Reserving to the Grantor, its successors, and/or assigns a 25' x 100' wide perpetual,
exclusive use easement in, over, under, and upon (including air rights) Lot #25, known
as 0/unnumbered Gilbert Street, Yarmouth, Massachusetts, in favor of Lot #23, known
as 142 Seaview Avenue, Yarmouth, Massachusetts (side yard, Parcel ID:025.330,
Certificate of Title No. 218599) and Lot#24, also known under the same address as 142
Seaview Avenue, South Yarmouth, Massachusetts (lot with house, Parcel ID 025.329,
Certificate of Title No. 218600) for all purposes whatsoever as if Grantor still owned the
property in fee simple and all purposes allowable in the zoning district of the Town of
Yarmouth in which the premises is located, including, but not limited to, underground
plumbing, electrical and other utilities, under and above ground septic systems, hot tub
and/or pool systems, landscaping and hardscapes, outdoor seating, garages, gazebos,
sheds,patios,parking,installation of a driveway or fence,and the right to install an above
ground and underground septic system and/or sewer system going forward. Said
easement is more particularly described on Exhibit "A" Sketch Plan, recorded herewith
and incorporated by reference. The Grantor, its successors and/assigns shall be
responsible for the upkeep, maintenance, costs, and expenses of the easement area, but
the Grantee shall be responsible for the cost of erecting and maintaining in perpetuity a
fence around the easement area, and payment in perpetuity of all real estate tax
assessments or betterments on Lot #25 with no contribution by the Grantor, or its
successors and/or assigns. Grantee further agrees to coordinate joined raised areas for
the septic systems of 9 Gilbert Street and 142 Seaview Avenue.
Grantor hereby releases any and all homestead rights to the within premises,whether
created by declaration or operation of law, and further states under the pains and
penalties of perjury that there are no other individuals entitled to homestead rights to
the property being conveyed herein.
For Grantor's title to Lot 25, see Deed recorded in the Barnstable Land Court Registry as
Document No. 1,364,120 (Certificate of Title No. 218601).
For Grantor's title to Lot 26, see Deed recorded in the Barnstable Land Court Registry as
Document No. 1,370,205 (Certificate of Title No. 219430).
