The permit number for the building permit is BLD-23-001709—this has not been issued. My Inspector had a question regarding if there was any battery storage. The electrical permit number is BLDE-23-001515 and that was issued on 9/21/22. Once the building permit has been issued, I will send you're the permit card. Disqualification. Sunnova reserves the right in its sole discretion to disqualify any applicant or participant for, among other things, the provision of any false information in connection with the Program, which is a violation of these Terms and the Customer Terms and may result in the immediate disqualification of an applicant or participant in the Program and forfeiture of any Reward. You acknowledge that participation in the Program could result in a shortage of energy to power your home or the full or partial unavailability of your ESS for backup power depending upon the charging and discharging of the ESS as a result of participation in the Program and other factors, provided however, that Sunnova agrees to always maintain a minimum of 20% reserve charge in your ESS regardless of the Adjustment Events. You acknowledge this potential for loss and unavailability and agree that Sunnova and Battery Manufacturer shall not be responsible for any such losses, shortages, or unavailability of the ESS, and Sunnova and Battery Manufacturer shall not be responsible for the cost to replace the energy that flowed out of your ESS or any other costs and expenses associated with such circumstance. 9. Termination. Our ability to offer the Program is contingent on receiving certain approvals and acceptances from the Program Administrator. If such approvals and acceptances are withheld or withdrawn, or if the Program is discontinued for any reason as a result of a change in law or other reason,the Program will be terminated along with the Reward. In the event of such termination, Sunnova will provide notice to you by email. Termination of the Program will not affect your payment obligations to Sunnova under your loan and security agreement. 10. Right To Withdraw. You may withdraw at any time by calling 1-866-SUNNOVA and speaking with a customer service representative. It may take up to sixty (60) days to process your withdrawal. Privacy notice. Neither Sunnova nor the Program Administrators are responsible for any changesin your electricity costs during the Program. 13. Information. You represent and warrant that the information you provide while applying for and during the course of the Program is accurate and complete, and you agree to promptly notify Sunnova if any information you provided during your application for the Program has changed, 14. Governing law. This Program is governed by the laws of the state of the Installation Location above without giving effect to conflict of laws principles. 15. Dispute resolution. If you and Sunnova do not resolve any dispute by informal negotiation, any other effort to resolve the dispute will be conducted according to the terms in your agreement with Sunnova and by individual arbitration governed by the Federal Arbitration Act("FAA"). You are giving up the right to litigate(or participate in as a party or class member)all disputes in court before a judge or jury. To become a Participant in the Program, you must submit an application to, and have it accepted by, both the Sponsor and the Program Administrator (as each is defined below). By applying for the Program, you agree to comply with and be bound by these Terms, even if your application is not accepted or approved by the Sponsor (as defined below) and the Program Administrator. The decisions of the Sponsor and the Program Administrator regarding your eligibility to participate are final and binding in all respects. Exclusion for Failure to Connect to the Internet or Failure to Register your Powerwall In order to provide this Limited Warranty for the full ten year warranty period, Tesla requires the ability to update your Powerwall through remote firmware upgrades. Installation of these remote upgrades may interrupt the operation of your Powerwall for a short period. By installing your Powerwall and connecting it to the Internet,you consent to Tesla updating your Powerwall through these remote Upgrades from time to time, without further notice to you. If your Powerwall is not connected to the Internet for an extended period,or has not been registered with Tesla, we may not be able to provide important remote firmware upgrades. In these circumstances,we may not be able to honor your full ten year Limited Warranty.
