Dear Ms. DiRienzo,
On behalf of the Town of Yarmouth, we respectfully ask that the Yarmouth Conservation
Commission review the attached Conservation Restriction (CR) at your April 20, 2023 meeting.
We hope that the Conservation Commission will recommend town approval of this Conservation
Restriction by the Board of Selectmen.
The Higgins Crowell Road Conservation Restriction is for ten parcels of land on Higgins Crowell
Road, that the Town is acquiring for drinking water supply protection. This approximately 9.6-
acre area to be protected lies within a Zone II area of Contribution to Public Water Supply,
connects to existing conserved land, including 330± acres of water supply protection land, and will
connect and enhance wildlife and habitat protection. The conservation restriction outlines the
ecological values (e.g., wildlife habitat, water resource protection, biodiversity, trail connectivity),
prohibited and permitted acts and uses, public access, and legal description of the premises.
Preserving this property will ensure many conservation benefits as described in the document.
The Conservation Restriction is currently under review by the Massachusetts EEA Division of
Conservation Services, before coming to the Board of Selectmen for approval and signing. We
are anticipating recording of the Conservation Restriction by June 30, 2023. Please let me know if
you have any questions. We appreciate your consideration of recommending Board of Selectmen
approval of this CR.
