Box 727 West Yarmouth, MA 02673 DECISION Hearing DAte: 1/28/88 Petition No: 2514 The petitioner requested a special permit under section 103.2 to allow a heavy construction contractors yard in an -industrial zone. Property located at 58 Mid Tech Drive, West Yarmouth and shown on Assessor's Map #73 Lot T37,T38, & T39. Members of Board of Appeals present: Leslie Campbell, Fritz Lindquist, Joyce Sears, Richard Neitz, Ron Schmidt. It appearing that notice of said hearing has been given by sending notice thereof to the petitioner and all those owners of property deemed by the Board to be affected thereby and that public notice of such hearing having been given by publiction in The Register on 1/14/88 and 1/21/88, the hearing was opened and held on the date first above written. The following appeared in favor of the petition: William Weller; Thomas Power. The following appeared in opposition: Mark Galkowski, Water Commissioner. REASON FOR DECISION This is a request to allow a heavy contractors yard in an industrial zone. A letter was received from the Water Department with questions relevent to the protection of the public water supply. Mr. Mark Galkowski,.Water Commissioner for the Town of Yarmouth appeared in opposition to•this request. The area lies within the zone of contribution for 11 wells and - within 1,000 feet of a new well, and although the site is within an Industrial Area, it is not an area for a heavy construction contractors yard due to the mechancal repair, maintenance and chemicals used and stored on the site. Mr. Powers, representing the Petitioner stated that a minimum amount of heavy equipment would be infrequently stored on this Fzite as most equipment is left oii the job site. On a motion to grant the petftion &nth the restriction that the permit be issued for this petitioner only, and ; -Y1 on site,_.equipment be stored inside.
