Special Permit and Variance relief were previously obtained from the Board of Appeals in Petition
#4948 (April 2022) to reconfigure and redevelop the Property to replace the inflatable water rides
within the Wicked Waves Waterpark with a permanent water ride feature and associated
infrastructure, including a Variance for the height of the structure.
In accordance with the Yarmouth Zoning Bylaw and M.G.L. Chapter 40A, Decision #4948 needs to
be exercised withing 24 months for the Special Permit and 12 months for the Variance. The
Petitioner has ordered the permanent water ride feature; however, there has been a delay in its
shipment. Delivery is anticipated in September 2023, with construction beginning thereafter in order
to be ready for the 2024 season. Because of the above delay, the Variance portion of Decision #4948
cannot be exercised within the original 12-month period, and an extension was requested.
A motion was made by Mr. Fraprie and seconded by Mr. Martin to extend the Variance for 12
months. On a roll call vote (4-0), the request to extend the Variance for 12 months was approved.
