Below is a statement on behalf of Dennis Aceto regarding the open Order of Conditions issued to
28 Seminole Drive.
On April 27th, ELS reviewed the site plan titled “Existing Plot Plan Yarmouth Mass.” Dated June 17th,
2019, Revised 09/19/2019 regarding the expansion of a deck within the 50-Foot Buffer to a
bordering vegetated wetland. After reviewing the plan and on-site measurements it was
concluded that the deck was built within the square footage allowance under the issued Order of
Conditions. The deck platform measured 16 feet wide and 11 feet long, the steps measured 9 feet
long with a 4-foot width. The deck footprint was determined to be less total square footage than
permitted on the revised plan, thus the mitigation provided met the criteria under the original
permit.
ELS also completed all mitigation following the administrative review issued in 2019 and complied
with the plant list submitted as part of the administrative review in 2023.
This signed letter will serve to be a professional review of the application and submitted plan as a
result of the original engineer being deceased.
