Dear Mr. Grylls and Mr. Sears:
As Building Inspectors and members of the Code Enforcement Team, this correspondence is to
request your valued assistance with some matters at 5 Bray Farm Road South in Yarmouth Port, a
site that was recently developed.
This property is located in a commercial zone but it is also within a residential neighborhood. As such,
there are noteworthy concerns about the commercial appearance of the site which previously was a
native growth forest (photo enclosed of the pre-developed site). It now has multiple vehicles, etc.,
parked about the site and a vast open stone yard.
The building is permitted for storage and a commissary associated with a food truck business
operating from the property. While the newly built structure itself is attractive, what has also
accumulated at the property is as follows:
- Two enormous RV's
- Two dumpsters plus a trash receptacle
Two boats: a huge power boat and a canoe
- A large carrying trailer
A snow plow
- Much of the time a boxy food truck is also parked outside
It is doubtful that some of these items have anything to do with the approved use of the site and only
contribute to its unsightliness. It appears that the property is being used as a self-storage facility and
dumping ground for large vehicles.
As mentioned, the property was clear cut of the previously existing native forest. It is our
understanding that the Yarmouth Zoning Bylaw requires that commercial properties like the subject
must include a goodly buffer where either existing trees were to have been retained, along with
plantings consisting of a mixture of shrubs and other plants, with optional fencing or low walls. As you
can see in the photo of the site preceding the recent development, there is significant native trees and
vegetation along the side of the road which were all removed and the rest is wide open, paved or
stone covered. There does not appear to be any such required buffer area remaining to protect the
neighbors/neighborhood. This wide open appearance makes the site unattractive to the residential
neighborhood, which is undoubtedly the reason for the buffer requirements.
The owner appears not to have had any of the concerns of the neighborhood in mind when he
proceeded to use the site as a storage facility for numerous unsightly items and may have failed to
fully comply with the buffer requirement. He has been contacted about this matter but has done
nothing to remedy the problem which is the reason for this request to a governing body.
We will leave it to your expertise and authority to take enforcement action to have the property owner
correct the matter of the possibly illegally stored items as well as the buffer situation.
