At its 10/21/2021 meeting, the Conservation Commission reviewed a Notice of Intent for
the above property, for renovations to an existing single family dwelling within existing
footprint and upgrade of the septic system to title 5 standards within the buffer zone to
vegetated wetlands and a coastal bank. The Commission voted to approve the proposed
work. The approved plan is titled Title 5 Site Plan of 27 Longview Road, Yarmouth Port,
MA, Daniel Ojala, PE, PLS, Down Cape Engineering, dated September 10, 2021 (Rev).

At its 7/1/2021 meeting,the Conservation Commission reviewed a Notice of Intent for
the above property,for the expansion to existing commercial building over currently
developed areas within the riverfront area and land subject to coastal storm flowage. The
Commission voted to approve the proposed work. The approved plan is titled Captain
Parker's Pub, 668 Route 28 in West Yarmouth, MA (Barnstable County)Site Plan,Brian
Yergatian, PE,BSC Group, dated 6116/2021 (Rev).

The Conservation Commission is awaiting an after-the-fact filing for review of existing
and proposed work at this property. The property owner also holds an unresolved Order
of Conditions issued on 3/1/1979, for the original development of the property,including
construction of a restaurant and parking area,together with all work appurtenant thereto.
The Conservation Administrator has requested that a Certificate of Compliance be sought
to close this outstanding Order.The approved plan was titled Sewage disposal system for
proposed Lobster Hut Restaurant, Route 28, West Yarmouth, C.D. Spohr, dated 2/28/79.
The Conservation Commission will need to review the work completed under the old
Order before new work at the site can be approved.

Narrative: The Floor Plan open Raw Bar and Side Patio will be upgraded for weather protection
by adding window walls and an opaque roof. There are no seating changes at this time.
A new AAB compliant restroom and a new AAB ramp exit will be added to the rear.
Plans for the proposed construction are attached.
Background: The current building use is A-2r(Restaurant)and has been fully occupied in the past.
The building is not sprinklered. The building does have a full fire alarm system which
is deemed adequate for its'current occupancy. New devices will be added as required.
These are shown on the attached plan. Fire alarm work will require a separate permit.
IEBC 2015: Compliance Method -Prescriptive Compliance Method for Additions(Sec.402) w/
&IBC 201f. Alterations(Sec 403). Sec.403 Alterations include Sec.404 Repairs,Sec.406 Window
w/ Replacement and Sec.410 Accessibility. There are some MA Amends for this work.
MA Amend
Summary Para.401.2-New Building Elements and Materials are to meet the IBC 2015 requirements.
Existing materials already in use may remain unless deemed unsafe.
Paras 402.1 &403.1 -Alterations being made will not make the building less conforming
than the building was prior to the alteration.
Para.402.2&403.2-Both the additions and alterations do not constitute a substantial
improvement'so that additional floodzone compliance measures are not required
Para.403.3&4-There will be no changes to the existing gravity or lateral load resisting
systems. IAW Para.403.3.1 there is no increase to the design live load. New work
is required and will meet current(IBC 2015)construction requirements.
Para.406.1 -Installation or replacement of windows is required to meet the standards
of new installation work; glazing, locations and connections.
Para.410.3-The extent of the alterations do not pose a requirement for any greater
accessiblity HOWEVER the additions will provide a new AAB compliant restroom &ramp.
Para.804.2.2-Fire Protection; requirements to add/upgrade a sprinkler system are not
met based upon both the value of the proposed work and the area increases.
All the proposed work is less than 33%of the assesed value(for sprinklers)and
much less than 50%of the building area(for construction).
Para. 804.4.1 -Fire Alarm; Existing alarm notification devices shall automatically activate
throughout the building. Where there are no devices alarm and notification equip-
ment shall be provided.
