Bergan Van Doren Revocable Living Trust, William K. Mackey and Lucinda V. Albrecht. There are a couple of activities being proposed as part of the Notice of Intent filing for the property at 4 Malfa Road, West Yarmouth, MA. The proposed activities are listed below (please reference attached project plans). The proposed work consists of a Coastal Beach and Coastal Dune stabilization project to eliminate the ongoing erosion at the subject parcel. All proposed work consists of a stabilization project, no new development is proposed. Work will take place on the Coastal Beach and Coastal Dune and within Land Subject to Coastal Storm Flowage. The project will result in a net environmental benefit after the work is complete. The proposed activities are further described below. 1.2 Applicable Regulations This application has been filed jointly with the Department of Environmental Protection, pursuant to the Commonwealth of Massachusetts Wetlands Protection Act (MWPA, M.G.L. Chapter 131, Section 40) in accordance with its implementing regulations (310 CMR 10.00); and the Town of Yarmouth Wetlands Protection Regulations Part 1 and 2, Yarmouth Bylaw Chapter 143, 2.0 BACKGROUND 2.1 Existing Conditions The project site is located at 4 Malfa Road, West Yarmouth, MA., a private residential property with views of Lewis Bay. The property is currently occupied by an existing single-family dwelling, garage, brick landing and steps, flagstone walk, brick patio, concrete pad, stone steps, A/C, Generator, rinse station, timber retaining walls, a dog kennel with fencing, a concrete pad, and a septic system. The property is also occupied by existing stone driveway picket fencing, manicured lawn and landscape areas. The lot is approximately 18,483 square feet in area. It is currently developed with a single-family dwelling, detached garage, brick patio, lawn, and landscaped areas. The entire waterfront currently has areas of erosion. 2.2 Property History The property is located at 4 Malfa Road, West Yarmouth, MA. and is shown on the Town of Yarmouth Assessors Map as 20-27.1 and comprised of 18,483 +/- square feet in area. The property has been a lot on record since on or about October 1, 1941, and has been developed as a legal single family residence as of 1966, per the Town Assessors records. 2.3 Site Characteristics The residential single family dwelling is situated affording views to the south across Lewis Bay. The property is located in FEMA Flood Zone VE (EL. 13) and AE (EL. 12), as shown on the FEMA Flood Insurance Rate Map No. 25001CO569J dated July 16, 2014. Flood Zone elevations shown and referenced are based on the 1988 North American Vertical Datum (NAVD 1988). The topography for this is relative flat. Page 1 NOTICE OF INTENT APPLICATION 4 MALFA ROAD, WEST YARMOUTH, MA 3.0 PROPOSED PROJECT 3.1 Scope of Work The project is located at 4 Malfa Road in West Yarmouth. The proposed work consists of three types of stabilization to restore and minimize erosion on the beach and dune area of the property. The most seaward portion of the stabilization includes the installation of a reinforced high marsh which is a below -grade matric of cobble, compatible sediment, coir fibers, and compost encased in biodegradable material. The second area moving inland consists of fiber rolls installed on the landward side of the reinforced high marsh. The array will be installed at 1 1.5:1 slope angle, beginning in the lowest course of fiber rolls and continuing up gradient. Lastly nourishment of the dune with compatible sediment is proposed as shown on the project plans. See Stabilization Plan by Wilkinson Ecological Design and Work Protocols for Reinforced High Marsh and Fiber Rolls document by Wilkinson Ecological Design for all locations, construction protocols and additional details. A temporary staging area for the proposed work that will be designated for material storage and woodcutting will be located in the upland. 3.2 Resource Areas The wetland resource areas found on or within 100 feet of the site include Land Under the Ocean, Land Containing Shellfish, Coastal Beach (CB), Coastal Dune (CF), Land Subject Coastal Storm Flowage (LSCSF). Stabilization work is proposed within the Coastal Beach, Coastal Dune and Land Subject to Coastal Storm Flowage. All proposed work consists of stabilization only, no new development is proposed. See Section 5.0 for the applicable performance standard analysis of each resource area. 3.3 Construction Methodology The Order of Conditions and signage will be posted at the site and the area staged for construction. Efforts will be coordinated to minimize construction time and disturbance within and around the subject resource areas. Construction methodology is outlined in detail in the Work Protocols for Reinforced High Marsh and Fiber Rolls document by Wilkinson Ecological Design 3.4 Anticipated Impacts The proposed project is a stabilization project only and will greatly enhance the shoreline's ability to withstand erosion while also enhancing the location with beachgrass and high marsh. The project as designed can be implemented with typical methodologies and measures. No adverse impacts associated with this project are anticipated. All disturbances will be kept to the minimum necessary to complete the stabilizationactivities. 4.0 MINIMIZATION AND MITIGATING MEASURES 4.1 Mitigation Measures The entire project is a stabilization project, no mitigation is required. The project has been designed to provide a long term environmental benefit. Page 2 NOTICE OF INTENT APPLICATION 4 MALFA ROAD, WEST YARMOUTH, MA 5.0 APPLICABLE PERFORMANCE STANDARDS 5.1 Land Subject to Coastal Storm Flowage (LSCSF) Land Subject to Coastal Storm Flowage is low lying land which lies in a flood hazard zone, as delineated by FEMA maps. A flood zone delineates the land area which will be inundated by a 100- year storm event. The Federal Emergency Management Agency (FEMA) has established the 100-year base flood elevations located on the property as Flood Zone VE(EL.13) and AE (EL.12), within the reach Lewis Bay, as shown on the plan of reference. All Flood Zone elevations shown and referenced are based on the 1988 North American Vertical Datum (NAVD 1988). As defined in the Commonwealth of Massachusetts, Wetland Protection Act (WPA) 310 CMR 10.04 and the Town of Yarmouth Wetland Protection Regulations Part 2. S. 2.10 — Land Subject to Flooding or Inundation by Coastal Flowage (LSCSF): Definition Under Town of Yarmouth Wetland Protection Regulations Part 2.10 (2) - "Land Subject to Coastal Storm Flowage " are areas that extend up -gradient or landward from the ocean and the ocean's estuaries to a point where the maximum lateral extent offloodwater will theoretically terminate based upon the 100 year frequency storm. Said boundary shall be the relevant 100 year storm elevation referenced within the latest available Flood Insurance Rate Maps provided by the Federal Emergency Management Agency. A. Definition — in 310 CMR 10.04 for Land Subject to Coastal Storm Flowage. Henceforth, the abbreviation for Land Subject to Coastal Storm Flowage (LSCSF) shall be used to mean Land Subject to Flooding or Inundation by Coastal Flowage. Performance Standards — (3) Performance Standards: Any activity within land subject to coastal storm flowage which will result in the building upon, removing, filling or altering land within 300 feet of a major estuary defined in section 1.04 of these regulations shall meet the following requirements. Notwithstanding this section 2.10, (3), beach nourishment and coastal engineering projects such as bulkheads and seawalls may be allowed if they meet all other performance in these regulations. (a) Existing septic system and cesspool repairs will be allowed provided they substantially meet all Title 5 and local Board of Health thresholds. (b) All groundwater elevations shall incorporate seasonable adjustments if test holes and or leaching components are 100 feet or closer from major estuaries. (c) Any proposed deck, shed, or other similar structure must be securely anchored to a footing or foundation. The project proposes to perform Beach and Dune area stabilization only, no new development is proposed, The project area is not a Critical Erosion Area as shown on maps prepared by the Massachusetts CZM Shoreline Change Analysis project. All the proposed work lies within Land Subject to Coastal Storm Flowage. The Coastal Beach is located upland of the Mean High -Water line, off the shores of Lewis Bay. The Coastal Beach has been identified and had been delineated with Flags numbered CB-1 to CB-6 as shown on attached site plan. As defined in the Commonwealth of Massachusetts, Wetland Protection Act (WPA) 310 CMR 10.04 and the Town of Yarmouth Wetland Protection Regulations Part 2. S. 2.02 — Coastal Beaches and Tidal Flats: Definition Under Town of Yarmouth Wetland Protection Regulations Part 2.02 (1) - " Coastal beaches, which are defined to include tidal flats, are significant to wildlife, wildlife habitat, storm damage prevention, flood control, and recreation. In addition, tidal flats are likely to be important to the protection of wildlife, wildlife habitat, marine fisheries, and where there are shellfish, to land containing shellfish. Coastal beaches dissipate wave energy by their gentle slope, their permeability and their granular nature, which; in turn, permit changes in beach form in response to changes in wave conditions. Coastal beaches serve as a sediment source for dunes and subtidal areas. Steep storm waves cause beach sediment to move offshore, resulting in gentler beach slope and greater energy dissipation. Less steep waves cause an onshore return of beach sediment, where it will be available to provide protection against future storm waves.... " 72. Definition — (a) "Coastal Beach" unconsolidated sediment subject to wave, tidal or coastal storm action which forms the gently sloping shore of a body, of salt water and includes tidal flats. Coastal beaches extend from the mean low water line landward to the coastal dune line, coastal bank line or the seaward edge of existing man made structures, when these structures replace one of the above lines, whichever is closest to the ocean. Performance Standards — (3) Performance Standards: Any activity which is allowed on a coastal beach or tidal flat or within 100 feet of a coastal beach or tidal flat shall not have an adverse effect on the coastal beach or tidal flat by. (a) affecting the ability of the waves to remove sand from the beach or tidal flat, (b) disturbing the vegetative cover, if any, so as to destabilize the beach or tidal flat, (c) causing any modification of the beach or downdrift beach that would increase the potential for storm or flood damage, (d) interfering with the natural movement of the beach or tidal flat, (e) causing artificial removal of sand from the beach or downdrift beach. There are no Vernal Pools located within 100' of the project site. The property shoreline is low, relatively flat, and vulnerable to erosion by rising sea levels and increased wave and storm energy. The Massachusetts Shoreline Change Project has mapped and calculated erosion rates in Lewis Bay and lists the erosion rate of the property shoreline as 0.46' per year. Page three of this document includes an image from the website. Further evidence shows more significant episodic erosion of the beach and dune when comparing the recent survey data to 2018 aerial images from Google Earth. Based on aerial imagery, the dune was approximately 56 feet wide in 2018. According the to the survey data from early 2023 recorded the dune is now only 36 feet wide; a loss of 20 feet in a five-year period. This project proposes a coastal adaptation strategy that includes a fiber roll array combined with a reinforced high marsh to lessen the severity of erosion, preserve the existing plant community, and provide additional native plant species where none exists. The reinforced high marsh is a below -grade matrix of cobble, compatible sediment, coir fibers, and compost encased in biodegradable material. The installation is reinforced planting medium for transitional high marsh species such as salt marsh hay, spike grass, seaside goldenrod, switchgrass, and American beach grass. Page three includes an image of a completed and fully vegetated reinforced marsh. In addition, a modest fiber roll array will be installed along the landward edge of the reinforced high marsh. The proposed coastal adaptation strategy takes into account the anticipated sea level rise. Refer to the Restoration plan by Wilkinson Ecological Design dated 4/13/2023 for more details. ACCESS Access for all machines and materials will be via Malfa Road, along the existing footpath. This access route is across town -owned land. Approval from the Town of Yarmouth will be requested before installation. Ground protection mats will be laid along the access route, including any vegetation to protect the roots and soils from machinery and compaction. This will allow for full recovery of the vegetation following installation. The ground protection mats will be equivalent to AlturnaMats© at 4'x8' or 3'x8' made of recycled and rugged 0.5" HDPE material. The access route will be restored to pre -construction conditions following the installation. Additionally, all equipment will be removed from tidal and sandy access routes prior to any astronomic tidal or storm event. INSTALLATION OF REINFORCED HIGH MARSH, FIBER ROLLS, AND NOURISHMENT A reinforced high marsh is a below -grade matrix of cobble, compatible sediment, coir fibers, and compost encased in biodegradable material. The installation is a reinforced planting medium for transitional marsh species such as salt marsh hay, spike grass, seaside goldenrod, switchgrass, and American beach grass. This reinforced high marsh will be approximately 24" thick, composed of 50% 8"-10" rounded cobble, 25% coir fiber and compost, and 25% compatible sediment. The mixture of cobbles, coir fiber, compost, and compatible sediment will be encased in two layers of 700-gram coir fabric and one layer of 20 oz jute -burlap. Rounded cobbles will be placed in a staggered natural arrangement along the seaward edge of the reinforced high marsh to protect the installation and plantings from ice scour. Following construction, the specified native forbs and grasses shall be planted through the coir fabric into the reinforced high marsh. An 18" fence will be installed along the seaward edge of the reinforced marsh during the growing season to protect the plantings from smothering due to wrack accumulation. Fiber rolls will then be installed on the landward side of the reinforced high marsh. The array will be installed at a 1.5:1 slope angle, beginning with the lowest course of fiber rolls and continuing up gradient. A layer of 900-gram coir blanket will encapsulate the fiber rolls to provide protection from ultra -violet degradation. All seams between the rolls will be planted with American beach grass at 12" on -center. The fiber rolls will be secured with earth anchors attached to 42" steel cables, spaced 2.5' +/- across the face of the fiber rolls into undisturbed soils as the array is constructed. All fiber rolls will be identified with stainless steel tags noting the name and phone number of the installer and the address of the installation location. Following installation and plantings, the fiber rolls will be nourished using compatible sediment. Ongoing sediment nourishment will supply the adjacent coastal resource areas with a sediment source. This nourishment will also help to extend the life of the fiber rolls. Nourishment of the dune with compatible sediment is also proposed as shown on the accompanying Restoration Plan.185 cubic yards of compatible sediment will be placed over the dune. The existing American beachgrass has evolved to grow and thrive when covered by wind blown and overwash sand. To speed the process of re-establishing vegetation, the nourishment will be planted with American beachgrass at 18" on center. A temporary irrigation system will be installed to provide supplemental water for the establishment period of the reinforced high marsh. This will encourage rapid colonization of the transitional high marsh within the first three years after planting. The irrigation system will be disconnected and removed from the project area following establishment of the plantings. ONGOING MAINTENANCE Maintenance of the fiber rolls, associated plants, and bioengineering materials is critical to ensure a longer lifespan of the erosion management strategy. The project includes annual maintenance, as well as regular monitoring throughout the storm season to ensure extra maintenance and repairs will be undertaken when needed. Sand nourishment of the fiber rolls is an activity that should be conducted on a long-term basis in order to provide the adjacent coastal resource areas with a sediment source. The trigger to determine when sand nourishment is necessary will be when 30% or more of fiber rolls become exposed. Sand nourishment will occur between late March and early May with no more than 40 cubic yards of compatible sediment to maintain a 4"- 6" cover over the fiber rolls. IN The project will be monitored after significant winter storms to assess the need for minor maintenance activities. The maintenance may include the tightening of anchor cables and repositioning of fiber rolls. After nourishment or maintenance work is complete, work areas will be restored to their previous condition, and any debris generated from maintenance work will be removed from the site. It is requested that sand nourishment and maintenance of the fiber roll array be written as an ongoing condition of the Order of Conditions and will be requested as an ongoing condition on the Certificate of Compliance. The fiber roll array and transitional high marsh installation have been outlined to show their respective locations under the dense native vegetation.
