The filing deadline is two weeks prior to the next scheduled Conservation Commission meeting for new applications. Failure to follow this Checklist shall result in an Administratively Incomplete Application and will not be advertised for a Public Hearing. Refer to the meeting schedule. Contact the Conservation Office if you need assistance. Submitting an Application: Does the property have any outstanding/expired Orders of Conditions? If so, please file a Request for Certificate of Compliance for each outstanding/expired Order, as the Commission may not issue a new Order until any outstanding/expired Orders have been closed and recorded. (*see page 2) Hardcopy filing dropped off or mailed to the Conservation Office including: 1 Administrative Checklist 1 NOI application with original signatures (double sided). Typed signatures will not be accepted. 1 detailed narrative of the project including: existing & proposed conditions, construction sequence, type of equipment, staging locations, drainage and stormwater, erosion controls, invasive species management and alternative analysis. The narrative shall include how the project meets performance standards per 310 CMR 10.0 & TOY Wetland Bylaw, Chapter 143, BVW delineation sheets or other resource area calculations, and supporting information. 1 100’ radius map, current abutters list identifying the property owners who are to be notified per 310 CMR 10.00and abutter notification form. Abutters list must be certified by the Town Assessor’s office. The Assessor’s office requires 7 days advance notice. All abutters must be notified via certified mail. Certified Mail Receipts (PS Form 3800) for all abutters. Green cards to be submitted at the hearing. 1 original and 7 copies of the plan, folded separately, right side out with title and project address visible. All plans shall reference NAVD1988 unless otherwise noted. Landscape plans shall be detailed to show proposed & existing conditions, native species, size and spacing. The project consists of proposed renovations and improvements to the existing resort needed to upgrade the existing facility’s buildings and grounds, including site landscape/hardscape improvements and other site amenities intended to enhance the facility’s guest experience. Proposed improvements to the site include a new swimming pool and cabana configuration, a spa, a trellised outdoor bar, patios, walkways and other site landscaping/hardscaping improvements as shown on plans prepared by the Project Design Team. Other site improvements to the existing hotel facility include improved hotel/restaurant arrival and porte cochere area; site accessibility, entrance road/parking lot, yards/parking areas fronting South Shore Rd, and infrastructure improvments to the storm drainage system and future municipal sewer hook up. The Scope of Work is summarized below: The project work area primarily is on the water side of the Hotel grounds, located to the west of the main entrance drive. Work in this area includes renovation work both inside and outside the building. Interior work includes renovations to the existing guest rooms and accessibility improvements for ADA compliance. Exterior work consists of the renovation of the existing pool and spa area and includes the demolition of the two existing pools, the pool patio, equipment vault, walkways and beach stairs. New construction includes a new pool, spa, pool patio, walkways and a trellised outdoor bar along with associated site utilities including underground water service, plumbing and electric. The pool deck and areas around the hotel buildings will feature new landscaping/hardscaping, with native plantings in the ecological sensitive areas to mitigate site work in the buffer zones. New storm drainage improvements will also be provided to collect stormwater runoff from the building and pervious ground surfaces. Improved areas within the buffer zones will be offset with native shrubs and mitigation plantings at a 3.76:1 ratio resulting in over 5,265 SF of ecological mitigation area (2,765 SF dune restoration and 2,500 SF lawn conversion). To the south, the project locus faces Nantucket Sound, with the following resource areas: Coastal Bank, Coastal Dune, and Land Subject to Coastal Storm Flowage (Flood Zone VE14, VE13, AE,11, and AE13). To the west, the property is bound by Parkers River, with its mouth defined between two jetties that protect that channel leading into Nantucket Sound. The Parker River represents a designated Riverfront Area with a 100 ft and 200 ft riverfront area buffer extending from the river bank to within the hotel side of the property. The Coastal wetland resource areas include a 50 ft. and 100 ft. coastal wetland buffer (dune and coastal bank) that is located along the seawall, revetment, and portion of neighboring property located on South Shore Drive. The beach (up to the seawall) is located within the Mass Wildlife’s Natural Heritage & Endangered Species Program (NHESP) as referenced on the MA GIS on line mapping tool, but does not appear to be in an Area of Critical Environmental Concern (ACEC) or any other regulated area not otherwise specified herein. Currently, the land is a fully developed site, with two hotel structures (one with an indoor pool), six cottages, five sheds, outdoor freezer, brick walkways, paved parking and driveways, tennis court, lawn covered recreation areas, miscellaneous concrete pads, seawalls, revetment, and a dock. The property has the following utilities: gas, water, drainage, and electricity. The property has multiple septic leaching fields located across the site as shown on record survey plan titled “Existing Conditions Plan” Dated 11- 17-2022 by Feldman Geospatial. The coastal resource areas were delineated by Lucas Environmental, LLC on 11-4-2022 and 11-17-2022. (increase) Drainage and Stormwater Management The proposed renovation project includes improvements to the existing stormwater management system and includes Best Management Practices (BMP’s) to manage stormwater storm water runoff by collecting, directing and infiltrating stormwater onsite. A new collection system will be installed to gather storm runoff from the existing roof and new pool patio hardscape areas and direct the runoff to a new stormwater recharge area. Through the use of onsite stormwater management system for roof runoff and pool patio, the proposed re-development will significantly reduce the peak flow and volume of runoff contributed to Nantucket Sound and Parkers River. Proposed roof and patio runoff will be collected and treated using CULTEC infiltration units sized for a 25-year storm event. See stormwater report titled “Red Jacket Resort - 28 South Shore Driver” Dated 05-18-2023 and prepared by Coastal C17189.03: Notice of Intent Application Town of Yarmouth, 28 South Shore Drive Page 6 of 21 Engineering Company for more information. NOTE: The proposed work area is less than one acre, so a Stormwater Management Permit Application (SMPA) is not anticipated to be required. Alternatives Analysis See performance standards section below titled “State Wetlands Protection Act 310 CMR 10.00 -- 10.58: Riverfront Area – (c) Practicable and Substantially Equivalent Economic Alternatives.” or an alternatives analysis. Erosion Control 1. During construction, the contractor shall be responsible for erosion control and protection of drainage structures until completion of sitework and establishment of vegetative ground cover. 2. The contractor shall practice good housekeeping measures during the day-to-day operation at the site. The site should be policed daily to remove any litter or debris. 3. Prior to construction, install perimeter sediment barrier in location(s) shown on plan. Sediment barrier to be double-staked straw bales with silt fence or 12"ø staked coir logs/silt sock. 4. Temporary soil material stockpiles shall be surrounded with siltation barrier on the downgradient side to prevent discharge of sediment from site. Material stockpiles that are in place for an extended period of time shall be stabilized with vegetation, mulching, erosion control blankets, and other measures that are necessary to prevent the discharge of sediment from the project site. 5. If sediment escapes the construction site, off-site accumulations of sediment must be removed at a frequency sufficient to minimize off-site impacts. 6. Litter, construction debris, and construction chemicals that could be exposed to storm water must be prevented from becoming a pollutant source. 7. Except as provided below, stabilization measures must be initiated as soon as practicable in portions of the site where construction activities have temporarily ceased, but in no case more than 14 days after the construction activity in that portion of of the site has temporarily or permanently ceased. 1. Where stabilization by the 14th day is precluded by snow cover or frozen ground conditions, stabilization measures must be initiated as soon as practicable. 2. Where construction activity on a portion of the site is temporarily ceased, and earth disturbing activities will be resumed within 14 days, temporary stabilization measures do not have to be initiated on that portion of the site. Construction Sequence – Equipment – Staging Locations 1. Install permitter limit of work construction fence and sedimentation barrier as indicated on the plans. Protect existing leaching catch basins inlets within and adjacent to construction area. 2. Install two vehicle tracking pads. One at South shore drive, and one at Pawkannawkut Drive. C17189.03: Notice of Intent Application Town of Yarmouth, 28 South Shore Drive Page 7 of 21 3. Clear and grub the highlighted areas as indicated on the plans. 4. Locate Areas for staging, material storage and stockpile. Surround material stockpiles with erosion control barrier. All equipment must be located behind locked fence during non-working hours. 5. Install temporary construction period runoff management swales. 6. Install a 3’ high orange vinyl fence around all existing sewage disposal fields. 7. Demolish existing pool, patios, pavement and walkways as shown on plans. 8. Rough grade site. 9. Install stormwater infiltration system components and other utilities. 10. Install proposed hardscapes including pool and spa. 11. Grade and pave proposed parking lot. 12. Install curbing and sidewalks. 13. Stabilize and vegetate disturbed areas with approved native seed and planting by the conservation commission. Equipment to be used: dump truck, excavator, skid loader, dewatering pumps, jackhammer, plate compactor, concrete pump truck or plaster pumping equipment for pool, and hand tools. Wetland Resource Areas and Performance Standards The existing property is located along Parkers River, and Nantucket Sound. The project area is within FEMA Flood Zone VE14, VE13, AE13 and AE11 as indicated on flood insurance rate map number 25001C0588J and 25001C0589J for Barnstable County Massachusetts both with an effective date of July 16, 2012. The Resource Areas are covered under the 310 CMR 10.00: Wetlands Protection Act Regulations as well as the Town of Yarmouth Wetland Protection Regulations. We have addressed the potential impacts to these Resource Areas based on the Performance Standards under both the State and Local Wetland Protection Regulations in the following sections. State Wetlands Protection Act 310 CMR 10.00 10.04: Land Subject to Coastal Storm Flowage "land subject to any inundation caused by coastal storms up to and including that caused by the 100-year storm, surge of record or storm of record, whichever is greater" The Land Subject to Coastal Storm Flowage (LSCSF) does not have regulation performance standards, though it is a protected resource area and therefore approval is needed to perform work within the LSCSF. This project will not adversely affect LSCSF and will improve its functionality. 10.28: Coastal Dunes WHEN A COASTAL DUNE IS DETERMINED TO BE SIGNIFICANT TO STORM DAMAGE PREVENTION, FLOOD CONTROL OR THE PROTECTION OF WILDLIFE HABITAT, 310 10.28(3) THROUGH (6) SHALL APPLY: C17189.03: Notice of Intent Application Town of Yarmouth, 28 South Shore Drive Page 8 of 21 (3) Any alteration of, or structure on, a coastal dune or within 100 feet of a coastal dune shall not have an adverse effect on the coastal dune by: (a) affecting the ability of waves to remove sand from the dune; (b) disturbing the vegetative cover so as to destabilize the dune; (c) causing any modification of the dune form that would increase the potential for storm or flood damage; (d) interfering with the landward or lateral movement of the dune; (e) causing removal of sand from the dune artificially; or (f) interfering with mapped or otherwise identified bird nesting habitat. No new structures are proposed to be constructed on any dune area. All work is upland from the existing seawall, which serves as a delineation line that separates the dune from the developed resort grounds. Existing dune resource areas will in fact be improved by proposed dune enhancement that is part of the project mitigation plan. New sand placement and dune contouring, along with additional beach grass plantings, will help stabilize the dune for flood protection and further enhance the resource area ecosystem by providing habitat for protected wildlife. (4) Notwithstanding the provisions of 310 CMR 10.28(3), when a building already exists upon a coastal dune, a project accessory to the existing building may be permitted, provided that such work, using the best commercially available measures, minimizes the adverse effect on the coastal dune caused by the impacts listed in 310 CMR 10.28(3)(b) through (e). Such an accessory project may include, but is not limited to, a small shed or a small parking area for residences. It shall not include coastal engineering structures. N/A. No work is to be done on the Dune. (5) The following projects may be permitted, provided that they adhere to the provisions of 310 CMR 10.28(3): (a) pedestrian walkways, designed to minimize the disturbance to the vegetative cover and traditional bird nesting habitat; (b) fencing and other devices designed to increase dune development; and (c) plantings compatible with the natural vegetative cover. N/A. No work is to be done on the Dune. Besides Beach grass mitigation plantings. (6) Notwithstanding the provisions of 310 CMR 10.28(3) through (5), no project may be permitted which will have any adverse effect on specified habitat sites of Rare Species, as identified by procedures established under 310 CMR 10.37. N/A. No work is to be done within the mapped NHESP boundary. 10.30: Coastal Banks (2) Definition. Coastal Bank means the seaward face or side of any elevated landform, other than a coastal dune, which lies at the landward edge of a coastal beach, land subject to tidal action, or other wetland. C17189.03: Notice of Intent Application Town of Yarmouth, 28 South Shore Drive Page 9 of 21 WHEN A COASTAL BANK IS DETERMINED TO BE SIGNIFICANT TO STORM DAMAGE PREVENTION OF FLOOD CONTROL BECAUSE IT SUPPLIES SEDIMENT TO COASTAL BEACHES, COASTAL DUNES OR BARRIER BEACHES, 310 CMR 10.30(3) THROUGH (5) SHALL APPLY: (3) No new bulkhead, revetment, seawall, groin or other coastal engineering structure shall be permitted on such a coastal bank except that such a coastal engineering structure shall be permitted when requires to prevent storm damage to buildings constructed prior to the effective date of 310 CMR 10.21 through 10.37 or constructed pursuant to a Notice of Intent filed prior to the effective date of 10 CMR 10.21 through 10.37 (August 10, 1978), including reconstructions of such buildings subsequent to the effective date of 310 CMR 10.21 through 10.37, provided that the following requirements are met: (a) a coastal engineering structure or a modification there to shall be designed and constructed so as to minimize, using best available measures, adverse effects on adjacent or nearby coastal beaches due to changes in wave action, and (b) the applicant demonstrates that no method of protecting the building other than the proposed coastal engineering structure is feasible. (c) Protective planting designed to reduce erosion may be permitted. The proposed project does not include any work on the existing licensed structure or any alteration or addition any new Coastal Engineering Structures. (4) Any project on a coastal bank of within 100 feet landward of the top of a coastal bank, other than a structure permitted by 310 CMR 10.30(3), shall not have an adverse effect due to wave action on the movement of sediment from the coastal bank to coastal beaches or land subject to tidal action. Portions of the proposed project is located in the 100 feet buffer measured from the top of the Coastal Bank. The work area is currently developed; all the new additions and improvements are designed to minimize adverse impacts to the designated resource area. As such, there are no anticipated adverse effect due to wave action on the movement of sediment from the coastal bank due to the existing sea wall. (5) The Order of Conditions and the Certificate of Compliance for any new building within 100 feet landward of the top of a coastal bank permitted by the issuing authority under M.G.L. c. 131 & 40 shall contain the specific condition: 310 CMR 10.30(3), promulgated under M.G.L. c. 131 & 40, requires that no coastal engineering structure, such as a bulkhead, revetment, or seawall shall be permitted on an eroding bank at any time in the future to protect the project allowed by this Order of Conditions. N/A. The coastal bank is a non-eroding bank and the existing CES is stable, well maintained and serves as flood protection to the upland areas. WHEN A COASTAL BANK IS DETERMINED TO BE SIGNIFICANT TO STORM DAMAGE PREVENTION OR FLOOD CONTROL BECAUSE IT IS A VERTICAL BUFFER TO STORM WATERS, 310 CMR 10.30 (6) THROUGH (8) SHALL APPLY: (6) Any project on such a coastal bank or within 100 feet landward of the top of such coastal bank shall have no adverse effects on the stability of the coastal bank. The seawall will be protected throughout construction. No adverse effects will be made towards the coastal bank. (7) Bulkheads, revetments, seawalls, groins or other coastal engineering structures may be permitted on such a coastal bank except when such bank is significant to storm damage prevention or flood control because it supplies sediment to coastal beaches, coastal dunes, and barrier beaches. N/A. The proposed project does not include any new Coastal Engineering Structure. (8) Notwithstanding the provisions of 310 CMR 10.30(3) through (7), no project may be permitted which will have any adverse effect on specified habitat sites of rare vertebrate or invertebrate species, as identified by procedures established under 310 CMR 10.37. The property lies within the Natural Heritage and Endangered Species Program (NHESP) Estimated or Priority Habitat of Rare Wildlife and Species mapped areas and a copy of the application packaged has been submitted to the NHESP for review. 10.58: Riverfront Area General Performance Standards. Where the presumption set forth in 310 CMR 10.58(3) is not overcome, the applicant shall prove by a preponderance of the evidence that there are no practicable and substantially equivalent economic alternatives to the proposed project with less adverse effects on the interests identified in M.G.L. c.131 § 40 and that the work, including proposed mitigation, will have no significant adverse impact on the riverfront area to protect the interests identified in M.G.L. c. 131 § 40. In the event that the presumption is partially overcome, the issuing authority shall make a written determination setting forth its grounds in the Order of Conditions and the partial rebuttal shall be taken into account in the application of 310 CMR 10.58 (4)(d)1.a. and c.; the issuing authority shall impose conditions in the Order that contribute to the protection of interests for which the riverfront area is significant. (a) Protection of Other Resource Areas. The work shall meet the performance standards for all other resource areas within the riverfront area, as identified in 310 CMR 10.30 (Coastal Bank), 10.32 (Salt Marsh), 10.55 (Bordering Vegetated Wetland), and 10.57 (Land Subject to Flooding). When work in the riverfront area is also within the buffer zone to another resource area, the performance standards for the riverfront area shall contribute to Effective 10/24/2014 310 CMR: DEPARTMENT OF ENVIRONMENTAL PROTECTION the protection of the interests of M.G.L. c. 131, § 40 in lieu of any additional requirements that might otherwise be imposed on work in the buffer zone within the riverfront area. The work being proposed is intended to meet all other performance standards for all resource areas associated with the riverfront area. (b) Protection of Rare Species. No project may be permitted within the riverfront area which will have any adverse effect on specified habitat sites of rare wetland or upland, vertebrate or invertebrate species, as identified by the procedures established under 310 CMR 10.59 or 10.37, or which will have any adverse effect on vernal pool habitat certified prior to the filing of the Notice of Intent. C17189.03: Notice of Intent Application Town of Yarmouth, 28 South Shore Drive Page 11 of 21 Except for the proposed dune enhancement and mitigation plantings in the dune area, the project work is not located within an area that is shown to impact the habitat area specified within the Natural Heritage Natural Heritage and Endangered Species Program (NHESP). (c) Practicable and Substantially Equivalent Economic Alternatives. There must be no practicable and substantially equivalent economic alternative to the proposed project with less adverse effects on the interests identified in M.G.L. c. 131 § 40. The No-build scenario is not an option, as building infrastructure and facilities are nearing the end of their useful life. The Project is designed to the practicable extent possible. Practicable and Substantially Equivalent Economic Alternatives. Per 310 CMR 10.58.1. Definition of Practicable is an alternative that is substantially equivalent economically if it is available and capable of being done after taking into consideration costs, existing technology, proposed use, and logistics, in light of overall project purposes. Available and capable of being done means the alternative is obtainable and feasible. Four factor that are considered are: i. Cost The existing hardscapes and pool are outdated and are not ADA compliant. The intent of the project is to renovate and update the hardscapes to attract new customers and provide a hospitable environment that matches the aesthetic of the neighborhood. This in turn will improve the property value and increase tax revenue to the town. This will also help finance proposed improvements which will result in both economic and ecological benefits. Doing nothing will result in the diminution of property value and degrade the site. Using the natural topography to dictate where the stormwater infrastructure is to be placed is the most logical and cost-efficient option. Existing partial rooftop and proposed patio has been designed with the intent to infiltrate on site. Therefore, immediately placing clean runoff back into the ground in close proximity to where it falls is the most practicable and cost-effective solution. ii. Existing Technology The existing parcel does not have any existing stormwater treatment available. The proposed structures are designed to infiltrate and detain stormwater for the 10- year storm event, and to follow the existing drainage patterns on site. One alternative would be to size the system to infiltrate and retain for a 100-year storm event, but this would add significant added cost with minimal benefit. This approach would adversely affect the site by providing a much larger system that C17189.03: Notice of Intent Application Town of Yarmouth, 28 South Shore Drive Page 12 of 21 would require significant grading which would encroach closer to the 25’ no disturb zone. Also, because the developed site area is already encompassed by a deep sheet pile bulkhead system, attenuation of storm drain occurs naturally as runoff is effectively pretreated by saturation in the sandy subsoils. iii. Proposed Use The Property is to remain as a hotel use as currently permitted in the Yarmouth HMOD2 zoning district. This ecological intent of the design is focused on the reduction in the impervious areas within the coastal and riverfront resource areas while still maintaining the recreational and hospitality needs for the facility (yard, driveway, and utilities), all of which provides much needed improvements to the facility and benefits the applicant, their guests and the community at large. iv. Logistics The majority (90.3%) of the parcel is located within the 100 ft riverfront area and much of the existing building area is located within the 200 ft riverfront area. The project design intent was to minimize new work in these buffer zones and to provide 2:1 mitigation to compensate for any disturbed area. A construction protocol and project narrative has been established to minimize adverse impacts to the wetland resource areas during construction. Construction access to the site will be from to upland areas located from the existing facility entrance point at the end of South Shore Drive and across the beach when necessary to access dune areas for implementation of dune enhancement work. These proposed actions will take place outside any time of year restrictions required by NHESP. (d) No Significant Adverse Impact. The work, including proposed mitigation measures, must have no significant adverse impact on the riverfront area to protect the interests identified in M.G.L. c. 131, § 40. 1. Within 200 foot riverfront areas, the issuing authority may allow the alteration of up to 5000 square feet or 10% of the riverfront area within the lot, whichever is greater, on a lot recorded on or before October 6, 1997 or lots recorded after October 6, 1997 subject to the restrictions of 310 CMR 10.58(4)(c)2.b.vi., or up to 10% of the riverfront area within a lot recorded after October 6, 1997 There is 4,901 s.f. of alteration proposed to the project. The project is removing 3,068 s.f. of impervious coverage within the riverfront area. a. At a minimum, a 100 foot wide area of undisturbed vegetation is provided. This area shall extend from mean annual high-water along the river unless another location would better protect the interests identified in M.G.L. c. 131 § 40. If there is not a 100 foot wide area of undisturbed vegetation within the riverfront area, existing C17189.03: Notice of Intent Application Town of Yarmouth, 28 South Shore Drive Page 13 of 21 vegetative cover shall be preserved or extended to the maximum extent feasible to approximate a 100 foot wide corridor of natural vegetation. The lot is developed and is within the 100ft riverfront area. The proposed work reduces the impervious coverage by 3,086s.f. Areas where structures were demolished are to be revegetated. b. Stormwater is managed according to standards established by the Department in its Stormwater Policy. The stormwater is designed based on the Massachusetts stormwater handbook and standards along with the Town of Yarmouth Conservation Commission Stormwater Management Regulations. c. Proposed work does not impair the capacity of the riverfront area to provide important wildlife habitat functions. The Proposed work does not impair the capacity of the riverfront to provide important wildlife habitat functions. All of the work is located on the opposite side of the hotel from where the river bank is located. d. Proposed work shall not impair groundwater or surface water quality by incorporating erosion and sedimentation controls and other measures to attenuate nonpoint source pollution. The proposed stormwater system will provide better protection of the groundwater quality by infiltrating stormwater runoff directly into the ground while using as little land area as possible. This use of onsite infiltration systems will prevent runoff from causing erosion during high storm events. (9) Redevelopment Within Previously Developed Riverfront Areas; Restoration and Mitigation. Notwithstanding the provisions of 310 CMR 10.58(4)(c) and (d), the issuing authority may allow work to redevelop a previously developed riverfront area, provided the proposed work improves existing conditions. Redevelopment means replacement, rehabilitation or expansion of existing structures, improvement of existing roads, or reuse of degraded or previously developed areas. A previously developed riverfront area contains areas degraded prior to August 7, 1996 by impervious surfaces from existing structures or pavement, absence of topsoil, junkyards, or abandoned dumping grounds. Work to redevelop previously developed riverfront areas shall conform to the following criteria: (a) At a minimum, proposed work shall result in an improvement over existing conditions of the capacity of the riverfront area to protect the interests identified in M.G.L. c. 131 § 40. When a lot is previously developed but no portion of the riverfront area is degraded, the requirements of 310 CMR 10.58(4) shall be met. C17189.03: Notice of Intent Application Town of Yarmouth, 28 South Shore Drive Page 14 of 21 Although the proposed work increases the hardscape within the riverfront area, the hardscape that is proposed is designed to be pervious and infiltrate stormwater directly into the ground. The existing hardscapes are impervious. To further mitigate the increase in impervious coverage native plantings and beach grass is proposed at a 2:1 ratio. providing more vegetation to the site. (b) Stormwater management is provided according to standards established by the Department. The stormwater is designed based on the Massachusetts stormwater handbook and standards along with the Town of Yarmouth Conservation Commission Stormwater Management Regulations. (c) Within 200 foot riverfront areas, proposed work shall not be located closer to the river than existing conditions or 100 feet, whichever is less, or not closer than existing conditions within 25 foot riverfront areas, except in accordance with 310 CMR 10.58(5)(f) or (g). The project scope of work will not be any closer to the riverfront than what is existing. (d) Proposed work, including expansion of existing structures, shall be located outside the riverfront area or toward the riverfront area boundary and away from the river, except in accordance with 310 CMR 10.58(5)(f) or (g) The proposed scope of work is located as far as possible from the riverfront. (e) The area of proposed work shall not exceed the amount of degraded area, provided that the proposed work may alter up to 10% if the degraded area is less than 10% of the riverfront area, except in accordance with 310 CMR 10.58(5)(f) or (g). Although the proposed work increases the hardscape within the riverfront area, the hardscape that is proposed is designed to be pervious and infiltrate stormwater directly into the ground. Furthermore, much of the existing hardscapes are impervious. To further mitigate the increase in impervious coverage native plantings and beach grass is proposed at a 2:1 ratio. providing more vegetation to the site in accordance with 310 CRM 10.58(5)(g) (f) When an applicant proposes restoration on-site of degraded riverfront area, alteration may be allowed notwithstanding the criteria of 310 CMR 10.58(5)(c), (d), and (e) Mitigation at a 2:1 ratio is proposed. providing additional vegetation to the site in accordance with 310 CRM 10.58(5)(g) (g) When an applicant proposes mitigation either on-site or in the riverfront area within the same general area of the river basin, alteration may be allowed notwithstanding the criteria of 310 CMR 10.58(5)(c), (d), or (e) C17189.03: Notice of Intent Application Town of Yarmouth, 28 South Shore Drive Page 15 of 21 Mitigation at a 2:1 ratio is proposed. providing additional vegetation to the site in accordance with 310 CRM 10.58(5)(g) The Town of Yarmouth Wetlands Performance Standards 2.03 Coastal Dune (3) Performance Standards Any activity which is allowed on a coastal dune or within 100 feet of a coastal dune shall not have an adverse effect on the coastal dune by: (a) affecting the ability of waves to remove sand from the dune; (b) disturbing the vegetative cover so as to destabilize the dune; (c) causing any modification of the dune form that would increase the potential for storm or flood damage; (d) interfering with the landward or lateral movement of the dune; (e) causing artificial removal of sand from the dune; or (f) interfering with mapped or otherwise identified bird nesting habitat. No new structures are to be constructed on the Dune. All work is beyond the seawall that separates the dune from the resort. In fact, the dune will be improved with additional dune mitigation plantings that will stabilize the dune and prevent deterioration, which will allow for a better ecosystem for bird nesting and flood protection. (4) The following projects may be permitted, provided they adhere to the provisions of section 2.03, (3): (a) elevated pedestrian walkways, designed to minimize disturbance to vegetative cover, and traditional bird nesting habitat. Walkways shall have a minimum clearance of two feet above any existing vegetation; (b) fencing and other devices designed to increase dune development; and (c) plantings compatible with the natural vegetative cover. Native Dune plantings are proposed. See plan Mitigation plan by Wilkinson Ecological for more information. 2.05 Coastal Banks (3) Performance Standards: Any activity that is allowed on a coastal bank shall comply with the following provisions: (a) No new bulkhead, revetment, seawall, groin or other coastal engineering structure shall be permitted on a coastal bank that provides significant sediment to an adjacent or downdrift coastal beach; except that such a coastal engineering structure shall be permitted when C17189.03: Notice of Intent Application Town of Yarmouth, 28 South Shore Drive Page 16 of 21 required to prevent storm damage to buildings constructed prior to August 10, 1978, including re-construction of such buildings subsequent to the effective date of these regulations, provided that the following requirements are met: (1) coastal engineering structures or modifications thereto shall be designed and constructed so as to minimize, using best available measures, adverse effects on adjacent or nearby coastal beaches due to changes in wave action; (2) the applicant demonstrates that no method of protecting the building other than the proposed coastal engineering structure is feasible; (3) protective planting designed to reduce erosion may be permitted; and (4) the applicant provides sufficient evidence that the building was constructed pursuant to a Notice of Intent prior filed before August 10, 1978. (b) Any project on a coastal bank or within 100 feet of the top of a coastal bank, other than a structure permitted under section 2.05, (3), (a), shall not have an adverse effect due to wave action on the movement of sediment from the coastal bank to coastal beaches or land subject to tidal action or flooding, and shall not have an adverse effect on the stability of a coastal bank. 2.03 Riverfront Area (4) Performance Standards (b) Redevelopment within a Previously Developed Riverfront Area. Notwithstanding the provisions of Sections 2.6(4)(a)3. and 4. above, the Committee may allow work to redevelop a previously developed Riverfront Area provided that the proposed activity improves existing conditions. Redevelopment means replacement, rehabilitation or expansion of existing structures, improvement of existing roads, or reuse of degraded or previously developed areas. A previously developed Riverfront Area contains areas degraded prior to August 7, 1996 by impervious surfaces from existing structures or pavement, absence of topsoil, junkyards, or abandoned dumping grounds. Lawn and landscaped areas are not considered degraded areas as they have topsoil. Work to redevelop previously developed Riverfront Area shall conform to the following criteria. 1. The proposed activity shall result in an improvement over existing conditions of the capacity of the Riverfront Area to protect the Bylaw Interests and Values. When a lot is previously developed but no portion of the Riverfront Area is degraded, the requirements of Section 2.6(4)(a) above shall apply. The proposed work improves the lot by removing impervious area, providing more vegetation to the site, and providing stormwater infiltration. C17189.03: Notice of Intent Application Town of Yarmouth, 28 South Shore Drive Page 17 of 21 2. Stormwater is managed according to regulatory standards at 310 CMR 10.05(6)(k) to (q) established by the Department, as applicable, and Section 1.6(8)(b)4.g. of these regulations above, as applicable. The stormwater is designed based on the Massachusetts stormwater handbook and standards. 3. The proposed activity shall not be located closer to the river than existing conditions or 100 feet, whichever is less, except in accordance with Sections 2.6(4)(b)7. and 8. below The project will be removing impervious material closest to the riverfront and replanting the disturbed area providing a greater buffer to the dwelling. 4. The proposed activity, including expansion of existing structures, shall be located outside the Riverfront Area or toward the Riverfront Area boundary and away from the river, except in accordance with Sections 2.6(4)(b)7. and 8. below. The proposed building expansion is located at the farthest corner from the lot away from the river. The driveway is located outside of the 100’ riverfront area. 5. The area of the proposed activity shall not exceed the amount of degraded area, provided that the proposed activity may alter up to 10% of the Riverfront Area if the degraded area is less than 10% of the Riverfront Area on the lot, except in accordance with Sections 2.6(4)(b)7. and 8. below. There is 4,901 s.f. of alteration proposed to the project. However, the project is removing 3,068 s.f. of impervious coverage within the riverfront area. 6. The limit of work shall be clearly identified on the plan and in the field and appropriate erosion and sedimentation control measures shall be implemented and maintained throughout construction. No silt or sediment may be permitted to enter any Bylaw Resource Area outside of the Limit of Work during or subsequent to construction. Limit of work is clearly defined on the plan titled “Plan Showing Erosion Control” dated 05- 18-23 by Coastal Engineering Company. 7. When an applicant proposes on-site restoration of degraded Riverfront Area, alteration may be allowed notwithstanding the criteria of Sections 2.6(4)(b)3. to 5. above at a ratio in square feet of at least 1:1 of restored area to area of alteration not conforming to the criteria. Areas immediately along the river shall be selected for restoration. Restoration shall include: a. removal of all debris, but retaining any trees or other mature vegetation; b. grading to a topography which reduces runoff and increases infiltration; c. coverage by topsoil at a depth consistent with natural conditions at the site; and C17189.03: Notice of Intent Application Town of Yarmouth, 28 South Shore Drive Page 18 of 21 d. seeding and planting with an erosion control seed mixture, followed by plantings of herbaceous and woody species appropriate to the site. N/A 8. When an applicant proposes mitigation either on-site or off-site within the Riverfront Area within the same general area of the river basin, alteration may be allowed notwithstanding the criteria of Sections 2.6(4)(b)3. to 5. above at a ratio in square feet of at least 2:1 of mitigation area to area of alteration not conforming to the criteria or an equivalent level of functional mitigation where square footage is not a relevant measure. Mitigation may include off-site restoration of Riverfront Area, conservation restrictions to preserve undisturbed Riverfront Area that could otherwise be developed under the Bylaw, the purchase of development rights within the Riverfront Area, the restoration of Vegetated Wetlands, projects to remedy an existing adverse impact on the Bylaw Interests and Values for which the applicant is not legally responsible, or similar activities undertaken voluntarily by the applicant. All mitigation will be contained on site and will meet or exceed the 2:1 minimum ratio for altered areas; there is no off site mitigation required for this project. 2.10 Land Subject to Coastal Storm Flowage: (3) Performance Standards Any activity within land subject to coastal storm flowage which will result in the building upon, removing, filling or altering land within 300 feet of a major estuary defined in section 1.04 of these regulations shall meet the following requirements. Notwithstanding this section 2.10, (3), beach nourishment and coastal engineering projects such as bulkheads and seawalls may be allowed if they meet all other performance in these regulations. (a) Existing septic system and cesspool repairs will be allowed provided they substantially meet all Title 5 and local Board of Health thresholds. N/A. Septic system alterations are not proposed. (b) All groundwater elevations shall incorporate seasonable adjustments if test holes and or leaching components are 100 feet or closer from major estuaries. N/A. Septic system alterations are not proposed. The existing sanitary waste will be tied into the municipal sewer collection system once the community sewer project comes on line. (c) Any proposed deck, shed, or other similar structure must be securely anchored to a footing or foundation. Proposed bar pavilion will be design to meet current building code structural requirements and will be securely anchored to engineered footings. C17189.03: Notice of Intent Application Town of Yarmouth, 28 South Shore Drive Page 19 of 21 Other Protected Resource Areas Other resource areas protected under regulations include adjacent flood zones and Natural Heritage Endangered Species Program (NHESP), which will be filed concurrently with this application Massachusetts Endangered Species Act (MESA) and its implementing regulations (321 CMR 10.00). indicates potential Priority and Estimated Habitats mapped on the MA online viewer for this project location as indicated in the diagram below. FEMA FEMA Firmette for the Project Locus The existing property is located along Parkers River, and Nantucket Sound. The project area is within FEMA Flood Zone VE14, VE13, AE13 and AE11 as indicated on flood insurance rate map number 25001C0588J and 25001C0589J for Barnstable County Massachusetts both with an effective date of July 16, 2012. These elevations are based on the North American Vertical Datum of 1988 (NAVD88). C17189.03: Notice of Intent Application Town of Yarmouth, 28 South Shore Drive Page 20 of 21 NHESP NHESP Habitat Border in the Project Locus The project work area is not located within mapped Natural Heritage and Endangered Species Program (NHESP) priority Habitats for Rare Species. All work is to be performed inside of the seawall and revetment. Construction Protocol Prior to the Start of Construction: Prior to the start of any work there will be an on-site meeting to review the order of conditions and satisfy the Commission and conservation agent. Construction start date to occur upon completion of all pre-construction requirements outlined in the specifications and Order of Conditions, as well as any pre- construction requirements outlined during the pre-construction meeting. On-Site Meeting: Prior to start of construction a meeting will occur to discuss access and general means of construction with the following individuals represented: Coastal Engineering Company, Inc.- Civil Engineer Wilkinson Ecological Design – Ecological Designer General Contractor Site Work and Utility Contractor Yarmouth Conservation Commission Representative To be discussed during this meeting: Limit of work and erosion control Tree removal and protection Demolition procedures Construction sequencing and schedule Necessary post-construction reparations and conditions. C17189.03: Notice of Intent Application Town of Yarmouth, 28 South Shore Drive Page 21 of 21 Procedure for post-construction inspection. Project Contacts Order of Conditions During the preconstruction conference, the Engineer and Conservation Agent shall inspect the erosion and sedimentation barrier. Any deficiencies shall be addressed prior to the commencement of the site work and building reconstruction. Pre-Construction Requirements to be Met by Contractor: Proof and Certification of Insurance Coverage Waiver, Release and Indemnification Posting of DEP sign Pre-Construction Requirements to be Met by Owner: Pre-construction photographs of the access, staging area, and project locus. Access & Staging: The access to the work area will be front the driveway. Contractors and all heavy machinery will be confined to a limit of work specified on plan. When machinery and equipment are not in use, they will be stored in the designated stockpile area. Equipment: During the course of construction, the following equipment is anticipated: Excavator for demolition and excavation. Generator for power tools. Miscellaneous hand tools. Work Completion: Upon completion of the construction, all disturbed surfaces along the access route to be re-contoured to pre-construction conditions. The Contractor is to notify the Engineer for a meeting with the parties taking part in the pre-construction meeting, prior to removal of equipment. Deficiencies will be identified to the Contractor on re-contouring requirements, and re-vegetation, which will be performed under the direction of the Engineer. Post Construction Photographs: The applicant shall supply the Conservation Commission with post-construction photographs of the access and staging area, and the project locus, as well as the final vegetation plantings. Ecological Mitigation Protocol: In addition to the above, a separate project protocol and narrative is being provided by Wilkinson Ecological Design, which is included and made part of this NOI application package. Summary and Recommendations This project has been designed to minimize adverse effects on the wetlands resource areas or wildlife habitats. Each performance standard under the State and Local regulations has been addressed. We believe the information provided adequately describes the project and the design considerations taken to prevent adverse impacts to the wetland resource areas and recommend the Yarmouth Conservation Commission approved this project as presented. 28 Lots Hollow Road | Orleans, MA 02653 Tel:(508)255-1113 | Fax:(508)255-9477 Project Protocol and Narrative 28 South Shore Drive South Yarmouth, MA 5/11/2023 The project includes 5,265 square feet of lawn conversion to native vegetation and dune restoration within the 100’ River Front buffer as mitigation for the coverage increases in the River Front buffer zone. The 2,500 square feet of lawn conversion to a native vegetation buffer will immensely increase the biodiversity in this area of the property. Existing plant species in this area only include lawn and non-native species, such as rugosa rose and Alberta spruce, which do not provide the same ecological functions and services as native plant species. Twenty proposed native species will increase biodiversity and provide resources to wildlife that are not being offered by the existing non-native plant species. The flowering native species will offer a food source for insects, pollinators, birds and other native wildlife throughout the season. In addition, the proposed native plantings offer opportunities for cover and increased habitat benefit while decreasing the amount of lawn within the 200’ River Front buffer. The only State-listed invasive plant species observed within the project areas were two grey willow saplings (Salix cinerea) growing out of the existing bulkhead. To stop the spread of this species in the resource area and protect the existing bulkhead from physical damage as the gray willows increase in size, they are proposed to be managed using a cut and wipe herbicide treatment with an herbicide approved for use in wetlands. The cut stumps will be left in place to decay naturally and there will be no disturbance to the surrounding area. All plant debris will be removed from the site and disposed of properly. The 2,765 square feet of dune restoration proposes to increase the density of native vegetation within portions of the existing Coastal Dune resource area that lack a sufficient vegetative cover. This vegetation is also proposed to extend beyond the existing Coastal Dunes to encourage expansion. The increased density of vegetation will help to trap wind- blown sand and build the Coastal Dune overtime as well as increased coastal habitat benefit. In addition, a 265 square foot portion of the berm within the Coastal Dune has experienced erosion and lacks a vegetated cover. Approximately ten cubic yards of compatible sediment will be placed within the eroded portion of the berm to re-establish the Costal Dune in this location. American beach grass and seaside goldenrod will then be planted at 18 inches on center to vegetate and stabilize the newly added sediment and trap additional wind-blown sand to build the Coastal Dune overtime. Access for the implementation is proposed from the existing entry point at the end of South Shore Drive and across the beach.
