All filings must be made on Town of Yarmouth forms. The filing deadline is two weeks prior to the next
scheduled Conservation Commission meeting for new applications. Failure to follow this Checklist shall result
in an Administratively Incomplete Application and will not be advertised for a Public Hearing. Refer to the
meeting schedule. Contact the Conservation Office if you need assistance.

Dear Agent Brooks and Members of the Commission:
On behalf of Eversource Energy Service Company (Eversource), Tighe & Bond respectfully
submits this Request for Determination of Applicability (RDA) for a proposed Emergency
Response Plan (ERP) staging yard located at Eversource's existing operations center at 484
Willow Street in Yarmouth, Massachusetts . The proposed project involves constructing a
paved vehicle staging yard that will be used to assist Eversource in assembling crews and
equipment for restoring utility service during emergency response situations. In addition to
the staging yard, infiltration basins and a storm sewer will be constructed to manage
stormwater runoff. Site lighting, landscaping, fencing, and a fire hydrant will also be installed
as a part of this project.
This RDA is being filed since a small portion of the proposed work will occur within the 200-
foot Riverfront Area. This area is regulated under the Massachusetts Wetlands Protection Act
(WPA, M.G.L. c. 131 §40) as well as the Town of Barnstable Wetlands Protection Regulations
(Chapter 143). The Applicant respectfully requests that the Yarmouth Conservation
Commission make a Negative Determination, confirming that a Notice of Intent will not be
required for the project.
This RDA application includes the following items:

The following text describes the jurisdictional resource areas and other existing conditions,
proposed activities, and proposed protective measures.
Site Description
The Project Site consists of an approximately 4.38-acre forested area located at the southern
extent of the Eversource property. North of the project limits are the existing Eversource
Energy facilities, parking lots, and perimeter fencing. To the east is forested open space and
an unnamed perennial stream. A residential neighborhood is located to the south. Willow
Street follows the western boundary of the site, and the Barnstable Municipal Airport is located

to the west of Willow Street. Please refer to the figures provided in Attachment B and the
Project Drawings provided in Attachment C for more information on the project location.
Wetland Resource Areas
Site reconnaissance and wetland resource investigations of the project area were con ducted
by a Tighe & Bond wetland scientist on December 9, 2022. The reconnaissance was conducted
in accordance with the Massachusetts Department of Environmental Protection (MassDEP)
guidelines, 310 CMR 10.00, and local regulations. Jurisdictional resource area boundaries
were surveyed using an Arrow 100® Global Navigation Satellite System (GNSS) sub-meter
unit.

Vegetated Wetlands
Wetland Series 1B can presently be characterized as a palustrine forested (PFO) wetland
associated with the adjacent perennial river at the eastern extent of the project site. Observed
hydraulic indicators include drainage patterns, microtopography, and geomorphic position.
Commonly identified vegetation includes sweet pepperbush (Clethra anifolia; FAC), smooth
arrowwood (Viburnum dentatum; FAC), highbush blueberry (Vaccinium corymbosum; FACW),
and inkberry (Ilex glabra; FACW).
Inland Bank
Wetland Series 1A delineates the Bank of an upstream tributary of Hawes Run/Mill Creek to
the east of the Project Site. The stream appears to be manmade with steep vertical banks
and measures approximately 3 feet in width. The bottom is composed of a sandy, compacted
substrate with no emergent vegetation. A desktop review of the most recent United Stated
Geological Survey maps confirms this stream to be perennial.
Bordering Land Subject to Flooding
The Federal Emergency Management Agency (FEMA) flood map (Panel No. 2500 1C0567J,
effective July 16, 2014) was consulted to evaluate the presence of B ordering Land Subject to
Flooding (BLSF) at and near the project area. The project area does not fall within an area
subject to flooding and/or inundation by the 100 -year flood, and therefore is not regulated as
BLSF.
Rare Species
The Massachusetts Natural Heritage and Endangered Species Program (NHESP) Atlas (1 5th
edition, effective August 2021) and MassGIS online mapping tool were reviewed during the
preparation of this RDA. According to these sources, the project area does not fall within
Priority Habitats of Rare Species or Estimated Habitats of Rare Wildlife.
Proposed Activities

The proposed project involves constructing a vehicle and equipment staging yard at 484
Willow Street in Yarmouth. The staging yard will be used to assist Eversource Energy in
restoring utility service during emergency response situations. Vehicles and resources a re
brought in from other locations to assist with emergency response during large power
outages. The proposed staging yard will provide a location to organize these additional
resources. Outside of emergency response situations, the lot will be unoccupied.
Construction activities will include tree removal, clearing and grubbing of the area and fence
removal. Approximately 0.02 acres (870 square feet) of trees will be removed within
Riverfront Area. The majority of tree clearing outside of jurisdiction occurred during winter
months, minimizing impacts to potential wildlife. Once the Project Site has been graded, the
area will be compacted and paved.
In addition to the asphalt parking lot, an infiltration basin will be installed at the eastern end
of the Project Site in addition to storm sewers to manage stormwater runoff. Site lighting,
landscaping, fencing, and a fire hydrant will also be installed.
Once construction activities are complete, native landscaping will be planted along the
frontage and neighboring property lines to provide adequate screening. Additionally, the
landscaping screening will also maintain the existing aesthetic as currently viewed from Willow
Street. The infiltration basin and other open areas within the project footprint will be planted
with a native seed mix.
Protective Measures
Wetland resource areas in close proximity to the proposed project area will be protected by a
row of erosion control barriers. The erosion control barriers will consist of silt socks. Details
of both measures are provided in Appendix C. These measures will be installed prior to the
commencement of work and will be maintained for the duration of construction and until
disturbed areas are restored and stabilized.
Regulatory Discussion
The proposed work will result in approximately 870 square feet (sf) of permanent impacts to
the outer 100 feet of the 200-foot Riverfront Area. These impacts are associated with tree
clearing and the installation of stormwater management features, as well as fencing and
landscaping at the eastern extent of the Project Site. No impacts are anticipated to Bordering
Vegetated Wetlands (BVW) or the associated 100-foot Buffer Zone as a result of project
activities. The Town of Yarmouth Chapter 143 does not have regulations more stringent than
the WPA regarding the Riverfront Area.
The proposed work was designed to minimize impacts to resource areas and temporarily
disturbed areas will be restored to pre-existing conditions to the extent practicable.
Application Requirements
A filing fee of $75 as well as the legal advertising fee has been submitted to the Yarmouth
Conservation Commission, and abutters to the project will be notified via USPS Certificates of
Mailing in accordance with the Town of Yarmouth Wetland Protection Regulations abutter
notification requirements. A copy of the abutter notification form and a list of abutters is
enclosed in Attachment F.

Summary

Conservation Commission at the public hearing on June 1, 2023. We anticipate these materials
are sufficient for the Commission to issue a Negative Determination confirming the proposed
