SUB: Request for Extension – After the Fact Notice of Intent, Enforcement Order – 13 Webster Road –
WPA Form 9, Dated 2/6/2023
Dear Ms. DiRienzo,
Please file this letter with respect to the Enforcement Order on 13 Webster Road, WPA Form 9, dated
2/6/2023. We greatly appreciate your willingness to extend our filing date for the “After the Fact Notice
of Intent” from May 18, 2023 to June 15, 2023. This letter, however, takes your recommendation to
bring additional extension requests to the Commission if needed.
Background: We have retained Down Cape Engineering to provide a site as-built and “after the fact”
permitting of hardscape. This comes after receiving a list in March of potential firms from the
Conservation Commission office and contacting potential firms. Down Cape Engineering was the only
firm contacted who was able to schedule us in due to the busy construction activity on the Cape. They
submitted a proposal to us on April 14, 2023 and a contract was established by the end of April but with
an understanding they are extraordinarily busy and backed up approximately 3-4 months. Heatherlee
Vermette, of Down Cape Engineering, wrote to Ms. Brittany Dirienzo of the Conservation Commission
with this information. Ms. Vermette wrote that she does not expect it will be possible before August.
Extension Request: Based on our clear intent to file and the information provided above, we request an
extension to September 21, 2023.
