Dear Mr. Callahan:
Our records indicate that the Yarmouth Conservation Commission issued three separate Orders of
Conditions for the above address:
SE#83-1461 Issued 1/4/1999 to remove structure and construct single family dwelling
SE#83-1547 Issued 5/16/2001 to construct in -ground swimming pool, boathouse and dock
SE#83-1865 Issued 10/6/2009 to reconstruct existing subsurface groundwater drain
Although these Orders have expired, whether the permits were issued to you or you purchased a
property that has an open permit, as the current owner of record, you are responsible for properly
closing out these Orders. Since the Orders were most likely recorded in your chain of title at the
Barnstable County Registry of Deeds, they create a lien on your title until they are properly closed out.
Please follow the Administrative Checklist and fill out Form 8A Request for Certificate of Compliance
("COC"), which are both found on our website at www.varmouth.ma.us/696/Filing-Forms, FOR EACH
PERMIT. If the projects have been completed in accordance with plans stamped by a registered
professional engineer, architect, landscape architect or land surveyor, a written statement by such a
professional certifying substantial compliance with the plans approved in each Order (and/or
describing deviations, if any exist, from the plans) must accompany each Request.
For each permit, Please submit the Administrative Checklist, completed Request for COC,
certified professional statement, stamped as -built plan if required under the special conditions
in the Order of Conditions and the filing fee of $75 to the Conservation Office. An electronic
copy of each application must also be submitted. Additionally, all erosion controls must be
removed off site and disposed of properly.
The Commission will then review and vote on the request at a scheduled meeting. If the request is
approved, a Certificate of Compliance will be issued to you, which will need to be recorded at the
Barnstable County Registry of Deeds to officially close out the permit. Your property's Conservation
records can be found online at Yarmouth.ma.us/LF.
