Subject: Planner Report for ANR Plan #2938
Un-numbered unbuildable lot southwest of 162 Pleasant Street
Assessor Map 51.91
Please find attached application Form A and ANR Plan #2938 submitted for a property
located off Pleasant Street southwest of 162 Pleasant Street, South Yarmouth,
Assessor’s Map 51.91. The parcel includes a 30’ private way to access 162A and 162B
Pleasant Street, as well as a 7’ wide footpath and private beach area along Bass River.
The ANR Plan will divide this unbuildable lot into three unbuildable lots Parcels 4-A, 4-B
and 4-C for conveyance purposes. Parcel 4-A will remain the 30’ private access, Parcel
4-B (footpath) will be conveyed to the adjacent 170 Pleasant Street and Parcel 4-C
(beach area) will be conveyed to the adjacent 162B Pleasant Street. According to Dan
Ojala of Down Cape Engineering, research conducted by law firm Nutter McClennen &
Fish confirmed that no other properties have rights to the footpath/beach area.
The submission was complete and included the required fee, Form A, ANR plan, and
the appropriate number of copies. The ANR Plan is entitled, “Plan of Land in South
Yarmouth, MA, prepared for Eleanor D. Acheson & Emily Hewitt”. The Plan was
prepared by Daniel A. Ojala, PLS of Down Cape Engineering, Inc, and is dated and
stamped March 31, 2023.
This application was received on April 4, 2023, and a decision is required by April 24,
2023 to remain within the 21-day statutory requirements. This project has been placed
on the Planning Board Meeting Agenda for April 19, 2023.
Planner Suggestion: Recommend the Planning Board make a motion to endorse ANR
Plan #2938 prepared by Down Cape Engineering and dated March 31, 2023.
