Hi Lisa,
I do not believe the Covenant you are referencing applies to 1 Algonquin Street. Lot 72 (1 Algonquin) was created by
Planning Board Subdivision 1887.
Also, the document you sent is far more involved than what is typically done by the Planning Board for a release. The
most you would get is a re‐issuance of the original lot release I sent you, although the Book Number is Land Court
19724K.

1 Algonquin was created as Lot 72 by Planning Board Subdivision #1887 which was subsequently converted to the
attached Land Court Plan 19724K. The attached lot release for Planning Board Subdivision #1887 releases Lot 72 from
an Agreement/Covenant with the Planning Board. However, I do not believe it was the one you sent as that subdivision
(PB #1193) did not include the creation of Algonquin Street. I do not know if the lot release was recorded at the registry.

I left you a voicemail today regarding the above‐referenced property. Our office represents the estate of Howard
Lawrence who owns the property (along with a trust after the death of his wife, Shirley Lawrence). The property is
under a purchase and sale agreement between the estate/trust and an unrelated third party. The title company for the
buyer is requesting a Release from the Town of Yarmouth Planning Board for the attached document that affects Lot
#72 which is this property. I’ve also attached a copy of the Lawrence deed which references the restriction and is
highlighted on page 3.
I don’t know if you are the correct person or department that can obtain this Release. If not, any assistance in how to
obtain a Release would be greatly appreciated.

I took another look at this. I have attached the Planning Board Agreement, which specifically
applies to “lot 46 shown on Land Court Plan 19724D, Sheet 2”. As you have pointed out, Lot
46 was subdivided in Land Court Plan 19724-I, and that lot became 13 lots, numbered 57
through 69, and created Algonquin Street and Sea Robin Road. Then, in Land Court Plan
19724-K, Lot 69 was subdivided to create Lots 71 through 83. Lot 72 is now known as
Algonquin Street.
On one hand, you are correct that the Planning Board Agreement applied to Lot 46. However,
we can agree that it has NEVER been released by the Planning Board. Lot 72 (1 Algonquin) is
undoubtedly part of what was once Lot 46, which was never released from the
Agreement. Although you are technically correct that the Agreement does not say, specifically,
that it applies to Lot 72, I think you can logically see that the Agreement applied to the entire
parcel, formerly known as Lot 46. It is not a jump to think that a title examiner would want this
released once and for all. Also, because this is a Land Court parcel, I can tell you that the
Certificate of Title for 1 Algonquin recites the Planning Board Covenant on the encumbrance
sheet. This is not something that I did or that the current owner did – this is created by the Land
Court in Boston. Finally, if we ever conveyed this lot with the Agreement still in effect, I could
only imagine the hard time I would get from the Planning Board for daring to allow the
conveyance to go through without calling the Planning Board first, to find out if the Agreement
was still effective. I have seen it done at numerous local Board meetings, where title attorneys
are called all kinds of names, and belittled for not “catching it”. I continue to believe, from a
title perspective, that your Planning Board’s Agreement is still effective, until released. Asking
your Board to release it for these reasons is not outrageous.

Hi Paul,
It makes no sense to me why the deed for 1 Algonquin would reference an Agreement with the Planning Board that did
not include the actual creaƟon of that lot. Although LC 19724D references lot 46, it is LC 19724I (Planning Board # 1193
– Harbor Estates) that subdivides lot 46 into the plan related to the 1959 Agreement. Then LC 19724K actually creates
lot 72 in 1966 which is 1 Algonquin (Planning Board #1887).
I can’t deny that the deed references the 1959 Agreement (document 61808), but it wasn’t imposed by the Planning
Board for that lot. So are we just trying to correct an error in the deed? That I can understand.

I don’t see how the Agreement registered as Document 61808 cannot apply to our lot. The
Land Court Plan 19724-D, Sheet 2 includes our lot. When was this Agreement ever
released? We will need that release to close. I have attached a copy of the Agreement, Land
Court Plan 19724-D and Land Court Plan 19724-K, which evidences that the Agreement
applies to our lot, and that it has not been released.

I do not believe the Covenant you are referencing applies to 1 Algonquin Street. Lot 72 (1 Algonquin) was created by
Planning Board Subdivision 1887.
Also, the document you sent is far more involved than what is typically done by the Planning Board for a release. The
most you would get is a re‐issuance of the original lot release I sent you, although the Book Number is Land Court
19724K.

1 Algonquin was created as Lot 72 by Planning Board Subdivision #1887 which was subsequently converted to the
attached Land Court Plan 19724K. The attached lot release for Planning Board Subdivision #1887 releases Lot 72 from
an Agreement/Covenant with the Planning Board. However, I do not believe it was the one you sent as that subdivision
(PB #1193) did not include the creation of Algonquin Street. I do not know if the lot release was recorded at the registry.

I left you a voicemail today regarding the above‐referenced property. Our office represents the estate of Howard
Lawrence who owns the property (along with a trust after the death of his wife, Shirley Lawrence). The property is
under a purchase and sale agreement between the estate/trust and an unrelated third party. The title company for the
buyer is requesting a Release from the Town of Yarmouth Planning Board for the attached document that affects Lot
#72 which is this property. I’ve also attached a copy of the Lawrence deed which references the restriction and is
highlighted on page 3.
I don’t know if you are the correct person or department that can obtain this Release. If not, any assistance in how to
obtain a Release would be greatly appreciated.
