Instructions: ― Describe the intended construction sequencing and timing of major activities, including any opportunities for phasing grading and stabilization activities to minimize the overall amount of disturbed soil that will be subject to potential erosion at one time. Also, describe opportunities for timing grading and stabilization so that all or a majority of the soil disturbance occurs during a time of year with less erosion potential (i.e., during the dry or less windy season). (NRS) completed its freshwater wetland site inspection of the above-referenced properties. This field work was performed in accordance with the stand- ards and definitions of the Massachusetts Wetlands Protection Act (M.G.L. ch. 131, §40) and its regulations (310 CMR 10.00 et seq.). Wetlands within the Town of Yarmouth fall under the regulating authority of the Yarmouth Conservation Commission. The site inspection was per- formed by NRS biologist Edward J. Avizinis, CPSS, PWS on November 16, 2018. The subject parcels are located along the west side of Station Avenue and are bounded by commercial development to the north and west as well as railroad tracks to the south. These lots encompass an area of approximately 1.32 acres in size. The inspected area is comprised of an upland pitch pine (Pinus rigida) forest. Based on the findings of this inspection, there are no freshwater wetlands situated within these lots nor are there any such resource areas within 200 feet of the parcels. Therefore, the specified project area is comprised of upland which is located outside of the jurisdiction of the MA Wetlands Protection Act. If the intended use of the property is the establishment of a motor vehicle fueling station, there are additional state and local land-use rules which may apply. For instance, the Town of Yarmouth General Bylaws applies specific standards to the placement of underground storage tanks (Chapter 250). This property is also located within a Zone II Interim Wellhead Protection Area (IWPA), a designation which factors into the potential use of the site as detailed in 310 CMR 22.00 et seq. A GIS graphic depicting the Zone II overlay from MassGIS has been append- ed with this letter for reference. This property also lies within the town’s Aquifer Protection Overlay District (Section 406.3 et seq.), a land-use designation which prohibits certain uses such as petroleum storage un- less the applicant can meet certain design criteria established by the Massachusetts Department of Environmental Protection. However, it is also important to note that, as per the Table of Use within the town’s Zoning Bylaw (Section 202; Row H6 under ‘Retail’), “Motor vehicle fuel & service” establishments are prohibited uses within this overlay district. This letter has been prepared to describe the site inspection performed by NRS. There are no regulated resource areas within the property as defined by the MA Wetlands Protection. However, the location of the site within a Zone II and the fact that it is located within the munic- ipality’s Aquifer Protection Overlay District may impact the potential use of the site depending on what type of activity is considered.
