Subject: Revitalization Overlay Architectural District (R.O.A.D) Application #2023-1
1272, 1276 & 1282 Route 28, South Yarmouth MA
Please find attached another R.O.A.D. Application #2023-1 for a revised project at 1272, 1276
& 1282 Route 28 in South Yarmouth (Assessor Map 60, Parcels 130, 131& 132). The
application was submitted to the Planning Board on July 10, 2023 by Ekaterina & Family LLC
(Jay Mart), and Jay Imad, Trustee of the Cedars of Lebanon Trust.
The CEDC reviewed a previous ROAD Application for this project back in May of 2022 (#2022-
1) and a revised Application back in October of 2022 (#2022-2). The Applicants have
resubmitted the project to try to address comments received during the Zoning Board of
Appeals (ZBA) Public Hearing on the #2022-2 application which was ultimately withdrawn
without prejudice. The revised plan still includes demolishing all existing buildings on the three
properties and construction of a gas station, convenience store with coffee shop and drive
thru, and 4 units of residential housing. The major change includes the separation of the
residential housing from the convenience store/coffee shop building. The 4 residential units
will now be located in a separate 3,755 sf two-story structure on the east side of the property
with a separate parking lot located directly behind. The convenience store/ drive-thru building
has been modified to a single story 3,890 sf building with the pick-up window relocated to the
western side of the building. The gas pumps remain at 4 pumps with a hipped roof canopy.
The attached application materials include a brief narrative from the applicant regarding the
economic benefits of the project. Per the requirements of Section 411 – Revitalization Overlay
Architectural District (R.O.A.D.) of the Zoning Bylaw, the application is being submitted to the
CEDC for your review and comments related to the overall project and its economic benefits.
Review of this project is currently on the CEDC Agenda for your July 25, 2023 meeting. The
Public Hearing with the Planning Board is scheduled for August 16th. Your input on the project
would be greatly appreciated.

SUBJECT: 1272, 1276, and 1282 Route 28 ROAD Application

The Yarmouth Community and Economic Committee recently met on July 25, 2023 to discuss the
ROAD application submitted to the Planning Board on July 10, 2023 for the properties located at
1272, 1276 and 1282 Route 28. A project update presented to the Committee by project
proponents noting that the economic benefits of the project (job creation, new construction,
housing and related tax revenues) were similar to those previously presented. Based on this
information, the Committee voted 4‐0‐1 (Peter Slovak abstained) to recommend the project as
presented to the Planning Board.
