Dear Ms. DiRienzo and Members of the Conservation Commission:
BSC Goup, Inc. is pleased to submit this Request for Determination of Applicability Application (RDA) on
behalf of our client, the Scott Cooper for work proposed at 30 Channel Point Drive in West Yarmouth (the
Site). This application Is being submitted to permit the construction of two additions and a pergola at the
front of the existing single-family home.
The existing Site contains a single-family home located along Sweetheart Creek in West Yarmouth. The
resource areas on Site that are under the jurisdiction of the WPA and the Town of Yarmouth Conservation
Commission Include Land Under Water, Salt Marsh, Coastal Bank and Flood Zone (AE El. 11). The two
proposed additions and the proposed pergola are located at the front of the house situated as far from
the resource areas as possible while still being attached to the existing single-family home. The proposed
additions and pergola are located at the outer edge of the 100' buffer zone to top of coastal bank and
Impacts are restricted to the 50-100' buffer zone to top of coastal bank.
The proposed additions and pergola will be located overtop of existing gravel driveway. The
Massachusetts Wetlands Protection Act lists minor exemptions In section 310 CMR 10.02 (2)(b)(2). Minor
exemption 10.02(2)(b)(2)(e ) states that…
"The conversion of lawn to uses accessory to residential structures such as decks, sheds, patios, pools,
etc.… provided the activity, including material staging and stockpiling Is located more than 50 feet from
the mean annual high-water line within the RFA, bank, or bordering vegetated wetland, whichever Is father,
and erosion and sedimentation controls are Implemented during construction."
While the proposed project does not Include converting lawn to accessory structures, we are proposing
to convert existing gravel driveway to accessory structures. Therefore, the proposed project does not
Include new Impacts, simply converting the area Impacted by the existing gravel driveway to two new
additions and a pergola. Sediment controls are proposed between the limit of work and the adjacent
wetland resource areas. Caution will be taken to ensure that no construction debris enters the wetland
and If any debris does enter a wetland It will be removed Immediately.
This application Is being submitted In accordance with the regulations stated within the Massachusetts
Wetlands Protection Act (310 CMR 10.00) and the Town of Yarmouth Wetlands Protection Bylaw.

Information:
All filings must be made on Town of Yarmouth forms. The filing deadline is two weeks prior to the next
scheduled Conservation Commission meeting for new applications. Failure to follow this Checklist shall result
in an Administratively Incomplete Application and will not be advertised for a Public Hearing. Refer to the
meeting schedule. Contact the Conservation Office if you need assistance.
Submitting an Application:
Hardcopy filing dropped off or mailed to the Conservation Office including:

Complete RDA application with original signatures (double sided). *
Detailed narrative of the project with sufficient information to enable the Commission to determine
whether the proposed work will alter an area subject to protection.
BVW delineation sheet(s), coastal bank calculation and other relevant material if applicable (not
applicable for flood zone only projects).
Yarmouth Assessor’s locator map highlighting parcel(s) where work is proposed, including map and
parcel numbers
1 original and 7 photocopies of the plan/sketch, folded separately, right side out with title and address
visible. All plans shall reference NAVD1988 unless otherwise noted. Landscape plans shall be
detailed to show proposed and existing conditions, native species, size and spacing.

I CERTIFY that all on-site requirements will be completed by noon on the Friday prior to the
hearing date. All proposed structures must be staked, and all relevant resource areas and buffer
zones must be staked or flagged. Please consult the Yarmouth Wetland Regulations, page 17.

The proposed project includes constructing two additions and a pergola. The additions and pergola
will go at the front of the existing house, and as far from resource areas as possible. Work will only take
place at the outer edge of the 50'-100' buffer zone to top of coastal bank.See cover letter for project
description.
