It appearing that notice of said bearing has been given by sending notice thereof to the petitioner and all those
owners of property deemed by the Board to be affected thereby, and to the public by posting notice of the
hearing and published in The Register, the hearing was opened and held on the date stated above.
The petitioner seeks a Special Permit per bylaw § 104.4, to convert existing residential structure to
condominium ownership.
The property is located within the R40 zoning district. The site contains approximately 20,000 square feet of
area, and contains three (3) residential structures; one two-family home and 2 smaller single-family structures.
Each of the four (4) existing units are one -bedroom year round dwellings. The best available information is that
each was constructed as a residence prior to the adoption of zoning in this area, and has been continuously used
as a residence since that time. No physical expansion of any of the structures is proposed. Renovations of each
building are currently in progress. A new septic system was constructed in 1999, servicing all four units.
The petitioner's condominium documents reflect the use of the buildings, each to be a one bedroom residential
unit. They provide for proper management and maintenance of all common facilities, and for typical operations
of the condominiums. The petitioner agreed to include reference in each Unit Deed to its being subject to the
Special Permit issued by the Board.
The Board finds that the proposed conversion of these structures to condominium ownership will not result in a
change of use, and that the organizational documents provide for conforming management and maintenance of
the facilities.
Accordingly, a motion was made by Mr. DeYoung, seconded by Mrs. Moudouris, to grant the Special Permit,
as requested. The members voted unanimously in favor. The Special Permit is therefore granted.
No permit shall issue until 20 days from the filing of this decision with the Town Clerk. Appeals from this
decision shall be made pursuant to MGL c40A section 17 and must be filed within 20 days after filing of this
notice/d.Leision with the Town. Clerk. Unless otherwise provided herein, the Special Permit shall lapse if a
su ' use thereof has igot begun within 24 months. (See bylaw § 103.2.5, MGL c40A §9)

The Board of Appeals of the Town of Yarmouth Massachusetts hereby certifies that a

Appeals further certifies that the decision attached hereto is a true and correct copy of its
decision granting said Special Permit, and that copies of said decision, and of all plans referred to
in the decision, have been filed.
The Board of Appeals also calls to the attention of the owner or applicant that General
Laws, Chapter 40A, Section 11 (last paragraph) and Section 13, provides that no Special Permit,
or any extension, modification or renewal thereof, shall take effect until a copy of the decision
bearing the certification of the Town Clerk that twenty (20) days have elapsed after the decision
has been filed in the office of the Town Clerk and no appeal has been filed or that, if such appeal
has been filed, that it has been dismissed or denied, is recorded in the registry of deeds for the
county and district in which the land is located and indexed in the grantor index under the name
of the owner of record or is recorded and noted on the owner's certificate of title. The fee for
such recording or registering shall be paid by the owner or applicant.

Proiect Summary
The applicant proposes to condominiumize 3 existing residential structures with 4 residential units at this site in the R40
zone. A Special Permit, per Bylaw section 104.4.1, will be required from the Board of Appeals.
Comments
Building: (1)Relief from the Board of Appeals is required as stated in the Project Summary. (2)Signage shall meet the
C. requirements of zoning bylaw Section 303.
Conservation: Not present.
Design Review: Not present.
Economic Development: Not present.
Engineering: Ask Town Surveyor for street numbers for units.
Fire: Recommend hardwired smoke detectors in each unit. The access appears to be adequate at this time.
Health: Must review the number of people allowed by code for each unit. Health dept licenses unit 3 & 4 as one bedroom
and one person each only, due to limited square footage.
lanning: Condominium documents, a Master Deed and a Declaration of Trust, were not submitted for review prior to
the Site Plan Review meeting. After a very quick review, the documents can be seen to include the number of units (4).
Units are described as containing kitchens. No seasonality of use or time sharing was found to be mentioned in either
document. A management authority is created in the Declaration document and common facilities, which include water
lines, septic systems, driveways, parking areas, walkways, etc.
Water: One water service is to be taken care of by the condo association, and paid by the association. Must be shown by
the condo documents.

The Petitioner understands and agrees:

That the public hearing will not be held within 65 days of the filing of this Application, or
That the Board will not take "final action" on the request for a Special Permit within 90
days of the conclusion of the public hearing, or
That the decision of the Board on a Variance request will not be made within 100 days of
the filing of the application.
Further, the petitioner agrees with the Board to extend the time frames within which the
hearing, re -hearing or continuance are to he held and the decision(s) are to be made and filed by
the Yarmouth Board of Appeals, and to waive any rights to the Constructive Grant of this
petition, provided that the Board does act within the time frame of this agreement. It is therefore
agreed that the Hearing shall be held/continued on
