Subject: Planner Report for ANR Plan #2939
1121 Route 28, South Yarmouth, Assessor Map 50.108 & 50.108.1
Please find attached application Form A and ANR Plan #2939 submitted for the property located
at 1121 Route 28, South Yarmouth, Assessor’s Map 50.108 & 50.108.1. The Board may recall
that the property at 1121 Route 28 went through the Village Centers Overlay District (VCOD VC4)
for a mixed-use project which included the commercial entity (manufacturing of artificial teeth) in
the existing building on the property and nine (9) proposed residential units in three triplexes.
The property was later condominiumized to allow for separate ownership of the commercial and
residential components. Subsequently, Habitat for Humanity of Cape Cod became interested in
acquiring the residential portion of the property to construct affordable single-family homes. The
purpose of the ANR Plan is to subdivide the existing condominium lot into two separate lots.
The submission was complete and included the required fee, Form A, ANR plan, and the
appropriate number of copies. The ANR Plan is entitled, “Approval Not Required Plan of Land at
1121 Route 28, Yarmouth, Massachusetts as surveyed and prepared for MRL Realty, LLC 37
Industrial Park Road Plymouth, MA 02630 and Shoestring Properties, LLC 297 North Street
Hyannis, MA 02601”. The Plan was prepared by John M. O’Reilly, PLS of J.M. O’Reilly &
Associates, and is dated and stamped August 4, 2023.
The application also included the attached Site Plan – Lot 1 Improvement, which shows how the
improvements on Lot 1 can be made to allow for separate parking and side buffers for the
commercial lot. Please note that this is for information purposes only and the Planning Board is
not making a determination on zoning compliance through an ANR Plan endorsement.
This application was received on August 9, 2023, and a decision is required by August 29, 2023
to remain within the 21-day statutory requirements. This project has been placed on the Planning
Board Meeting Agenda for August 16, 2023.
Planner Suggestion: Recommend the Planning Board make a motion to endorse ANR Plan
#2939 prepared by J.M. O’Reilly & Associates, and dated August 4, 2023.
