General Description: Ekaterina & Family LLC and Jay Imad, Trustee of the Cedars of Lebanon Trust, have submitted a Revitalization Overlay Architectural District (ROAD) Application #2023-1 for a further modified redevelopment project at 1272, 1276 and 1282 Route 28, South Yarmouth, MA (Assessor Map 60, Parcels 130, 131 & 132). The Planning Board reviewed a previous ROAD Application for this project back in June of 2022 (#2022-1) which was ultimately withdrawn without prejudice, and a revised Application back in January of 2023 (#2022-2) which was approved by the Planning Board with conditions. The Applicants have resubmitted the project to try to address comments received during the Zoning Board of Appeals (ZBA) Public Hearing on application #2022-2 which was ultimately withdrawn without prejudice. The revised plan still includes demolishing all existing buildings on the three properties and construction of a gas station, convenience store with coffee shop and drive through, and 4 units of residential housing. The major change includes the separation of the residential housing from the convenience store/coffee shop building. The 4 residential units will now be in a separate 3,755 sf two-story structure on the east side of the property with a separate parking lot located directly behind. The convenience store/ drive-thru building has been modified to a 3,890 sf building with the pick-up window relocated to the western side of the building. The gas pumps remain at 4 pumps with a hipped roof canopy. The project also includes various site and utility improvements as well as irrigated buffer and landscaped areas. The combined lots total 1.14 acres and currently contain five cottages, a convenience store and two gas pumps with canopy. B. Process: Section 411 – ROAD Bylaw, allows for zoning flexibility in exchange for a high standard of site and building design. The Planning Board serves as the Design Review Authority for ROAD projects and is tasked with ensuring the project substantially adheres to the Yarmouth Architectural and Site Design Standards (Design Standards). If the Planning Board approves the ROAD District Development Plan, the applicant can submit for a Special Permit from the ZBA for relief needed rather than requesting any Variances, which are more difficult to obtain. Within 45-days of submission, the Planning Board needs to issue their decision on the ROAD District Development Plan after having a Public Hearing. The application was submitted on July 10, 2023 with the 45-day deadline on August 23, 2023. Failure to act by August 23rd results in disapproval without prejudice unless the timeline is further extended. The Public Hearing is scheduled for August 16, 2023. The attached Public Hearing Notice was published in the Cape Cod Times on August 1st and August 8th and notification to abutters within 300’ of all three Planning Division Page 2 of 4 Planning Board Planner Report – ROAD 2023-1 – 1272, 1276 & 1282 Route 28 August 11, 2023 properties was sent on August 2nd. Approval of a ROAD District Development Plan requires a majority vote (4 out of 7). C. Review Criteria: When considering approval of a ROAD District Development Plan, the Planning Board shall consider the following criteria, standards, objectives, and recommendations as outlined in Section 411.5.1 and have been summarized below. Refer to the attached Applicant’s Narrative for a detailed list of criteria. Please note a proposal need not satisfy all criteria to receive approval. 1. Site Plan Review Objectives: related to adequate internal circulation/egress and traffic safety; reasonable measures taken to reduce parking visibility from public ways; adequate fire and service equipment access; adequate utilities, drainage, and fire protection; and minimize removal of existing trees within the buffer zones. 2. Design Review Objectives: related to improving aesthetic quality of buildings and sites; promote attractive and viable commercial districts; preserve the pattern of the neighborhood; encourage public amenities; Cape Cod architectural styles using traditional building materials and muted colors; and internal parking circulation to reduce curb cuts, improve landscaping and traffic flow, allow for proper turning radius and parking space, encourage pedestrian uses and access, screen trash receptacles, and minimize any accessory signage. 3. ROAD Goals, Purpose & Objectives: provides zoning flexibility and incentives to encourage business opportunities and redevelopment while preserving and enhancing our historic community; promotes quality redevelopment through design standards; requires the project to substantially adhere to the Design Standards as determined by the Planning Board; and adheres to the intent and purposes of the underlying zoning. 4. Economic Benefits of the Proposed Project. 5. SPR and CECD Recommendations. 6. Supplementary ROAD District standards: related to the quality of aesthetic and architectural styles; color and materials; balances economic growth and employment with protection of the natural environment; the benefits of the ROAD project shall outweigh its detriments; and the benefits of any deviation or relief from the underlying zoning bylaw shall outweigh any detriments as determined by the Planning Board. D. Other Committee Comments: 1. Community & Economic Development Committee: The CEDC reviewed this modified project at their meeting on July 25, 2023 and voted to recommend the project to the Planning Board based on its economic benefits. Refer to the attached August 2, 2023 Memo from CEDC. 2. Site Plan Review (SPR): Most of the comments in the attached June 6, 2023 SPR Comment Sheet are related to other permits or regulatory requirements that the Applicant needs to adhere to and will be addressed during permitting for the project. Edits have been made to the plans to address zoning and design related SPR comments including eliminating the second menu board, adding two in-lot trees, eliminating the side yard encroachment through revised grading (see revised 8/11/23 plan), adding a note to retain and protect existing arborvitaes along the eastern property line; adding 6’ fencing along the eastern property line; relocating the underground drainage to outside the buffer areas to allow for plantings in the front buffer island; modifying lighting footcandles; providing underground electrical service to the residential building; modifying the commercial building to add shed dormer to eliminate large expanse of roof; and modifying the covers over the doors to the residential building. The Applicant is also proposing an 8’ privacy fence along the entirety of the northern property lines. The Planning Board had previously conditioned their approval to require an 8’ acoustic fence. The Applicant has included the attached August 1, 2023 Letter providing information on decibel levels at the property line from the drive-thru intercom system. Design Review Committee (DRC) & Architectural and Site Design Standards (Design Standards): The DRC reviewed this project on July 18, 2023 in an advisory capacity (see the attached DRC Comment Sheet). The DRC appreciated the modifications and felt this was a superior project to that previously proposed. The DRC denoted all the Siting and Building Strategies as either Not Applicable (N/A) or Meets Standards (substantially). There was a suggestion by a DRC member to reduce the shed dormer on the west side if the space above isn’t needed. The Applicant has indicated they may use the upper level over the convenience store for a personal office/storage space, not to exceed 600 square feet in size. E. Bylaw Relief: Although the Planning Board is not granting any waivers, they need to review the benefits of any relief requested compared to any detriments. It should be noted that the currently developed sites have some existing non-conformities. Per the SPR Comments, the Application Narrative and plan modifications, the following relief in the form of a Special Permit will be required providing all mandatory sections of 411 are met. 1. Building front setback, section 203.5 2. Parking behind front setback, section 301.4.1 3. In lot trees, section 301.4.6 (1 short) 4. Drive through buffer distance to residential zone of 100’, section 301.8. 5. Front landscape buffer width, section 301.4.4. 6. A12, multifamily use, table 202.5 and Section 411 (with no more than 50% of total building floor area being used for residential) 7. H6, gas station use, table 202.5. 8. Signs on front and right-side elevations, section 303.5.5 F. Options: Depending upon the deliberations of the Board, they may wish to approve, approve with conditions, or deny the ROAD Application #2023-1, but will need to provide some findings or reasoning for whichever decision is made. The ROAD #2023-1 application already incorporates some of the conditions contained in the Certificate of Approval for ROAD application #2022-2 by including more tree species, reducing the footcandles under the canopy, and showing a 6’ fence along the eastern property line. The issue related to the eastern property line was resolved previously with further analysis by their Surveyor. The last condition was “Install an eight (8) foot acoustic fence along the entirety of the northern property line abutting the residential zoning district.” A solid 8’ privacy fence is proposed. The Applicant provided supplemental noise mitigation information for consideration by the Planning Board and the Board may or may not want to include this condition for an acoustic fence. 1. Approval: The Planning Board could make a motion to Approve ROAD Application #2023-1 submitted for 1272, 1276 & 1282 Route 28, South Yarmouth with the following conditions: a. Existing arborvitaes along the eastern property line shall remain and be protected during construction and no grading shall be done in proximity to this buffer vegetation which would impact their long term viability. b. Others? Some findings of the Board to support an Approval could include: a. Results in economic benefits to the Town and recommended by the Community & Economic Development Committee. b. The Design Review Committee and the Planning Board have both determined that the project substantially adheres to the applicable sections of the Yarmouth Architectural and Site Design Standards. Improves the aesthetics of the buildings using cape cod style architecture, traditional looking building materials and muted colors. d. Promotes an attractive and viable commercial district. e. Improves the buffering along the public way with wider buffers, additional landscaping, and fewer curb cuts, and provides for enhanced landscape buffers along abutting properties. f. Provides fire access, internal circulation/egress, pedestrian access, and bike racks. g. The residential building will have a sprinkler system for fire protection. h. Utilities and drainage provide functional service for the site and structures. i. Property does not impact wetlands, floodplains, or drinking water recharge areas. j. The benefits of the project outweigh the detriments resulting from the requested relief being through a Special Permit. 2. Denial: The Planning Board could make a motion to deny ROAD Application #2023-1 submitted for 1272, 1276 & 1282 Route 28, South Yarmouth. However, the Board would need to clearly document the reasons why the application is being denied based upon the review criteria. I have the following information regarding the proposed Dunkin drive-thru service and noise mitigation: The projected peak hours for Dunkin drive-thru are between 6 am to 9 am. Dunkin uses the 3M C860 and C960 intercom systems which are preadjusted at the factory to produce an audio sound pressure level of 70 decibels at a distance of 4 feet on axis to the center of the speaker. Sound diminishes at the rate of 6 decibels every time the distance from the sound source is doubled. So at a distance of 8 feet from the speaker, the level is 64 feet and at 16 feet it is 58 decibels and at 32 feet it is 52 decibels. The closest point from the proposed speaker location to the residential property line to the north is approximately 46 feet at the proposed 8-foot high PVC fence at the property line. As stated above at 32 feet away from the speaker the decibels level is at 52 decibels (without any mitigation) adding the 20-foot landscape buffer along with the proposed 8-foot high PVC fence (STC rating of 26) with arborvitaes combination for sound mitigation, we anticipate an ambient noise reduction by 8- 10 decibels bringing the decibels level at the property line (at the 8-foot high PVC fence location) to 44-42 decibels which is lower than normal conversation level at 60 decibels.
