Request for Certificate of Compliance
Dear Commission Members:
The property owners modified their existing, licensed pier at 24 Scallop Road, West
Yarmouth to better conform with Town of Yarmouth Wetlands Protection Regulations,
Section 109(4)a, Docks and Piers, as requested by the Conservation Administrator. The
Conservation Commission issued an Order of Conditions approving the modification under
Wetlands File No. SE 83-2241, August 25, 2020. The work has been completed and Down
Cape Engineering, Inc. located the rebuilt structure, shown on the Pier As -Built Plan, dated
October 18, 2022. Hamlyn Consulting visited the property in June 2023 to inspect the
construction and site for compliance with the Order and approved plan.
The fixed pier was extended 16 feet to elevate the structure above the salt marsh, using
ThruFlow panels. An additional metal pipe was installed to stabilize the floats, which were
switched in order so that the wider float could accommodate the ramp bottom. All pier
components were built in accordance with the sizes specified on the approved plan. A sign
for lateral passage has been placed on the pier:

As the project is in compliance with the Order of Conditions and the approved plan, the
Applicant requests that a Certificate of Compliance be issued at this time. If you have any

Order of Conditions (OOC). If the project received an OOC from the Conservation Commission, submit
this request to that Commission. If the project was issued a Superseding Order of Conditions or was the
subject of an Adjudicatory Hearing Final Decision, submit this request to the appropriate DEP Regional
