(Coneco) is requesting that the Yarmouth Conservation Commission issue a Certificate of Compliance for the 1975 Order of Conditions (OOCs) issued in association with the 62 Highbank Road (Bass River Golf Course) Pond Creation Project. This Request for a COC is for the OOC issued under the Massachusetts Wetland Protection Act (M.G.L. c. 131, § 40.) and its implementing Regulations at 310 CMR 10.00 and the Yarmouth Wetlands Bylaws. The OOC was issued for this project and recorded at the Barnstable Registry of Deeds. The work under this Order was satisfactorily completed. •MA DEP File No. 83-27 - Issued March 26, 1975 - Recorded in Book 843, Page 417 (June 3, 1953) - Expired March 26, 1978. Because the exact location of the proposed pond project was unclear in the 1975 sketch plan by Thomas Kelley PLS, several generations of golf course managers presumed that the pond referred to in the permit was an expansion of the wetland area to the south of the 2nd (formerly 11th) green and that it was not built. Coneco looked at historic aerials and it actually does look like the pond referred to in the permit was built sometime between the two aerials we could find from that period of time (1973 and 1985; attached). Since the pond was permitted (and presumably built) 48 years ago it is likely that the pond limits are different than when it was originally constructed. I can tell you based on my site visits that the “pond” is there in approximately the correct location and configuration as shown on the 1975 sketch attached to the OOC. The applicant wishes to pursue a Certificate of Compliance in order to close out the project. There have been no impacts to any resource areas or buffer zones as a result of this project.
