PROJECT NARRATIVE This project involves the removal of a culvert structure in a drainage system for a cranberry bog. The drainage system previously served bogs on the subject and adjacent properties, but not only serves to drain the bogs to the south of Weir Road. The applicant believes that the project is exempt under clause 36 of the Wetlands Protection Act, G.L. ch. 131, Sec. 40, which exempts the2maintenance of drainage and flooding systems of cranberry bogs." However, it is subject to the Yarmouth Wetland Bylaw and, as such, the applicant has simply filed to obtain a permit under both the WPA and the Bylaw. The project will proceed as follows. First, a mini -excavator and a small dump truck will be located adjacent to the culvert. The culvert and supporting stone will be removed and material placed into the dump truck. Second, the removed material will be disposed of off -site outside of Conservation Commission jurisdiction. Under consideration are sand and gravel facilities on Great Western Road in Dennis or in the sand pit at the adjacent cranberry bog south of Weir Road. Culvert piping will be disposed of at a solid waste facility unless suitable for reuse by the bog owner. Third, excavation will result in banks on each side of the excavated area following the contours of adjacent banks and excavation will match existing bottom depths_ Fourth, once the excavator and dump truck are removed the area will be inspected for damage to the buffer zone and repaired pursuant to the previously approved seeding plan. To minimize damage to the buffer, work only will proceed during relatively dry conditions_ The project is being performed to ensure that flow is no longer impeded in the ditch at the request of the neighboring property owner as part of a settlement of claims that the ditch was allegedly causing flooding of their property 8T55 T562 2000 oThS 220L 9155 ` 962 2000 0'Ch© 220L 611111111111111111111111111il 2204 a LU 1055 T562 2DOD OThO 220L 2055 1562 2000 OT-hO 220L b ' x pYIL 61 2ESS T560 2000 O'Ch0 2204 2E55 T562 2000 D'1hQ 220L --emovw 'd J2/f ail V 6Z,E ,r ■ g u da EILI 5255 T562 2000 DTbO 2204 26L T962 2DQ❑ UTho 220L 2E6L 1111111111111111111111111 T562 2000 O'Ch0 220L i7
