To Whom it May Concern,
October 17, 2023
This letter constitutes a formal enforcement order under MGL Ch 40A, the Zoning Act. This notification is to
advise that you are in violation of Petition #4801 in relation to clearing your property located at 473 Station
Ave. South Yarmouth.
Petition # 4801 was approved by the ZBA and filed with the Town Clerks office on Sept. 5, 2019.
A revised landscape plan dated 7/31/2019 was presented to the ZBA indicating that several existing trees were
to remain as part of the approved plan.
It has come to my attention deviations of the approved landscape have taken place without prior approval from
the ZBA. You are hereby ordered to restore the landscaping to its approved condition or, in the alternative,
apply to the ZBA for an amended approval. Either such remedy is required within thirty (30) days of this letter.
Your legal counsel should advise you regarding the next steps.
You may appeal this violation notice under the Zoning Act and Yarmouth Zoning Bylaws to the Yarmouth
Zoning Board of Appeals in accordance with G.L c. 40A, within 30 days of this letter.
If you feel that the circumstances described herein are not accurate, please provide me with proof to the
contrary within said thirty days.
