The petitioners requested a special permit under section 175-4400, for the construc-
tion of a steel bulkhead seaward of an existing deteriorating timber bulkhead.
Members of Board of Appeals present: Morris Johnson, James MacNeill, Donald Henderson,
David Oman, Augustine Murphy.
It appearing that notice of said hearing has been given by sending notice thereof
to the petitioner and all those owners of property deemed by the Board to be affected
.� thereby and that public notice of such hearing having been given by publication in the
Dennis -Yarmouth Register on 3/8/84 and 3/15/84, the hearing was opened and held on the
date first above written.

Reasons for decision:
This is a request for a special permit to construct a steel bulkhead, seaward of an
existing, deteriorating, timber bulkhead. Petitioner submitted a plan to the Board dated
January 6, 1984, showing the existing bulkhead and the new bulkhead. Conservation Com
mission indicated by letter that a public hearing concerning this project was held on
March 15, 1984, and that they will be writing orders of conditions to control the propose(
work. The Planning Board, by letter, deferred to Conservation CoT�mission,and the Board of
Health, by letter, indicated it saw no problem with the project, The Board is satisfied
that the proposal will not cause any undue nuisance, hazard or congestion, and will not
harm the established or future character of the neighborhood or town, and consequently,
the special permit is granted as requested,
Members of Board voting: Morris Johnson, James MacNeill, Donald Henderson, David Oman,
Augustine Murphy. Unanimous in favor of granting as requested.
Therefore, the petition is granted as requested for the above stated reasons.
No permits issued until 20 days from the date of filing the decision with the Town Clerk.

HYANNIS MARINER SERVICE
This memo is regarding the above appeal number. It is to
allow, under Section 175-4400, the construction of a steel
bulkhead seaward of an existing deteriorating timber bulk-
head.
This department foresees no problem at this time. Anv ex-
cavated soil must be deposited properly with the location
approved by Conservation and Health Department.
