Since the structure on this site is over 75 years old, this request is automatically subject to the provisions of the Yarmouth Town By-Law, Chapter 92: Historic Properties. Because the barn/garage is not listed as a contributing structure in a National Register District, the YHC can move forward and allow the Town to issue a permit for the demolition of this structure without referral to the Cape Cod Commission. On September 14, 2023 the Commission voted unanimously that despite its deplorable condition, the barn/garage located on this property is a significant structure as defined in Chapter 92-2. This decision was based on documentation and materials gathered by the Commission, along with their observations during a site visit on August 17. On October 12, 2023 a public hearing was held in accordance with Chapter 92-3 to gather information in order to make a determination whether or not demolition of this structure would be detrimental to the historical, cultural, or architectural heritage of Yarmouth. On Thursday, October 12, 2023 at the regularly scheduled monthly meeting held at 10:00 AM and in compliance with Yarmouth Town By-Law, the Historic Commission voted unanimously on the following items: 1. The demolition of the barn/garage located at 176 Old Main Street, South Yarmouth, MA, would be detrimental to the historical, cultural, or architectural heritage or resources of the Town of Yarmouth. 2. Believing there is a reasonable likelihood some other person or group is willing to purchase, preserve, rehabilitate, or restore the barn/garage since the property has been listed for sale by the owner,the Commission voted to impose the 180-day demolition delay period. Upon advice of Town Counsel, the demolition permit may be transferred from the current owner to a new owner. The current owner will need to submit a letter to the Building Department removing their name from the permit as the responsible party. The new owner will need to supply the Building Department with information sufficient to be determined qualified to assume responsibility for the permit. Once approved by the Building Commissioner, the current permit including the demolition delay period,would be transferred.
