Dear Ms. DiRienzo and Conservation Commissioners:
Below are the comments sent to Coneco Engineers & Scientists on October 18, 2023 by Brittany
DiRienzo. The comments are in regard to the Notice of Intent (NOI) submittal for the proposed
cart and pedestrian path bridge on the Bass River Golf Course. Ms. DiRienzo’s questions are
numbered below as 1 to 5. The Coneco responses are listed as bullet points in Bold.
1.To meet the plan requirements, mean High and mean low water must be identified on the
plan.
Per the plan requirements Coneco’s survey was conducted using NAVD88 as the
datum. We established an observation gauge at the crossing location, took
readings over a five-day period in late August, and note that the tidal range is
approximately 20 inches at this location. Coneco’s surveyors tied the gauge into
NAVD88. MLT (MLW) is at elevation 0.44 feet and MHT (MHW) is at 2.10 feet. We
have put these elevations on the plans. Scott Gilmore notes that even during King
Tides the creek never overtopped the old bridge.
2.After further discussion with Andrew from DEP, this filing does not qualify as a limited
project. An alternatives analysis is required to comply with 310 CMR 10.58. Since the
bridge did not exist at the time of the application filing, it is not a remove and replace.
We have recently worked on another project where a bridge was removed and years
later replaced. The DEP considered this as a replacement project. We have also
recently worked on 6 bridge and boardwalk replacement projects for DCR that were
all allowed as Limited Projects under 310 CMR 10.53(3)(j) and 10.53(6) by both
Conservation Commissions and the DEP (NERO and WERO). Additionally, under
310 CMR 10.24(7)(2) this project also appears to qualify as a Limited Project.
We disagree that this bridge replacement should be considered as a new bridge.
The bridge is being replaced now because funding is available, and it was not
available at the time the old bridge was damaged and removed to prevent a public

safety risk. Regardless, this project qualifies under 310 CMR 10.58(5) as a
redevelopment project. As shown on the plans and the attached 2 images the
project elements within Riverfront are all located withing previously developed
RFA. As such an alternatives analysis and selection of a LEDPA is not required.
This project is proposed to eliminate a public safety issue. When the damaged
bridge was removed golfers (both those in carts and those walking the golf course)
were forced to follow a path through the woods following the east bank of the tidal
creek to the point on the 13th golf hole where they could cross to the west of the
creek because the creek is contained in a culvert under the 13th hole fairway. Upon
exiting the woods the golfers are directly in line with the tee shots of the golfers
playing the 13th hole. This unsafe condition would be eliminated by replacing the
former bridge. In addition this path and another on the west side can be eliminated
and the areas restored if the Commission finds this beneficial. There is no other
alternative to get from the 18th tee to the 18th green (and therefore back to the
clubhouse and parking lot) than by either unsafely walking backwards along the
13th hole or by crossing a bridge over the tidal creek. The Least Environmentally
Damaging Practicable Alternative (LEDPA) is to replace the bridge in the location
where the old one stood for decades which is the narrowest crossing location. Any
other location along the creek would result in a longer crossing of the creek and
adjacent wetland resource areas.
3. Structures over salt marshes must be designed at a height to width ratio of 1:1, although
the Division of Marine Fisheries prefers a ratio of 1.5:1.
Although we understand the reasoning for this guidance and have discussed this
on multiple occasions with the DEP, putting the golf cart bridge 6 to 9 feet in the air
would significantly increase the cost of the project to the Town, would likely require
placing the structure on piers rather than clear spanning the resource area, would
require railings, would require significant regrading of the paths to meet the bridge
deck height, and would interfere with the play of the golf hole. This could, in fact,
cause more damage to the resource areas than will be done by simply replacing a
crossing that had existed for decades.
Neither 310 CMR 10.32 nor the Town’s Regulations (Section 2.06) contain this
requirement. In fact, 310 CMR 10.32(4) and the Town’s bylaw both state
“Notwithstanding the provisions of 310 CMR 10.32(3), a small project within a salt
marsh, such as an elevated walkway or other structure which has no adverse
effects other than blocking sunlight from the underlying vegetation for a portion of
each day, may be permitted if such a project complies with all other applicable
requirements of 310 CMR 10.21 through 10.37.” As proposed this project complies
with this performance standard.

4. Except for the helical pilings, no further activity may take place in the salt marsh, including
the addition of fill. At this time, the project does not meet the performance standards set
forth in 310 CMR 10.58 or 10.32.
We have removed all grading and restoration plantings formerly proposed in the
disturbed salt marsh area adjacent to the bridge. A revised set of design plans is
attached as is a revised WPA Form 3. The only elements in salt marsh are four (4)
helical piles. The project complies with all of the performance standards of 310
CMR 10.32 and 310 CMR 10.58.
5. To complete the application and be scheduled for a hearing, please provide an alternatives
analysis including options that minimize adverse impact to the resource areas present and
pick the design with the lowest impact.
As noted above, as a redevelopment project under 310 CMR 10.58(5) an
alternatives analysis and selection of a LEDPA is not required. 310 CMR 10.58 (5)
states “Notwithstanding the provisions of 310 CMR 10.58(4)(c) and (d), the issuing
authority may allow work to redevelop a previously developed riverfront area,
provided the proposed work improves existing conditions. Redevelopment means
replacement, rehabilitation or expansion of existing structures, improvement of
existing roads, or reuse of degraded or previously developed areas.” This project
proposes to reuse previously degraded areas. We have discussed alternative
means of access from the 18th hole tee to the green and clubhouse above.
On behalf of the Town of Yarmouth we request that the NOI be heard at your next available public
meeting on November 2nd. We have met all of the requirements for a completed filing as required
by the WPA and the Town Bylaw. We understand that you, and perhaps the Commission, still
have questions and concerns about the project. We need to appear at a public meeting of the
Commission to hear and respond to their concerns and those of the public. Please do not hesitate

B. Fees
Fee should be calculated using the following process & worksheet. Please see Instructions before
filling out worksheet.
Step 1/Type of Activity: Describe each type of activity that will occur in wetland resource area and buffer zone.
Step 2/Number of Activities: Identify the number of each type of activity.
Step 3/Individual Activity Fee: Identify each activity fee from the six project categories listed in the instructions.
Step 4/Subtotal Activity Fee: Multiply the number of activities (identified in Step 2) times the fee per category
(identified in Step 3) to reach a subtotal fee amount. Note: If any of these activities are in a Riverfront Area in
addition to another Resource Area or the Buffer Zone, the fee per activity should be multiplied by 1.5 and then
added to the subtotal amount.
Step 5/Total Project Fee: Determine the total project fee by adding the subtotal amounts from Step 4.
Step 6/Fee Payments: To calculate the state share of the fee, divide the total fee in half and subtract $12.50. To
calculate the city/town share of the fee, divide the total fee in half and add $12.50.
