RE: Request for Certificate of Compliance,SE83-2270,2 Channel Point Dr,Yarmouth
Pursuant to your Request for a Certificate of Compliance for work permitted under file number SE83-2270,after
review and inspection of the work carried out at the property,the Conservation Commission voted at its public
meeting held on November 16,2023,not to issue a Certificate of Compliance at this time.
The Commission found that the following conditions of the Order have not been met:
14. Any area that is disturbed during construction shall be revegetated Immediately or as soon after as the
growing season commences,with appropriate Native plantings. Permanent stabilization shall be carried
out in order to minimize Erosion.
15.Native vegetation shall be planted per the approved plan and revised notice of intent. The native vegetation
shall be left undisturbed. This is an on-going Condition,that does not expire with the issuance of a
certificate of compliance. The applicant must wait until the 3rd, growing season is complete before the
request for a certificate of compliance is submitted. During this time period,the
commission/conservation administrator may require additional plantings if it is determined that any
specimens are dead or dying and need replacement.
The following actions shall be taken,and a new Request for Certificate of Compliance may then be submitted:
The silt fence should be removed where possible by cutting it away where it is exposed. Portions that are buried
or have vegetation growing through may remain. The compost sock at the most vertical portion of the bank
should be removed(circled in yellow), and the sock retuned into the bank and secured with metal anchors or
stakes. The sock should be lifted upwards using machinery or by hand and re-installed by staking or anchoring
in place where it has slumped(blue circle). Bare areas in the approximately 3-foot-wide space at the bottom of
bank(and within the sock if possible)should be planted with high marsh/transitional species such as Spartina
patens, Distichlis spicata, Juncus gerardii, and Baccharis halimifolia. Please submit a list of plants that will be
installed.The Commission also requests all plantings be monitored for the 2024 growing season to confirm
plantings become established.A new COC request should be submitted once plants have been established, after
at least one full growing season.
