The use of the restaurant in a residential zoning district is a non -conforming use. Any expansion of said use will require further relief from the ZBA in the form of a Special Permit and or Variance. As you know, my client, Harbor Club Inc. d/b/a Tugboats is requesting approval to permit entertainment accessory to the restaurant use as proposed in its filing with the ZBA. The accessory use provision is cited as Q3 in the Use Regulation Table. The use must be customarily incidental to the primary use and not detrimental to the neighborhood. Entertainment can be considered incidental to a restaurant. The numerous letters from abutters in support of the entertainment is evidence of the fact that it would not be detrimental to the neighborhood but would instead benefit the neighborhood. Please issue your approval for my client to provide entertainment as may be limited by the licensing authority in its future petition for an entertainment license. Thank you. Regards, Steve Steven J.
