Work Description (use additional paper and/or provide plan(s) of work, if necessary): The proposed project entails a house addition within the outer limits of the 100 Buffer Zone to Bordering Vegetated Wetland (BVW) and 100-200 Riverfront Area (RFA). The proposed addition will result in an additional disturbance of 140 square feet (sf) (of which only 25 sf is new disturbance) in the 200 RFA and 110 sf (of which only 26 sf is new disturbance) of additional disturbance in the 100 Buffer Zone to BVW. In addition, 51 sf of proposed mitigation plantings in 0-50 Buffer Zone to BVW and RFA is proposed. An area of 400 sf of disturbed area within BVW will be allowed to restore naturally. Under the 310 CMR 10.02 (2)(b)(2)(e) the conversion of lawn to uses accessory to residential structures, such as small additions, may not be subject to the WPA and associated regulations, as long as the project activity and stockpiling/staging is conducted more than 50-feet from the mean annual high water line within RFA or 50-feet from BVW and sediment/erosion controls are employed during construction. The project complies with these requirements, as well as requirements under the Yarmouth Wetlands Protection Bylaw, therefore this project may be exempt from having to file an NOI. 3. a. This application is being submitted in accordance with the Massachusetts Wetlands Protection Act and the Town of Yarmouth Wetlands Protection By-law. 2.0 SITE DESCRIPTION The property located at 70 Breezy Point Road contains a single-family home. The property is bordered by single-family homes to the north, west, and south and by wetlands associated with The Run (creek) to the east. The wetland resource areas and areas of conservation jurisdiction on the site that are protected under the Wetlands Protection Act and the Town of Yarmouths Wetland Protection Bylaw include: •200-Foot Riverfront Area (RFA) •Bordering Vegetated Wetland (BVW) •Land Subject to Coastal Storm Flowage FEMA Flood Zone AE (Elevation 12 & 11) 3.0 PROPOSED ACTIVITIES The purpose of this application is to authorize the following activities: The proposed project entails an addition to an existing single-family dwelling within the outer portion of the 100 Buffer Zone to BVW and within the 100-200 RFA to The Run creek, a perennial stream associated with Crowell Pond to the south of the Site. The proposed addition is proposed over 140 square feet (sf) of existing lawn and driveway within the 100- 200 Riverfront Area, however because a large portion of the addition is proposed within the footprint of the existing driveway, this will only result in 25 sf of new disturbance within RFA. Similarly, 110 sf of the addition is proposed within the 100 Buffer Zone to BVW, however, a net increase 26 sf of impervious area outside of the driveway is anticipated. A proposed section of the addition will be cantilevered by 2 feet (ft) to meet septic setbacks. In 1.09, (4) General Requirements (d) Setbacks (2) of the Yarmouth Wetland Regulations, it is stated that, "Minor structures such as shed, decks, and small additions may be allowed closer than 50 feet to a Resource Area, but no closer than 35". The proposed addition would qualify as a minor structure and is proposed between the 50’-100’ Buffer Zone to BVW and 100’-200’ Riverfront Area (RFA). Similarly, the project qualifies as a minor activity within Buffer Zone under WPA 310 CMR 10.02(2)(b)(2)(e), which includes conversion of lawn to accessory structures to single-family dwellings, so long as the project activity and stockpiling/staging is conducted more than 50-feet from the mean annual high-water line within RFA or 50-feet from BVW and sediment/erosion controls are employed during construction. As the proposed project will not result in the disturbance of naturally vegetated areas or ground disturbance beyond the limits of the addition, no significant impacts to RFA or the 100-foot Buffer Zone to BVW are anticipated. Request for Determination of Applicability 70 Breezy Point Road South Yarmouth, Massachusetts 4.0 MITIGATION Proposed mitigation required for 25 sf of new impact within RFA for includes 51 square feet of mitigation plantings in 0-50 Buffer Zone to Bordering Vegetated Wetland and 0-100-foot portion of RFA. The mitigation plantings will consist of 9 Lowbush Blueberry (Vaccinium angustifolium). In addition to the 51 sf of lawn conversion to mitigation planting area, approximately 400 sf of disturbed areas within the BVW will be allowed to return to a natural state. Staked straw wattles and silt fence will be installed at the limit of work as sediment control and will be maintained until the site reaches appropriate levels of stabilization. All stockpiling and placement of roll-off containers will be staged as far from the resource areas and associated buffer zones as possible.
