Notice of the hearing has been given by sending notice thereof to the Petitioner and all those owners
of property as required by law, and to the public by posting notice of the hearing and publishing in
The Register, the hearing opened and held on the date stated above.
The Petitioner seeks a Special Permit pursuant to Zoning Bylaw § 104.3.2, in order to alter or extend
a legally pre-existing non -conforming single family dwelling into the front yard setback. The
Property is located in the R-40 Zoning District and is improved with a one '/2 story single family
structure having 3 bedrooms and 2 baths, and constructed in approximately 1900. The lot
consists of 65,439 square feet. In addition to the main dwelling, there is also constructed a
detached garage, small storage shed, and a barn located near the rear boundary of the property.
None of these accessory structures will be altered as part of this project. The house currently
encroaches into the front yard setback by approximately 10.5 feet at the front covered porch, but
meets all other setback requirements. The building coverage currently measures 6.3%.
The proposal includes three separate additions to the main house, 2 of which are permitted by
right as they encroach no further into any setback than the existing structures, the height of
which will not be taller than the existing peak measurement. The third addition, consisting of a
covered porch along the front of the home, however, does require relief as the southerly most
portion of that structure will encroach 12 inches further into the front yard setback than the
existing covered porch. The lot coverage increase will be de minimus. The height of the home
will be unchanged.
No abutter or other interested party appeared either in favor or in opposition to the Petition. The
Board was in unanimous agreement that the expansion of the structure would not be substantially
more detrimental to the neighborhood, zoning district, or Town, than the existing non-

conforming structure, and that no undue nuisance, hazard or congestion will be created.
Accordingly, a Motion was made by Mr. Martin, seconded by Mr. Nickinello, to grant the
Special Permit, as requested, without condition. The members voted unanimously in favor of the
motion.
No permit shall issue until 20 days from the filing of this decision with the Town Clerk. Appeals
from this decision shall be made pursuant to MGL c40A section 17 and must be filed within 20
days after filing of this notice/decision with the Town Clerk. Unless otherwise provided herein,
the Special Permit shall lapse if a substantial use thereof has not begun within 24 months. (See
bylaw § 103.2.5, MGL c40A §9)

said Board of Appeals further certifies that the decision attached hereto is a true and correct copy
of its decision granting said Special Permit, and copies of said decision, and of all plans referred
to in the decision, have been filed.
The Board of Appeals also calls to the attention of the owner or applicant that General Laws,
Chapter 40A, Section 11 (last paragraph) and Section 13, provides that no Special Permit, or any
extension, modification or renewal thereof, shall take effect until a copy of the decision bearing
the certification of the Town Clerk that twenty (20) days have elapsed after the decision has been
filed in the office of the Town Clerk and no appeal has been filed or that, if such appeal has been
filed, that it has been dismissed or denied, is recorded in the Registry of Deeds for the county and
district in which the land is located and indexed in the grantor index under the name of the owner
of record or is recorded and noted on the owner's certificate of title. The fee for such recording
or registering shall be paid by the owner or applicant.

It appearing that notice of said hearing has been given by sending notice thereof to the petitioner and all those
owners of property deemed by the Board to be affected thereby, and to the public by posting notice of the
hearing and published in The Register, the hearing was opened and held on the date stated above.
The petitioner's seeks to re -divide two (2) adjoining residential lots, and to raze and replace the small house
located on one of the lots. For this, the petitioner's seek Special Permits under ¢ 104.3.2 (2) and ¢ 104.3.5, or in
the alternative Variances from the dimensional requirements to accomplish the same results.
The properties are located in the R40 zone, and are adjoining parcels on the easterly side of Old Church Street,
Yarmouthport. Number 40 Old Church Street contains approximately 3,000 square feet of area, and contains a
small one story home, in significant disrepair. Number 32 Old Church Street contains approximately 70,981
square feet of area, and is also improved with an historical single-family home. The petitioner's propose to
enlarge the lot at #40 Old Church Street to a size of 8,540 square feet, by taking a corresponding amount of land
from #32 Old Church Street, which will then contain 65,439 square feet of area. The existing house on #40 Old
Church would be removed, and replace with a new two story, two bedroom single-family home. The new home
would conform to all current setbacks and lot coverage requirements. The lot area adjustment would leave #32
Old Church with more then conforming lot area, and the house would not become any more non -conforming (as
to from setback) then at present.
The house proposed for #40 Old Church is shown in the petitioners architectural plan, by Craftsbury Company,
dated November 14, 2005, and revised January 12, 2006 (Sheets 1-7)(these revised plans were received by the
Board on February 3, 2006). It would be a modest Cape style home, with a shed dormer to the rear. It would be
a two (2) bedroom home only.
The proposal appears to easily meet the requirements for both Special Permits, except for the unusual
circumstances surrounding the creation of the smaller lot (40 Old Church). According to the deeds of record,
the smaller lot was subdivided from the larger parcel in 1953. At that time, the Subdivision Control Law was in
effect in Yarmouth, and the zoning bylaw then required 8,500 square feet of area for a residential lot. This lot
was created by deed only, with no plan of record having been approved or recorded.
The petitioners now propose to submit the plan to the Planning Board, for endorsement, under the Subdivision
Control Law, and propose to make the smaller lot conform to the size requirement it should have had at the time
of the recording of its deed. The petitioner's and members of the audience, further related that the lot was

actually created long before the recording of the formal deal. Apparently the original owner, Mr. Raymond
Cash, traded for the lot, and moved a structure, which became the current house, onto the lot. However, he
failed to record the deed for the property for a number of years. By the time he formally recorded his deal, the
resulting lot was non -conforming. The petitioner's point out that the house is significantly older then the date
of the deed, and that his deed recites that he already lived there at the time of its recording. This explanation,
while largely anecdotal, was confirmed by neighbors and one relative of Mr. Cash.
The Board is reluctant to rely solely on anecdotal evidence of this sort. However, it is noteworthy that Mr. Cash
was not a relative of the owners of the remaining land, and had no other apparent justification of living on this
land for so long unless all concerned had believed that he already owned it. In addition, no effort has ever been
taken by the town to protest this transaction.
One neighbor, to the north, expressed concern for the growth of the home to a second story, due to its effect
upon her privacy in the adjoining back yard. The petitioner agreed to construct a privacy fence, as the neighbor
had requested.
The Board is satisfied that, after this uncontroverted interval of over 50 years, that the petitioner's explanation
may be credited, and is at least as plausible as the alternative. It seems implausible that neither planning,
zoning, nor building authorities would ever have left unquestioned for so long this lots' creation and use, had
there not been some justification for the initial actions of the owners.
The Board therefore finds that the lot was created, by delivery of an unrecorded deed, prior to the adoption of
the Subdivision Control Law and prior to the adoption of zoning in this area. Being a lawfully pre-existing non-
conforming lot, it quakes for treatment under the two provisions of §104 requested. The Board further finds
that the proposed lot re -division will make the lot, and new house, less non -conforming, and will not cause or
exacerbate any pro -existing non -conformities on either property. The Board also finds that the proposed
reconstruction will not be substantially more detrimental to the neighborhood then the existing house.
Accordingly, a motion was made by Mrs. Martin, seconded by Mr. Richards, to grant the Special Permits as
requested, to redivide the lots, as shown on the revised plan, by BSC Group, dated February 1, 2006 and
received by the Board on February 3, 2006, subject to its endorsement by the Planning Board and recording in
the Registry of Deeds, and to allow the replacement of the existing home on the lot at 40 Old Church Street,
with the home shown on the architectural plan filed with the Board on February 3, 2006, by the Crattsbury
Company, Sheets 1-7, on the condition that it be limited to a two (2) bedroom home, as shown, and that a 6'
solid fence be constructed along the northerly boundary of the lot. In the event that the Old Kings Highway
Committee should not approve the fence, then the petitioner will be permitted to substitute an equivalent solid
evergreen buffer, which shall be planted and maintained along the northerly boundary, for the privacy of the
abutting lot.
The members voted unanimously in favor of the motion, the Special Permits are therefore granted. The Board
then moved, seconded and voted to allow the petitioner's request to withdraw, without prejudice, the alternate
request for Variance.
No permit shall issue until 20 days from the filing of this decision with the Town Clerk. Appeals from this
decision shall be made pursuant to MGL c40A section 17 and must be filed within 20 days after filing of this
noticeldecision with the Town Clerk. Unless otherwise provided herein, the Special Permit shall lapse if a
substar}ti5l'rse thereof has not begun within 24 months. (See bylaw § 103.2.5, MGL c40A §9)
