Hi Kathy,
After further review of the process I’d like to add the following now that I have a better understanding.
The creation of the A&R can be done at any time. An A&R is not required to comply with zoning.
Where the issue gets complicated is if any additions to the existing structure or additional structures are sought in the
future. I believe those actions will require zoning relief as the lot is being created and does not comply with zoning.

Yes, as you are changing the property lines again. I do not see any particular issue with what you want to do but the
zoning bylaw does require this process if one or more of the lots will still be non‐conforming.

Thank you for sending along the ANR Plan. My only comment on the plan is to request more space between the lines
to allow for the Planning Board to sign.
After reviewing the plan, one of the lots is currently non‐conforming and would remain non‐conforming per the ANR
Plan. Per Section 104.3.5 – Other Adjoining Non‐conforming Lots of the Yarmouth Zoning Bylaw (Page 12), a Special
Permit from the ZBA is required. We request that you go through the Special Permit process first and include the
Decision Book and Page number on the ANR Plan submitted to the Planning Board. I am copying Dolores Fallon, ZBA
Office Administrator, as she can assist you with filing for the ZBA Special Permit.
