The ANR Plan adjusts the lot lines between two (2) parcels, one of which is non-conforming. Please note that the ANR Plan involves the redivision of a non-conforming lot which will remain non-conforming after the redivision. The Building Commissioner has determined that Section 104.3.5 of the Zoning Bylaw applies, and a Special Permit is required. The applicant chose to submit the ANR Plan for endorsement to the Planning Board prior to obtaining a Special Permit. As endorsement of ANR Plans does not mean the lots created meet zoning regulations and the plan met the other ANR requirements, the Planning Board endorsed the ANR Plan. This is an issue that would need to be resolved when any future work is proposed for the structure. The applicant has six months from the endorsement date of December 6, 2023 to record the plan with the Barnstable Registry of Deeds. Please let me know if you have any questions.
