All lots are currently owned by the Evangelical Baptist Church of South Yarmouth Inc. The ANR Plan adjusts the lot lines between four (4) parcels to create three (3) lots and is subject to relief given in the attached ZBA Decision 4994. The submission was complete and included the required fee, Form A, ANR plan, and the appropriate number of copies. The ANR Plan is entitled, “Plan of Land 1240 Rt. 28, 10 Carter Rd. & 63-69 Pond Street in Yarmouth Massachusetts Approval Not Required Plan”. The Plan was prepared by Kieran J. Healy, PLS, of BSC Group, and is dated and stamped October 26, 2023. The ZBA Decision has been recorded and is referenced on the plan. However, it references a Variance when a Special Permit was issued. The Applicant has been requested to make this modification on the note. This application was received on October 27, 2023, and a decision is required by November 16, 2023 to remain within the 21-day statutory requirements. This project has been placed on the Planning Board Meeting Agenda for November 1, 2023. Planner Suggestion: Recommend the Planning Board make a motion to endorse ANR Plan 2940 prepared by BSC Group as amended to denote the issuance of a Special Permit rather than a Variance.
