DRAFT — MINUTES — JUNE 9, 2014 MEETING
The Old King's Highway Committee met on Monday, June 9, 2014, in the Hearing Room at
Yarmouth Town Hall, 1146 Route 28, South Yarmouth. Members present: Chairman Richard
Gegenwarth, Peter Kimball, W. Leslie Peat and James Liedell, Alternates present, Judith
Recknagel and James Stuart. Members absent: Vice Chair Suzanne Courcier, Staff Present,
Mary Waygan, Administrative Assistant, Department of Community Development
A quorum present, Mr. Gegenwarth opened the meeting with a brief explanation of how the
meeting is run and an explanation of the 1Q-day appeal period. He then stated for the record that
applicants must pick up their paperwork at the OKH office and use the stamped OKH-approved
plans for all town departments. In addition, he explained that the Building Department and OKH
work together to ensure compliance with the OKH-approved plans. To that end, OKH inspects at
framing and occupancy permit times and reports to the Building Department whether the approved
construction has taken place or if changes requiring additional OKH review have occurred. Mr.
Gegenwarth also announced that the meeting was being televised. The regular meeting convened
at 7:15 P.M.
14-AO40 George Ruff (owner) Solar City Corp. (agent); Installing 32 Solar Electric Panels
on roof at 7 Jasmine Street. Alec Meyers of Solar City Corp (agent) represented the
owner and made a presentation of the proposed work. W. Leslie Peat moved to
approve the application for a Certificate of Appropriateness as presented. Judith
Recknagel seconded. Approved Unanimously.
14-A041 Roy & Carolyn Federer (owner); Painting the front of the house and shutters at
86 Shaker House Road. Roy & Carolyn Federer (owner) made a
presentation of the proposed work. W. Leslie Peat moved to approve the
application for a Certificate of Appropriateness as presented. Peter Kimball
seconded. Approved Unanimously.
14-AO42 Nelson & Laureen Gomm (owners) Newpro Windows (agent); new windows at
18 Randolph Road. Greg Labelle of Newpro Window (agent) made a presentation of
the proposed work. W. Leslie Peat moved to approve the application for a Certificate
of Appropriateness as presented. James Liedell seconded. Approved Unanimously.
14-AO43 Mary Ann Gray (owner) Solar City Corp. (agent) install Solar Panels on roof at
11 Thrush Trail. Alec Meyers of Solar City Corp (agent) represented the owner and
made a presentation of the proposed work. W. Leslie Peat moved to approve the
application for a Certificate of Appropriateness as presented. James Liedell seconded.

14-AO44 Historical Society of Old Yarmouth (owner) George Davis Inc. (agent); roof and
gutters at 11 Strawberry Lane. Christine Marzigliano and Judith LeGrande
represented the Historical Society of Old Yarmouth and made a presentation of the
proposed work. Ms Marzigliano stated the Society would make every effort to reuse
the existing wooden gutters. James Liedell moved to approve the application for a
Certificate of Appropriateness as presented. W. Leslie Peat seconded. Approved
Unanimously.
14-AO45 Richard Lupo (owner) Larry Peterson (agent); adding a dormer and reroof at
8 Richard Road. Larry Peterson (agent) represented the owner and made a
presentation of the proposed work. W. Leslie Peat moved to approve the application
for a Certificate of Appropriateness as presented. James Liedell seconded. Approved
Unanimously.
14-AO46 Robert F. & Lois J. Nuss (owner) David A. Olson (agent) construct a free standing
garage, 14' x 28', and a cupola on the house at 764 Route 6A. Robert F. Nuss
(owner) and David A. Olson (agent) made a presentation of the proposed work. W.
Leslie Peat moved to approve the application for a Certificate of Appropriateness as
presented. Peter Kimball seconded. Approved Unanimously.
14-AO47 Richard & Claudine Araujo (owners) paint clapboards and trim on the front of the
house and install an outside shower at 57 Kencomsett Circle. Richard & Claudine
Araujo (owners) made a presentation of the proposed work. Peter Kimball moved to
approve the application for a Certificate of Appropriateness with the following
amendments: 1.) The front door to remain white; and 2.) Outdoor shower located at
option 2 at end of house and constructed with cedar panels with white trim. James
Liedell seconded. Approved Unanimously.
14-AO48 Ken & Janice Lyman (owners) Stephen Babola (agent) replace slider with triple
window unit at 9 Kencomsett Circle. Stephen Babola (agent) represented the owner
and made a presentation of the proposed work. W. Leslie Peat moved to approve the
application for a Certificate of Appropriateness as presented. James Liedell seconded.
Approved Unanimously.
14-AO49 Robert & Sara Hunt (owners) Todd Canara (agent) 7 new windows at
220 Center Street. Todd Canara (agent) and Sara Hunt (owner) and made a
presentation of the proposed work. James Liedell moved to approve the application for
a Certificate of Appropriateness as presented. W. Leslie Peat seconded. Approved
Unanimously.
14-AO50 Claire Laferty (owner) Kevin Fair (agent) 17' x 14' dormer, new windows and a
deck at 85 Pheasant Cove Circle. Neither the owner nor agent was present. On a
motion by W. Leslie Peat, seconded by James Liedell, the Committee voted
unanimously to table this item until the end of the meeting.

14-AO51 Richard Zamachaj (owner) Michael Shamberg (agent) windows, trim, doors, siding,
and shutters at 58 Cross Street. Richard Zamachaj (owner) and Michael Shamberg
(agent) made a presentation of the proposed work. At the request of Ms Recknagel,
Mr. Zamachaj agreed to replace the existing wooden shutters with wooden, louvered
shutters of the same style. Mr. Zamachaj also confirmed that all Azek will be painted.
Peter Kimball moved to approve the application for a Certificate of Appropriateness as
presented. W. Leslie Peat seconded. Approved Unanimously.
14-AO52 Annmarie Cenisio (owner) Daniel Tousignant (agent) pressure treated deck with
steel cable railings at 46 Merchant Ave. Daniel Tousignant (agent) represented the
owner and made a presentation of the proposed work. Mr. Tousignant confirmed to
the Committee that the decking with the cable railing would have a wooden bottom rail
of the style shown on the front page, bottom right corner of the ATLANT brochure.
James Liedell moved to approve the application for a Certificate of Appropriateness as
presented. W. Leslie Peat seconded. Approved Unanimously.

14-AO36 Kathleen McCabe (owner) replace deck with stairs, 4' fence and outdoor rinsing
station in rear of property at 12 Shaker House Road. Old King's Highway
Committee agreed to act on the behalf of the owner. James Leidell moved to
approve the application for a Certificate of Appropriateness as presented. Peter
Kimball seconded. Approved with five members voting affirmatively, and W. Leslie
Peat abstaining.

EXEMPTIONS AND OTHER BUSINESS:
MINUTES: On a motion by Peter Kimball, seconded by James Liedell, the Committee voted to
accept and approve the minutes of April 28, 2014 with the following amendments requested by
Suzanne Courcier by email (June 6, 2014):
• "A-14025" - This should be referred to as 14-A025. The address is 12 Shaker House
Road.
• Fourth paragraph from the end of the playground application: I always say
"appropriateness in setting" not "appropriateness and setting". It's a small change but
distinctly different meanings.

Stuart voting affirmatively and W. Leslie Peat abstaining.
MINUTES: On a motion by Peter Kimball, seconded by Judith Recknagel, the Committee voted
to accept and approve the minutes of May 12, 2014 with the following amendments requested
by Suzanne Courcier by email (June 6, 2014):
• 14-AO29 - We did not approve the electric netting fence, unless attached to a wooden
picket fence to block the view of the netting. So, the minutes should state: "Ms. Courcier
moved to approve with a shingled roof and a wooden picket fence to block the view of
the netting".
• 14-AO39 - Not approved. It was tabled. The applicants did not show up.
with Chairman Richard Gegenwarth, Peter Kimball, Judith Recknagel and James Stuart voting
affirmatively and W. Leslie Peat abstaining. James Liedell was not present for the vote.

The Committee reviewed an email (attached to these minutes) from Suzanne Courcier dated
June 6, 2014 regarding OKH in which reference is made to an email from Chris Koelsch of 8 Old
Church Street dated April 26, 2014 regarding Application #111.1 'Playground Equipment
Upgrade". Un the email Ms Courcier requested an explanation as to why the email from Mr.
Koelsch was not made known.
The Committee was provided with the following correspondence (attached to these minutes):

• Email from Will Rubenstein dated April 28, 2014 regarding Old Kings Highway
Feedback for 6A Playground
• Email from Jan Martin dated April 26, 2014 (and April 28, 2014) regarding the park.
The Committee noted that these three emails were received by the Old King's Highway Office,
but were not provided to the Committee prior to the April 28, 2014 and May 12, 2014 meetings.
It was further noted that this was an oversight and the normal practice is for the Committee to
receive all correspondence.
Mr. Gegenwarth announced that Appeal #2014-1 will be heard on July 1, 2014 at 1:30 PM at
Yarmouth Town Hall Hearing Room. The appeal seeks the reversal of the granting of a
Certificate of Appropriateness for the installation of new playground equipment at 460 Route 6A
has been.
Mr. Gegenwarth also announced that a Training Workshop for the Old King's Highway Regional
Historic District will be held on June 18, 2014 at 6:30 PM at the West Barnstable Community
Building.
Exception 14-EO36 Norman Holcomb (owner) Storm window replacement at 96 Center
Street was considered and approved by the Chairman.
MEETING ADJOURNED: On a motion by Peter Kimball, seconded by Judith Recknagel, the
Committee voted unanimously to adjourn with Chairman Richard Gegenwarth, Peter Kimball, W.
Leslie Peat, Judith Recknagel and James Stuart voting affirmatively. James Liedell was not
present for the vote.

Please allow me to introduce myself. I am Chris Koelsch and together with my wife Susan we are the owners of the
house located on 8 Old Church Street Yarmouthport MA. Built in the mid 1700's our home has been in Susan's family for
several generations and was originally built and occupied by Colonel Joshua Hamblin. We have spent the last five years
painstakingly restoring it to it's original grandeur.
Since we will not be in town on Monday, April 28th and therefore will not be able to attend the meeting
regarding application #111.1, "Playground Equipment Upgrade", we would like this email to be our formal vote and voice
on this subject. We have been following the process, as much as possible, and have studied the project application form
and are verwmuch-anainst the proposed plan for the following reasons:
1) Public Safety: Always first and foremost in our minds. The footprint and size of the added equipment will surely attract
many more people to the, relatively small common, referred to, currently, as the Yarmouthport Village
Playground. Attracting a substantially increased amount of people (mostly young children) to an area with a busy
intersection, directly on route 6A, is very concerning. The lack of sufficient parking to accommodate the expected
increase in park usage will lead to creating further safety concerns, with folks with small children being forced to cross
streets to get to the park.
2) Historic Preservation: The Yarmouthport Village Playground, was historically, not a playground at all, but rather the
common meeting ground for the town. Historic meetings were held over the years, as well as social
gatherings. We believe the plans outlined in application #111.1, with it's large modem plastic structures, are not in line
with keeping this park as a historic common area. In the application under the "Community Benefit" section it is noted that
the benefit is "to play, rest, picnic, fly a kite or just relax". We agree and have enjoyed watching the young families do just
that over the years. We do, however, disagree, that installing huge modern plastic structures, would increase these
benefits. If fact, we believe it would have the opposite effect, creating an over used, loud and disruptive atmosphere for
such a small ( 113 acre) common area_ It should, as it does now remind us of a simpler time, where families enjoy real
quality time together without the need for commercial stimulation, such as large modern playground equipment.
3) Due Process: In the "Community Support" section it is stated that over 200 signatures in support are on
hand_ Although this may very well be the case, we are abutters, and we have never been approached or noted of the
public meetings regarding application 9111.1, nor been asked for our ideas or support.

Dear OXED Committee;
I am a parent of two daughters, aged 9 and 3 and live a mile from the 6A playground in YarmouthPort.
While we are not direct abutters, we have been affected by the removal of much of the playground a few years
ago and are excited about the proposed renovations.
During the winter of 2013/14, my 9 year -old and I attended a community meeting at the church, and she
advocated for monkey bars as part of the new design, because they helped her build confidence as a toddler to
join a gymnastics team. She is now a competitive gymnast!
My wife and I hope that the Committee will consider and approve a treehouse playground design that
incorporates natural colors of tan and green.
Please keep in mind the families of Yarmouth who are non -direct abutters as you make your final decision.

Hi Dorcas - Sorry Tom and I cannot attend the meeting Monday, so here our our thoughts about doing the park the way
it is planned. First and foremost we should think of the children, then the parents and grandparents that will bring the
children. Thus the equipment that is planned is excellent, and the benches are a must. Our 4aersonal history with using
the park starts with Tom who used it as a teenager for basketball; our son who was there from a toddler to adulthood,
especially during middle school - basketball, then lunch at the Martin house, then more basketball; our first two
granddaughters who called it Nini and Papa's Park; our next two grandchildren who also practiced their hitting and
catching for baseball there; and our last grandson who is very disappointed with its present condition. So this wonderful

The Old King's Highway Committee met on Monday, August 26, 2013, in the Hearing Room at Yarmouth
Town Hall, 1146 Route 28, South Yarmouth. Members present: Chairman Richard Gegenwarth, Vice Chair
Suzanne Courcier, and MemberJames Liedell. Members Absent: Member W. Leslie Peat and Alternates
Stanley Kaczynski and Judith Recknagel. Staff Present: C. McLaughlin, OKH Office Adminstrator
A quorum present, Mr. Gegenwarth opened the meeting with a brief explanation of how the meeting is run and an
explanation of the 10-day appeal period. He then stated for the record that applicants must pick up their
paperwork at the OKH office and use the stamped OKH-approved plans for all town departments. In addition, he
explained that the Building Department and OKH work together to ensure compliance with the OKH-approved
plans. To that end, OKH inspects at framing and occupancy permit times and reports to the Building Department
whether the approved construction has taken place or if changes requiring additional OKH review have occurred.
The regular meeting convened at 7:15 P.M.

13-AO86 Walden Way, LLC (owner), Robert Dunphy (agent); install vinyl post -and -rail fence around the
perimeter of the road at Walden Way. Mr, Dunphy had provided the Committee with a written request to table his
application to the September 9 Old King's Highway meeting. The members reviewed his request. Ms. Courcier
then moved to table the application to the September 9 meeting; Mr. Liedell seconded. TABLED: 3-0-0
Gerry Bastian of 16 Collingwood Drive, an abutter to Walden Way, asked to be able to speak at tonight's meeting
because she might not be able to attend the September 9 meeting. The Committee discussed her request and
decided that asking her to return might create a hardship for her. Chairman Gegenwarth asked her to come
forward and address the Committee. Ms. Bastian was opposed to the installation of the fence for several
reasons. First, she questioned the appropriateness of a vinyl fence in the District —particularly, when
homeowners were not allowed to install them. She also detailed a list of complaints against the development of
the area over the years (clearcutting land, broken promises to abutters, etc.) The members listened to her
objections and advised her that they would take them into consideration when the application was heard on
September 9. Ms. Courtier also suggested that Ms. Bastian (if possible) and other abutters attend the meeting to
express their concerns.
INFORMAL DISCUSSION: Route 6A Playground: Dorcas McGurrin of the Recreation Commission will discuss
potential changes at this site. She is looking for information from the Committee regarding OKH requirements.
Ms. McGurrin was not able to attend the meeting. In her place, Pat Armstrong, Director of Parks, Recreation, and
Cemeteries, and Steve Sozanski, Recreation Commission Member, attended. Ms. Armstrong explained that the
Commission would be applying for OKH approval for the revitalization of the Route 6A playground early next year.
Before doing so, the Commission wanted the OKH Committee's advice concerning the appropriateness of colors
and materials of the play equipment, the location of the equipment, and any other items over which the OKH
Committee had regulatory authority. The goal was to gather the information before putting the application (and
pricing) together to streamline the approval process.
Ms. Courcier questioned the appropriateness and necessity of having the playground right on Route 6A; she
asked if other locations, such as Bass Hole, had been explored. Ms. Armstrong replied that several locations in
addition to 6A had been explored, but for a variety of reasons had been ruled out Several meetings with various
groups (abutters, potential users, etc.) had been held to obtain the positions of residents concerning a
playground. Many mothers had objected to Bass Hole in particular due to what they felt was the remoteness of
the area and lack of people available if a problem was encountered and help was needed. Some focus groups
objected to the 6A location, but Ms. Armstrong reminded the Committee that a previous playground had already
been there. Due to arsenic in the wood, it was dismantled piece by piece over the years as each element of the
equipment failed.
Ms. Armstrong stated that the Recreation Commission wanted the planning process to be transparent. To that
end, three public hearings had been held and a variety of opinions (pro and con) had been obtained. Ms.
Armstrong explained that the current plan was to build a play area on the footprint of the previous playground.
The play area would have 3 sections pre-school (ages 2-5), elementary -age (ages 5-12), and swings (ages 2-12).
Equipment would have a matte finish in earth tones. Imaginative, creative play would be encouraged.
Another aspect of the playground would be the refurbish ment/resurfacing of the existing basketball court. One of
the hoops would be removed to limit the use to shooting baskets, not games (which might be louder, encourage
night-time use, and perhaps increase light pollution from car headlights used to light the court for the game).
Ms. Armstrong and Mr. Sozanski provided illustrations of the proposed equipment and site plans to the members.
Ms. Courcier asked if the synthetic rocks pictured with the equipment could be replaced by real rocks. Ms.
Armstrong replied that the synthetic rocks lasted better than the real, which would crack over time and use. She
also questioned whether the playground equipment company would approve such a substitution considering
warranties and safety issues; she felt that the equipment suppliers would want all their elements used. Ms.
Courcier asked who would maintain the area; Ms. Armstrong replied that the Town of Yarmouth would.
Ms. Armstrong also showed the members a catalog of playground equipment similar to that shown in the
illustrations provided to the members. Mr. Gegenwarth preferred the flat, board -style, posts shown in the catalog
to the round, typical -playground equipment posts shown in the illustrations. Ms. Armstrong said that she would be
glad to look into using the flat posts. Mr. Gegenwarth asked about the cushioning under the play equipment. Ms.
Armstrong said that the synthetic antimicrobial material was safer and cleaner than sand, which might be used as
a litter box by animals. Also, removing the sand that remains from the earlier playground would eliminate any
lingering traces of arsenic.
Ms. Armstrong added that their would also be landscaping, additional benches, restoration of existing monuments
and flagpoles, and signboards explaining the history of the park. Mr. Gegenwarth asked to have the benches as
natural as possible, too. Parking will remain the same; no additional parking spaces will be created.
Mr. Gegenwarth summed up the Committee's advice: equipment in natural colors with a matte finish, flat
poles/posts whenever possible, and elements that look like wood as much as possible. Landscaping and other
aspects of the project will be addressed later.

am told that the letter was emailed in advance of the April 28 meeting to Colleen by Chris Koelsch, 8 Old

I am a parent of two daughters, aged 9 and 3 and live a mile from the 6A playground in YarmouthPort.
While we are not direct abutters, we have been affected by the removal of much of the playground a few years
ago and are excited about the proposed renovations.
During the winter of 2013/14, my 9 year -old and I attended a community meeting at the church, and she
advocated for monkey bars as part of the new design, because they helped her build confidence as a toddler to
join a gymnastics team. She is now a competitive gymnast!
My wife and I hope that the Committee will consider and approve a treehouse playground design that
incorporates natural colors of tan and green.
Please keep in mind the families of Yarmouth who are non -direct abutters as you make your final decision.

Please allow me to introduce myself. I am Chris Koelsch and together with my wife Susan we are the owners of the
house located on 8 Old Church Street Yarmouthport MA. Built in the mid 1700's our home has been in Susan's family for
several generations and was originally built and occupied by Colonel Joshua Hamblin. We have spent the last five years
painstakingly restoring it to it's original grandeur.
Since we will not be in town on Monday, April 28th and therefore will not be able to attend the meeting
regarding application #111.1, "Playground Equipment Upgrade", we would like this email to be our formal vote and voice
on this subject. We have been following the process, as much as possible, and have studied the project application form
and are yw much-acminSt the proposed plan for the following reasons:
1) Public Safety: Always first and foremost in our minds. The footprint and size of the added equipment will surely attract
many more people to the, relatively small common, referred to, currently, as the Yarmouthport Village
Playground. Attracting a substantially increased amount of people (mostly young children) to an area with a busy
intersection, directly on route 6A, is very concerning. The lack of sufficient parking to accommodate the expected
increase in park usage will lead to creating further safety concerns, with folks with small children being forced to cross
streets to get to the park.
2) Historic Preservation: The Yarmouthport Village Playground, was historically, not a playground at all, but rather the
common meeting ground for the town. Historic meetings were held over the years, as well as social
gatherings. We believe the plans outlined in application #111.1, with it's large modern plastic structures, are not in line
with keeping this park as a historic common area. In the application under the "Community Benefit" section it is noted that
the benefit is "to play, rest, picnic, fly a kite or just relax". We agree and have enjoyed watching the young families do just
that over the years. We do, however, disagree, that installing huge modem plastic structures, would increase these
benefits. If fact, we believe it would have the opposite effect, creating an over used, loud and disruptive atmosphere for
such a small ( 113 acre) common area. It should, as it does now remind us of a simpler time, where families enjoy real
quality time together without the need for commercial stimulation, such as large modem playground equipment.
3) Due Process: In the "Community Support" section it is stated that over 200 signatures in support are on
hand. Although this may very well be the case, we are abutters, and we have never been approached or notified of the
public meetings regarding application #111.1, nor been asked for our ideas or support.

Hi Dorcas - Sorry Tom and I cannot attend the meeting Monday, so here our our thoughts about doing the park the way
it is planned. First and foremost we should think of the children, then the parents and grandparents that will bring the
children. Thus the equipment that is planned is excellent, and the benches are a must. Our personal history with using
the park starts with Tom who used it as a teenager for basketball; our son who was there from a toddler to adulthood,
especially during middle school - basketball, then lunch at the Martin house, then more basketball; our first two
granddaughters who called it Nini and Papa's Park; our next two grandchildren who also practiced their hitting and
catching for baseball there; and our last grandson who is very disappointed with its present condition. So this wonderful
