Re: 94 Wianno Road — Structure Violation
Dear Mr. Zontini,
Your property, being north of Route 6, is within the Old King's Highway Regional Historic District, the
largest and one of the oldest historic districts in the country. Reference is made to Sections 6 & 8 of the
Old King's Highway Regional Historic District Act as established by Chapter 470 of the Acts of 1973, as
amended and as published in the OLD KING'S HIGHWAY REGIONAL HISTORIC DISTRICT
COMMISSION BULLETIN. This Act requires that all exterior changes and/or additions to settings and
structures be reviewed and approved by the local Old King's Highway Committee prior to work being
started.
It has been brought to the attention of the Yarmouth Old King's Highway Committee, that there are
structures on your property, visible from a public way, that have been constructed without the prior
approval of the Yarmouth Old King's Highway Committee. As such, you are hereby informed that you
are currently in violation of the OKH by-laws for the following reason(s):
1. Construction of exterior structures visible from a public way, without approval from
Yarmouth Old King's Highway Committee for appropriateness and setting.
To clear this violation, you must either remove the structures or present a plan to the OKH Committee,
requesting approval to plant an appropriate landscape barrier to block the view from the public way.
Please contact the Old King's Highway office within 14 business days of receipt of this notice to
discuss your plan of action.
If, at the expiration of the time allowed, these conditions have not been remedied by the removal of the
structures or submission of a landscape plan, such further action will be taken as the law requires.
Any objection or inquiry in reference to this notice should be filed before the expiration of time allowed
for the resolution of this violation.

Also please note that a building permit is not needed unless the structure is over 4 feet high.

I will forward your additional concerns on to the OKH Committee.
Please note that the Old King's Highway does not have purview over items such as tools, saw horses, sinks and
chairs. Their only area of concern, in this situation, is softening the view of the raised garden beds from the public
way. This action is being taken solely in response to one abutter's (your) complaint.
I also should let you know that during their investigation of your complaint, several Committee members noticed a stone
wall located on the corner of your property for which there is no record on file at the OKH office. As such, I have been
asked to inform you that you are in non-compliance of the Old King's Highway bylaws, for the installation of a stone wall
without prior approval from the OKH Committee. A notice is currently being drafted to be sent to you along with an
Application for a Certificate of Appropriateness.

A couple of other things are that when the growing season is over all the yard tools, saw horses, sink, chairs,
etc. stay out. If there was row of evergreens four foot high this would not effect the sun light on the garden
because it does not even get any sun until noon.

Five yews will not cover the length of this area effectively. A row of four foot high arborvitae needs to be 30
feet in length. This would be at least 15 plantings of some evergreens.

Hi Dave -
I don't know what that is about, but it could be that he is preparing the area for some plantings. An application was
submitted to the Old King's Highway office today for approval to plant 5 natural yews along the roadway in front of the
raised gardens to shield the view from the road. The application requires a review by the OKH Chairman which should
take place between tomorrow and Monday. I will make note to let you know when/if this approval is granted.
Would this be an acceptable solution for you?
